PC R 01-1809RESOLUTION NO. 01-1809 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE-YEAR TIME EXTENSION CASE NO. 01-002 FOR TENTATIVE PARCEL MAP CASE N0. 99-005, LOCATED ON 1196 A AND 1196 B GRAND AVENUE APPLIED FOR BY ORIN B. COCKS WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a second one-year time extension for Tentative Parcel Map Case No. 99- 005 filed by Orin B. Cocks to subdivide a 1,535 square foot condominium office unit into two offices of 1,070 and 465 square feet located at 1 196 A and 1 196 B Grand Avenue; and WHEREAS, the Planning Commission approved the project on November 2, 1999; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Tentative Parcel Map Case No. 99-005, filed by Orin B. Cocks, with the above findings and subject to the conditions as set forth in Resolution No. 99-1708, attached hereto and incorporated herein by this reference. The expiration of approval for Tentative Parcel Map Case No. 99-005 shall now be November 2, 2002. On motion of Guthrie, seconded by Brown, and by the following roll call vote, to wit: AYES: Commissioners Brown, Fowler, Guthrie, Keen, and Chair Costello NOES: None ABSENT: None the foregoing Resolution was adopted this 4 day of December 2001. Cocks December 4, 2001 Page 3 of 3 EXHIBIT "A" CONDITIONS OF APPROVAL TENTATIVE PARCEL MAP CASE NO. 99-005 TIME EXTENSION NO. 01-002 GENERAL CONDITIONS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes a one-year time extension for Tentative Parcel Map Case No. 99-005, subdividing a 1,535 square foot condominium office unit into two offices of 1,070 and 465 square feet, 1 196 A and 1 196 B Grand Avenue, Arroyo Grande, California. 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Tentative Parcel Map Case No. 99-005. � 3. Tentative Parcel Map Case No. 99-005 shall automatically expire on November 2, 2002. The applicant may apply for two additional time extensions pursuant to Development Code Section 9-02.140. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant shall be subject to all currently applicable development fees. �
