PC R 02-1848RESOLUTION NO. 02-1848 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE-YEAR TIME EXTENSION FOR VESTING TENTATIVE PARCEL MAP 99-002, LOCATED AT 1470 NEWPORT AVE., APPLIED FOR BY BRUCE AND MARGARET SUMMERS WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a one-year time extension for Vesting Tentative Parcel Map 99-002 filed by Bruce and Margaret Summers; and WHEREAS, the Planning Commission approved the project on September 7, 1999; and WHEREAS, the Planning Commission held a public hearing on September 3, 2002 to consider this application in accordance with City Codes; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study and deliberation, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Vesting Tentative Parcel Map 99-002 filed by Bruce and Margaret Summers, with the above findings and subject to the conditions as set forth in Resolution No. 99-1706, attached hereto and incorporated herein as Exhibit "A" by this reference. The expiration of approval for Tentative Parcel Map shall now be September 7, 2003. On motion by Commissioner Guthrie, seconded by Commissioner Brown, and by the following roll call vote, to wit: AYES: Commissioners Guthrie, Brown, Fowler, Keen and Chair Costello NOES: None ABSENT: None The foregoing Resolution was adopted this 3` day of September 2002. COSTELLO, CHAIR COMMUNITY DEVELO�MENT DIRECTOR � 'J � RESOLUTION NO. 02-1848 BRUCE AND MARGARET SUMMERS SEPTEMBER 3, 2002 PAGE 3 of 3 EXHIBIT "A" CONDITIONS OF APPROVAL TIME EXTENSION 02-003 FOR VESTING TENTATIVE PARCEL MAP 99-1706 ► - � •► � •► fitil � I►�ilii«���i � ► � ► � - � : ► � ► This approval authorizes a second one-year time extension for Vesting Tentative Parcel Map 99-002 filed by Bruce and Margaret Summers to subdivide an existing residential parcel of 43,834 square feet into parcels of 30,541.5 square feet and 13,292.4 square feet respectively, located at 1470 Newport Ave 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Vesting Tentative Parcel Map 99-002. 3. Vesting Tentative Parcel Map 99-002 shall automatically expire on September 7, 2003. The applicant may apply for one additional one-year time extension pursuant to Development Code Section 16.12.140. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. For all building permits issued in the subject development, the applicant shall pay those development impact fees which are in effect at the time the permits are issued.
