PC R 00-1760RESOLUTION NO. 00-1760 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM CASE NO. 00-003, APPLIED FOR BY SONNY'S AUTOMOTIVE, LOCATED AT 414 TRAFFIC WAY WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application by Sonny's Automotive for Planned Sign Program Case no. 00-003, with Architectural Review, located at 414 Traffic Way in the Highway Commercial District; and WHEREAS, the applicant is proposing to place four wall signs and one projecting sign on the building at 414 Traffic Way and remove all existing signage; and WHEREAS, the Planning Commission has found that this Planned Sign Program and architectural review is consistent with the General Plan and Environmental Documents associated therewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQA Guidelines Section 1531 1(a); and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: The proposed signs are consistent with the goals, objectives, policies and programs of the Arroyo Grande General Plan. The goals of the General Plan are to encourage economic vitality and business activity, protect investments while preserving the environment and character of the City. Said signs are important to the success of this business and are not out of scale or character with other signs in this zone and vicinity. 2. The proposed signs conform to applicable development standards and provisions of the Development Code, and will not be detrimental to the public health, safety or welfare. 3. The physical location or placement of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Planned Sign Program Case No. 00-003, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. ATTEST: Kathleen Fryer, Co mission Clerk �Q:cu.�C� G��.Q.�, Laurence Greene, Chair AS TO ONT NT: Kerry M C nts, Community Development Director Resolution No. 00-1760 Planned Sign Program Case No. 00-003 Sonny's Automotive September 5, 2000 Page 3 EXHIBIT "A" CONDITIONS OF APPROVAL PLANNED SIGN PROGRAM CASE NO. 00-003 414 Traffic Way Sonny's Automotive GENERAL CONDITIONS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes the placement of four (4) 4 ft. X 8 ft. wall signs, two of which will be located on the Traffic Way frontage of an existing building, and two on the north side of the same building adjacent to the parking lot; and one (1 � 4 ft. X 8 ft. projecting sign.as illustrated in Exhibits "B1- B2". 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Planned Sign Program Case No. 00-003. 3. This application shall automatically expire on September 5, 2002 unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 4. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of September 5, 2000 and marked Exhibit "B1 ". 5. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. DEVELOPMENT CODE 6. Development shall conform to the General Commercial zoning requirements Resolution No. 00-1760 Planned Sign Program Case No. 00-003 Sonny's Automotive September 5, 2000 Page 4 and the Sign Ordinance except as otherwise approved. ARCHITECTURAL REVIEW COMMITTEE 7. Each wall sign will have lathe borders painted to match. The projecting sign will have a border to match wall signs. BUILDING AND FIRE DEPARTMENT CONDITION 9. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande. 10. The applicant shall obtain any necessary permits from the City's Fire and Building Department, as determined by the Chief Building Inspector. ^� �'
