A RESOLUTION OF THE CITY OF ARROYO GRANDE
PLANNING COMMISSION DENYING VARIANCE CASE
NO. 01-005 TO EXCEED THE FLOOR AREA RATIO (FAR)
FOR A SINGLE FAMILY RESIDENCE, LOCATED AT 1249
MONTEGO STREET, APPLIED FOR BY BRIAN STOTE
WHEREAS, the Planning Commission of the City of Arroyo Grande held a duly noticed
public hearing on February 19, 2002 to consider Variance Case No. 01-005 to exceed the
FAR of 0.40 by 33% for a single family residence located at 1249 Montego Street; and
WHEREAS, as part of its consideration of the application, the Planning Commission
reviewed and considered the information and public testimony presented at the public
hearing, the staff report and other information and documents that were part of the public
record; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, that the following circumstances exist:
1. The strict or literal interpretation and enforcement of the specified regulation would
NOT result in practical difficulty or unnecessary hardship not otherwise shared by
others within the surrounding area. Property owners in the surrounding area have
developed property in adherence to all required property development standards,
including the FAR standard, and the height restriction as applicable on the south side
of Montego Street.
2. That there are NO exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply
generally to other properties classified in the same zone. The required access from
Montego Street and site slope do not constitute extraordinary circumstances or
conditions applicable to the property.
3. That strict or literal interpretation and enforcement of the specified regulation would
NOT deprive the applicant of privileges enjoyed by the owners of other properties
classified in the same zone. Adherence to the FAR standard would still enable the
applicant to build a residence consistent in size and design with other properties
classified in the same zoning district.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby denies Variance Case No. 01-005 with the above findings.

On a motion by Commissioner Guthrie, seconded by Commissioner Fowler, and by the
following roll call vote, to wit:
AYES: Commissioner's Brown, Fowler, Guthrie, Keen, and Chair Costello
