PC R 02-1818RESOLUTION NO. 02-1818 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE- YEAR TIME EXTENSION FOR CONDITIONAL USE PERMIT NO. 99-004 APPLIED FOR BY RAYMOND SMITH WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a one-year time extension for. the construction of an office building at 136 Bridge Street; and WHEREAS, the Planning Commission approved the original project on May 18, 1999 and the amended project on January 5, 2000; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Conditional Use Permit 99-004 and Amended Conditional Use Permit 99-001, with the above findings and subject to the conditions as set forth in Resolution Nos. 99-1696 and 99-1725 and amended by Resolution No. 02-1818, attached hereto and incorporated herein by this reference. The expiration of approval for Tentative Parcel Map 2306 shall now be January 4, 2003. ATTEST: i� ��C�il i�� - ' Lyn Reardon-Smith, Commission Clerk Community Develop � oseph Costello, Chair � AS TO CONTENT: Resolution No. 02-1818 Raymond Smith January 15, 2002 Page3of3 EXHIEiIT "A" CONDITIONS OF QPPROVAL TIME EXTENSION NO. 01-005 136 BRIDGE STREET GENERAL CONDITIONS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes a one-year time extension for Conditional Use Permit (CUP) No. 99-004 as amended by ACUP 99-001, for an office building at 136 Bridge Street in Arroyo Grande, California. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for ACUP 99-001 as approved by Resolution 99-1725. 3. The Amended Conditional Use Permit shall automatically expire on January 4, 2003. The applicant may apply for additional time extensions pursuant to Development Code Section 9-02.140. 4. The applicant shall agree to defend at his/her sole expen�e any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant shall be subject to all currently applicable development fees. � \
