PC R 02-1853RESOLUTION NO. 02-1853 A RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION APPROVING TEMPORARY USE PERMIT 02-025; PLACEMENT OF TWO (2) STORAGE CONTAINERS AT 128 BRIDGE STREET; APPLIED FOR BY THE SOUTH COUNTY HISTORICAL SOCIETY WHEREAS, the applicant has filed for Temporary Use Permit 02-025, for placement of two (2) storage containers located at 128 Bridge Street; and WHEREAS, the Planning Commission of the City of Arroyo Grande has held a public hearing on Temporary Use Permit 02-025 in accordance with City Code; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan and Development Code; and The Planning Commission has approved a Temporary Use Permit because the following findings were made in an affirmative manner: 1. The operation of the two (2) storage containers behind the IOOF Hall building for a maximum of two (2) years will not jeopardize, endanger of otherwise constitute a menace to public health, safety or general welfare, subject to the conditions of approval prescribed in Exhibit 'A'. � 2. The proposed site consisting of a 40'x75' paved area behind the IOOF Hall building is adequate in size and shape to accommodate the temporary placement of two (2) 8'x8'x40' storage containers without material detriment to use and enjoyment of other properties located adjacent to and in the vicinity of the site. (The containers will be placed behind the building and will not be easily visible from Bridge Street, Traffic Way or Branch Street due to existing Creek vegetation, and existing buildings in the vicinity.) 3. The proposed site and temporary use related to permitted construction activities is adequately accessible for fire and security purposes as well as general access traffic not being obstructed. 4. Adequate temporary parking to accommodate vehicular traffic and access to the building and temporary use is� available on-site and in the vicinity, including the north side yard of more than thirty (30) feet. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Temporary Use Permit 02-025 with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. TEMPORARY USE PERMIT 02-025 PAGE30F4 EXHIBIT "A" CONDITIONS OF APPROVAL TEMPORARY USE PERMIT 02-025 South County Historical Society 128 Bridge Street COMMUNITY DEVELOPMENT DEPARTMENT General Conditions This approval authorizes the placement of two (2) 8'x8'x40' containers at the rear of the IOOF Hall for a maximum period of two (2) years or until completion of construction, whichever comes first. That the applicant paint the two containers a compatible neutral earth tone color and retain sufficient material to immediately restore any damage or remove any graffiti that may occur during the two year maximum term of temporary placement. 2. The containers will be located on paved surface and adjoining areas of the site will be kept clean of weeds, debris or any outside storage. Any necessary parking or circulation for the construction activities or temporary use will be provided on-site, without dust, noise or other objectionable factors. 3. Any lighting required for security will be provided in a manner acceptable to the Community Development Director. All outdoor lighting shall comply with Development Code Section 16-48.090 including the requirement for all lights to be shielded and directed away from surrounding properties. 4. Access (loading or unloading of stored materials) will occur during normal construction hours (Monday — Friday, 8:00 a.m. — 5:00 p.m. 5. The Community Development Director may require review and additional consideration of conditions after six months if any complaints are received regarding this use. The Temporary Use Permit shall terminate upon completion of construction, but in no event later than two years from placement. 6. Temporary signs, if any, shall be subject to separate City approval. 7. The applicant shall ascertain and comply with all State, County and city requirements as are applicable to this project. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 9. The applicant shall provide waste containers and the site shall be kept clean and free of debris and litter at all times. 10. Smoking shall not be permitted on the property. "No Smoking" signs shall be conspicuously posted. DEVELOPMENT CODE 11. The project shall conform to the Village Commercial (VC) zoning requirements except as otherwise approved.
