A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE APPROVING LOT MERGER
CASE NO. 99-001 AND CERTIFICATE OF COMPLIANCE
CASE NO. 99-002, LOCATED AT 1086 GRAND AVENUE,
APPLIED FOR BY DEBLAUW BUILDERS, INC.
WHEREAS, the Planning Commission of the City of Arroyo Grande has considered
applications for Lot Merger Case No. 99-012 and Certificate of Compliance Case No.
99-002, filed by DeBlauw Builders, Inc., to merge two existing lots of 19,998 square
feet and 23,410 square feet into one lot of 43,408 square feet; and
WHEREAS, the Planning Commission has held a public hearing on this application in
accordance with the City Code; and
WHEREAS, the Planning Commission has found that this project is consistent with
the General Plan and the environmental documents associated therewith; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing that the two existing lots were legally created; and
WHEREAS, the Planning Commission finds that the merged lots comply with the
minimum lot size, lot width, and lot depth requirements of the General Commercial
Zoning District; and
WHEREAS, the Planning Commission directs the Community Development Director to
record a Certificate of Compliance with the County Recorder.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves Lot Merger Case No. 99-001 and Certificate of
Compliance Case No. 99-002, with the above findings and subject to the conditions
as set forth in Exhibit "A", attached hereto and incorporated herein by this reference.
On motion by Commissioner Keen, seconded by Commissioner Costello, and by the
following roll call vote:
AYES: Commissioners Costello, Keen, London, Vice-Chair Parker, Chair Greene
NOES: None
ABSENT: None

CONDITIONS OF APPROVAL
LOT MERGER CASE NO. 99-001 AND
CERTIFICATE OF COMPLIANCE CASE NO. 99-002

COMMUNITY DEVELOPMENT DEPARTMENT
GENERAL CONDITIONS
This approval authorizes the merger of two existing lots of 19,998 square feet and
23,410 square feet into one lot of 43,408 square feet, and the issuance of a
Certificate of Compliance for property located at 1086 Grand Avenue.
1. The applicant shall ascertain and comply with all Federal, State, County and
City requirements as are applicable to this project.
2. The applicant shall agree to defend at his/her sole expense any action brought
against the City, its present or former agents, officers, or employees because
of the issuance of said approval, or in anyway relating to the implementation
thereof, or in the alternative, to relinquish such approval. The applicant shall
reimburse the City, its agents, officers, or employees, for any court costs and
attorney's fee's which the City, its agents, officers or employees may be
required by a court to pay as a result of such action. The City may, at its sole
discretion, participate at its own expense in the defense of any such action but
such participation shall not relieve applicant of his/her obligations under this
condition.
DEVELOPMENT CODE
3. The developer shall comply with Development Code Chapter 9-04, "Land
Divisions".
PUBLIC WORKS DEPARTMENT
GENERAL REQUIREMENTS
1. Fees - The applicant shall pay all applicable City fees at the time they are due.

2. Recording - The Lot Merger shall be finalized by recording a Certificate of
Compliance or a Parcel Map, and by subsequent deed transfers.
PRIOR TO RECORDING THE CERTIFICATE OF COMPLIANCE:
3. Preliminary Title Report - A current preliminary title report shall be submitted to the
Director of Public Works prior to checking the map.
4. Tax Certificate - In accordance with Section 9-15.130 of the Development Code, the
applicant shall furnish a certificate from the tax collector's office indicating that there
are no unpaid taxes or special assessments against the property.
5. Subdivision Guarantee - A Subdivision Guarantee shall be submitted to the Director
of Public Works at the time of Certificate Recordation.
