PC R 02-1855RESOLUTION NO. 02-1855 A RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION APPROVING VIEWSHED REVIEW 02-013 FOR A SECOND STORY RECREATION ROOM LOCATED AT 135 TALLY HO ROAD; APPLIED FOR BY ERIC AND LEONA WAHL WHEREAS, the applicant has filed for a Viewshed Review, for an interior remodel of RV garage and Mezzanine to second story recreation room for single family house located at 135 Tally Ho Road; and WHEREAS, the Planning Commission of the City of Arroyo Grande has held a public hearing on October 15, 2002 in accordance with City Code; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan and Development Code; and The Planning Commission has approved a Viewshed Review because the following findings were made in an affirmative manner: Findings of Approval: 1. The proposed structure is consistent with the intent of Section 16.16.130 of the Development Code; and 2. The proposed structure is consistent with the established scale and character of the neighborhood and will not unreasonably affect views of surrounding properties; and 3. The proposed structure will not unreasonably or unnecessarily interfere with the scenic view from any other property, judged in light of permitting reasonable use and development of the property on which the proposed structure or expansion is to occur. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Viewshed Review 02-013 with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. COSTELLO,CHAIR i I � RESOLUTION NO. 02-1855 VIEWSHED REVIEW 02-013 PAGE 3 OF 3 EXHIBIT "A" CONDITiQlVS OF APPROVAL Viewshed Review 02-025 Eric and Leona Wahl 135 Tally Ho Road COMMUNITY DEVELOPMENT DEPARTMENT General Conditions This approval authorizes the interior remodel of RV garage and Mezzanine to second story recreation room for single-family house. 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. Development shall occur in substantial conformance with the plans on file in the Community Development Department office. 3. Development shall conform to the Rural Residential (RR) zoning requirements unless otherwise approved. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or emptoyees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition.
