PC R 02-1838RESOLUTION NO. 02-1838 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM 02-001, AMENDING THE VILLAGE CENTRE PLANNED SIGN PROGRAM REGARDING PRUDENTIAL HUNTER REALTY SIGNS, APPLIED FOR BY PRUDENTIAL HUNTER REALTY, LOCATED AT THE INTERSECTION OF WEST BRANCH AND WESLEY STREETS WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Planned Sign Program 02-001 to amend the Village Centre Planned Sign Program, filed by Prudential Hunter Realty, to replace existing signage with two (2) new wall signs; and WHEREAS, the Planning Commission has held a duly noticed public hearing on this application in accordance with the City Code; and WHEREAS, the Planning Commission has reviewed and considered the information and public testimony presented at the public hearings, the staff report and other information and documents that are part of the public record; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQA Guidelines Section 1531 1(a); and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that the following circumstances exist: 1. The proposed signage has been reviewed by the Architectural Review Committee and was found to be consistent with the Design Guidelines for Historic Districts (D-2.4) which apply to the project site. .- 2. The number, size and material of the proposed signage conforms to applicable development standards. There is nothing in the design or construction of the signs that will be detrimental to the public health, safety or welfare. 3. The location of the trellis structure sign is similar to the existing Blakeslee & Blakeslee sign and would accurately depict the location of the entrance to the Prudential Hunter Realty office and is therefore compatible with the surrounding neighborhood. There is nothing in the design or construction of either sign that would pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Planned Sign Program 02-001, amending the Village Centre Planned Sign Program, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. ATTEST: lain Haworth, Acti a� ission Clerk � C� Costello, Chair AS TO CONTENT: Rob Stror�g, v� Community Developm Resolution No. May 21, 2002 Page 3 of 4 � I GENERAL CONDITIONS EXHIBIT "A" CONDITIONS OF APPROVAL PLANNED SIGN PROGRAM 02-001 130 WEST BRANCH STREET PRUDENTIAL HUNTER REALTY COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes the placement of one (1) 1.5' x 6' wall sign and one (1) 2' x 10' wall sign, to be located as shown on Attachment 1. 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Planned Sign Program Case 02-001. 3. This application shall automatically expire on May 21, 2003, unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 4. , Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of May 21, 2002 and marked Attachment 1. 5. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. BUILDING AND FIRE DEPARTMENT CONDITION 6. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande. Resolution No. May 21, 2002 Page 4 of 4 7. The applicant shall obtain any necessary permits from the City's Fire and Building Department, as determined by the Chief Building Inspector. �,� �
