CONSENT AGENDA The following routine items listed below are scheduled for consideration as a group. The recommendations for each item are noted. Page 3 of 308 9.a Consideration of Cash Disbursement Ratification (VALENTINE) Recommended Action: Review and ratify the attached listing of cash disbursements for the period of April 16 through April 30, 2024. 9.b Resolutions for the 2024 General Municipal Election for the Election of Certain Officers of the City (MATSON) Recommended Action: 1) Adopt a Resolution calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 5, 2024, for the election of certain officers of the City; 2) Adopt a Resolution requesting the Board of Supervisors of the County of San Luis Obispo to consolidate a General Municipal Election to be held on November 5, 2024; and 3) Adopt a Resolution adopting regulations for candidates governing the submittal of a Candidate Statement. 9.c Consideration of Engineer's Reports and Resolutions Declaring the City's Intention to Levy and Collect Assessments (ROBESON) Recommended Action: 1) Approve the Engineer's Reports for the Parkside Village Assessment District, Grace Lane Assessment District, and Arroyo Grande Landscaping and Lighting Assessment District No. 1, within Tract 1769, for FY 2024-25; 2) Adopt Resolutions declaring the intention to levy and collect assessments for the Parkside Village Assessment District, Grace Lane Assessment District, and Arroyo Grande Landscaping and Lighting Assessment District No. 1, within Tract 1769, for FY 2024-2025; 3) Set a public hearing for June 25, 2024, at 6:00 p.m. for the Parkside Village Assessment District, Grace Lane Assessment District, and Arroyo Grande Landscaping and Lighting Assessment District No. 1, within Tract 1769, to consider levying the property assessments; and 4) Make findings that the is categorically exempt from the California Environmental Quality Act ("CEQA") under the Class 2 exemption, which applies to the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. (State CEQA Guidelines, § 15302.) 9.d Consider Four-Year Agreement with the California Department of Corrections and Rehabilitation for Use of Inmate Work Crews (ROBESON) Recommended Action: Adopt a Resolution authorizing the City Manager or his designee to negotiate and execute a Page 4 of 308 four-year agreement to begin July 1, 2024 with the California Department of Corrections and Rehabilitation (CDCR) for inmate community service work crews, with terms substantially similar to the Standard Agreement with the CDCR, Agreement Number C5609432, signed on May 29, 2020. 9.e Monthly Water Supply and Demand Update (ROBESON) Recommended Action: Receive and file the Monthly Water Supply and Demand Update. 9.f Adoption of an Ordinance Amending Title 16 of the Arroyo Grande Municipal Code Regarding Public Art (PEDROTTI) Recommended Action: 1) Adopt the ordinance amending Section 16.16.200 of the Arroyo Grande Municipal Code regarding public art (the "Ordinance"); and 2) Find that the Ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines sections 15060(c)(2) and 15061(b)(3). 10. PUBLIC HEARINGS 10.a Continued Public Hearing to Consider a Resolution Denying the Installation of One (1) Domestic Well on Property Zoned Planned Development(PD); Applicant—Michael Harris; Representative— Richard Burde, SLO Civil Design (PEDROTTI) Recommended Action: 1) Adopt a Resolution denying the request by Michael Harris to drill and install one (1) new domestic well on an unaddressed property on Noyes Road (APN: 007-781-055) northeast of the intersection of Noyes Road and Equestrian Way; and 2) Determine that the denial is not a project subject to the California Environmental Quality Act ("CEQA") because CEQA does not apply to projects which a public agency disapproves or rejects (Pub. Resources Code § 21080(b)(5); State CEQA Guidelines, § 15270(a)), and the denial will not have direct or reasonably foreseeable indirect environmental impacts (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378. 11. OLD BUSINESS None. 12. NEW BUSINESS 12.a Consider Placing a Local Transactions and Use Tax("Sales Tax") Measure on the November 5, 2024 Ballot (DOWNING) Recommended Action: 1) Adopt the proposed Resolution ordering the submission to the qualified electors of the City a measure relating to the establishment of a local transactions and use tax (hereinafter referred to as a "sales tax") at the General Municipal Election to be held on Tuesday, November 5, 2024, as called by Resolution; Page 5 of 308 2) Adopt the proposed Ordinance adding Chapter 3.23 to Title 3 of the Arroyo Grande Municipal Code regarding a transactions and use tax (to ultimately be considered for approval by the voters); 3) Adopt the proposed Resolution setting priorities for filing a written argument regarding a City measure and directing the City Attorney to prepare an impartial analysis of the measure; 4) Adopt the proposed Resolution requesting consolidation with the County of San Luis Obispo General Municipal Election to be held on Tuesday, November 5, 2024; 5) Appoint two members of the Council to serve on an ad-hoc committee for creation of the argument to be submitted in favor of the measure; and 6) Determine that adopting the Resolutions and Ordinance relates to organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment, and therefore is not a project within the meaning of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, section 15378(b)(5). 12.b Discussion and Consideration of Approval of the Fiscal Year(FY) 2024-25 Mid-Cycle Budget Update Report (VALENTINE) Recommended Action: Review the preliminary budget, receive a presentation from staff, and provide feedback to staff in preparation for the public hearing scheduled for June 11, 2024, to consider the Fiscal Years (FY) 2024-25 Mid-Cycle Budget Update Report. 13. COUNCIL COMMUNICATIONS Any Council Member may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council policies and procedures, Council Members may request staff to report back to the Council at a subsequent meeting concerning any matter or request that staff place a matter of business on a future agenda. Any request to place a matter of business for original consideration on a future agenda requires the concurrence of at least one other Council Member. 14. ADJOURNMENT All staff reports or other written documentation, including any supplemental material distributed to a majority of the City Council within 72 hours of a regular meeting, relating to each item of business on the agenda are available for public inspection during regular business hours in the City Clerk's office, 300 E.
