PC R 02-1842RESOLUTION NO. 02-1842 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TIME EXTENSION 02-001 FOR TENTATIVE PARCEL MAP 99- 003 AND PLANNED UNIT DEVELOPMENT 99-003, LOCATED AT 1171 ASH STREET WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a one-year time extension for Tentative Parcel Map 99-003 and Planned Unit Development 99-003 filed by Billy Sutton to subdivide a 23,566 square foot parcel into three parcels of 10,594, 6,486 and 6,486 square feet located at 1171 Ash Street; and WHEREAS, the Planning Commission approved the project on June 6, 2000; and a WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Tentative Parcel Map 99-003 and Planned Unit Development 99-003, filed by Billy Sutton, with the above findings and subject to the conditions as set forth in Resolution No. 00-1745, attached hereto and incorporated herein by this reference. The expiration of approval for Tentative Parcel Map 99-003 and Planned Unit Development 99-003 shall now be June 6, 2003. On motion of Commissioner Commissioner Brown, seconded by Commissioner Fowler, and by the following roll call vote, to wit: AYES: Commissioner's Guthrie,Fowler, Brown, Keen and Chair Costello NOES: None ABSENT: None the foregoing Resolution was adopted this 18 day of June, 2002. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Tentative Parcel Map 99-003 and Planned Unit Development 99-003. 3. Tentative Parcel Map 99-003 and Planned Unit Development 99-003 shall automatically expire on June 6, 2003. The applicant may apply for two additional one-year time extensions pursuant to Development Code Section 16.12.140. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. For all building permits issued in the subject development, the applicant shall pay those development impact fees which are in effect at the time the permits are issued.
