PC R 00-1756RESOLUTION NO. 00-1756 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE NO. 00-006, LOCATED AT 244 OAK PARK BOULEVARD, APPLIED FOR BY THE PEACE LUTHERAN CHURCH WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Conditional Use Permit Case No. 00-006, filed by the Peace Lutheran Church, to expand their meeting hall, add handicapped restrooms and a storage room; and WHEREAS, the Planning Commission has held a public hearing on this application in accordance with the City Code; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for Implementation of CEQA and has determined that the Project is Catagorically Exempt; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: FINDINGS FOR APPROVAL Conditional Use Permit Findings: 1. The proposed use is permitted within the General Commercial district pursuant to the provisions of Section 9-03.050 of the Development Code, and complies with all applicable provisions of the Development Code, the goals and objectives of the Arroyo Grande General Plan, and the development policies and standards of the City. 2. The proposed use will not impair the integrity and character of the district in which it is to be established or located because the proposed use is similar to surrounding uses. 3. The site is suitable for the type and intensity of use or development that is proposed because all the necessary easements, circulation, parking and setbacks would be provided. 4. There are adequate provisions for water, sanitation, and public utilities and services to ensure the public health and safety. 2. The proposed use will not be detrimental to the public health, safety, or welfare, or materially injurious to properties and improvements in the vicinity because the proposed project would not create adverse environmental impacts. Resolution No. 1756 Peace Lutheran Church Page 2 Architectural Review Findings: 1. The proposal is consistent with the General Architectural Review Guidelines for the City of Arroyo Grande. 2. The proposal is consistent with the text and maps of the Arroyo Grande General Plan, and the City of Arroyo Grande Development Code. 3. The proposal will not be detrimental to the health, safety, comfort and general welfare of the persons residing or working in the neighborhood of the proposed project. 4. The general appearance of the proposed building is consistent with the character of the neighborhood because the size and design are consistent with other commercial buildings in the vicinity. � � The proposal is not detrimental to the orderly and harmonious development of the City. The proposal will not impair the desirability of investment or occupation in the neighborhood. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Conditional Use Permit No. 00-006, with the above findings, and to the conditions set forth in Exhibit "A", attached hereto and incorporated herein by this reference. ATTEST: �� Kathleen Fryer, Commissi Clerk AS TO �ONTENT: Laurence Greene, Chair Kerry cC nts, Community Development Director Resolution No. 1756 Peace Lutheran Church Page 3 EXHIBIT "A" CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 00-006 PEACE LUTHERAN CHURCH, LOCATED AT 244 OAK PARK BOULEVARD General Conditions This approval authorizes the 1,588 square foot expansion of the church meeting hall to include two new handicapped restrooms, additional meeting area and a storage room. The project is located at 244 Oak Park Boulevard, City of Arroyo Grande. The applicant shall comply with the following conditions: The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Conditional Use Permit Case No. 00-006. 3. This application shall automatically expire on August 1, 2002 unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 4. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of August 1, 2000 and marked Exhibit "B". 5. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Community Development Department 6. All outdoor lighting associated with nonresidential uses shall be shielded and directed away from surrounding residential uses. Such lighting shall not exceed 0.5 foot-candles of illumination beyond the property containing the nonresidential use, and shall not blink, flash, oscillate or be of unusually high intensity or brightness. Building Department 7. Prior to relocation of parking lot light, an Electrical Permit shall be obtained through the Building Department. Resolution No. 1756 Peace Lutheran Church Page 4 8. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande. PRIOR TO ISSUING A CERTIFICATE OF OCCUPANCY: 9. The appticant shall post designated fire lanes, per Section 22500.1 of the California Vehicle Code. All fire lanes must be posted and enforced , per Police Department and Fire Department guidelines. 10. Two fire hydrants shall be installed on the project site, one near the southeastern portion of Educational Building 1 and the other located on the western edge of the property per approval of the Director of Building and Fire: 1 1. A rated firewall shall be constructed on the eastern section of the project addition per approval of the Director of Building and Fire. 12. Applicant must provide an approved "security key vault" per Building and Fire Department guidelines. 13. Fees - The applicant shall pay all applicable City fees prior to issuance of a Building Permit. Public Works Department 14. Fees - The applicant shall pay all applicable City fees at the time they are due. 15. Site maintenance - The developer shall be responsible during construction for cleaning city streets, curbs, gutters and sidewalks of dirt tracked from the project site. The flushing of dirt or debris to storm drain or sanitary sewer facilities shall not be permitted. The cleaning shall be done after each day's work or as directed by the Director of Public Works or the Community Development Director. 16. Site plan — The site improvement plans shall include the following: a. The location and size of all water, sewer, and storm water facilities within the project site and abutting streets or alleys. b. The location and size of all sewer laterals. c. The location, size and orientation of all trash enclosures. d. All parcel lines and easements crossing the property. e. The location and dimension of all paved areas. f. The location of all public or private utilities. g. Plan and profile drawings of existing and proposed streets and utilities. h. Retaining wall locations and details. 17. Inspection agreement — Prior to approval of any improvement plans, the applicant shall enter into an agreement with the City for inspection of the required improvements. Resolution No. 1756 Peace Lutheran Church Page 5 18. Encroachment permits - The applicant shall be responsible for obtaining an encroachment permit for all work within a public right of way. 19. Grading - All grading shall be done in accordance with the City Grading Ordinance. 20. Curb, gutter and sidewalk - Curb, gutter, & sidewalk along Oak Park Boulevard shall be installed fronting the property in accordance with the Public Improvement plans for Oak Park Boulevard and Grand Avenue prepared for the City by EDA (Engineering Development Associates) and approved by the City on June 14, 1999. These improvements are included in the City capital improvement project. 21. Street widening - Oak Park Boulevard shall be widened fronting the property in accordance with the Public Improvement plans for Oak Park Boulevard & Grand Avenue prepared for the City by EDA (Engineering Development Associates) and approved by the City on 6/14/99. These improvements are included in the City capital improvement project. GRADING AND DRAINAGE 22. Grading - All grading shall be done in accordance with the City Grading Ordinance. PUBLIC UTILITIES 23. New Utilities - All new public utilities shall be installed as underground facilities. 24. Underground Utilities - Existing overhead utilities shall be placed underground as shown in Figure 1. 25. Utility review - All improvement plans shall be submitted to the public utility companies for review and comment. Utility comments shall be forwarded to the Director of Public Works. PRIOR TO ISSUING A BUILDING PERMIT: PRIOR TO ISSUING A CERTIFICATE OF OCCUPANCY: 26. Documents - The Certificate of Compliance and all easements, abandonments, or similar documents to be recorded shall be prepared by the applicant on 8.5 x11 City standard forms, and shall include legal descriptions, sketches, closure calculations, and a current preliminary title report. The applicant shall be responsible for all required fees, including any additional required City processing fees. 27. Recordation - At the time of recordation, copies of all recorded documents shall be submitted to the City on either mylar sheets or 8%2" x 1 1" archival quality paper. Oak Park Boulevard dedication of Right of Way - A offer to dedicate shall be dedicated fronting the property in accordance with the Public Improvement plans for Oak Park Boulevard & Grand Avenue prepared for the City by EDA (Engineering Development Associates) and approved by the City on 6/14/99. 29. Utilities - All utilities shall be operational. _J
