PC R 00-1768RESOLUTION NO. 00-1768 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE-YEAR TIME EXTENSION FOR TENTATIVE PARCEL MAP 2306, LOCATED ON THE WEST SIDE OF SOUTH ALPINE STREET BETWEEN CERRO VISTA LANE AND CERRO VISTA CIRCLE APPLIED FOR BY CASTLEROCK DEVELOPMENT WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a one-year time extension for Tentative Parcel hlap 2306 filed Castlerock Development to subdivide a 0.88 acre site into four residential parcels located on the west side of South Alpine Street between Cerro Vista Lane and Cerro Vista Circle; and WHEREAS, the Planning Commission approved the project on January 19, 1999; and WHEREAS, the Planning Commission held a public hearing on September 5, 2000 to amend the Conditions of Approval; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Tentative Parcel Map 2306 filed by Castlerock Development, with the above findings and subject to the conditions as set forth in Resolution No. 99-1681 and amended by Resolution No. 00-1757, attached hereto and incorporated herein by this reference. The expiration of approval for Tentative Parcel Map 2306 shall now be January 18, 2002. The applicant shall comply with all conditions of approval for Tentative Parcel Map No. 2306 as amended by Resolution No. 00-1757. 3. Tentative Parcel Map No. 2306 shall 2002. The applicant may apply for an Development Code Section 9-02.140. automatically expire on January 18, additional time extension pursuant to 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant shall be subject to all currently applicable development fees.
