WHEREAS, the State of California relinquished ~ertain real property to the
City of Arroyo Grande, whi~h lies adjacent and westerly of Oak Park Boulevard,
between El Camirui Real and Atlantic City Avenue; and
WHEREAS, the parcel of real prope1:ty described in Exhibit "A" attached hereto
and by referen~e in~orporated herein is part of the strip of property relinquished
by the State of California to the City of Arroyo Grande as above set ferhh; and
WHEREAS, the hereinafter described parcel of property constitutes a strip of
property lying in front of and immediately adja~ent to privately owned property,
and said parcel of property unless used by the City of Arroyo Grande for right of
way purposes will constitute unused ~roperty and will detract from the uSe and
appearan~e of the adja~ent private property, and will constitute a continuous .
obstruction to the free use of the adjacent real property and represent an area
which may be at any time changed as. to its use, and be~ause of the un~ertainty of
the USe of said strip or parcel of property, the adjacent private property will
be seriously depreciated in its value, and
WHEREAS, the City of Arroyo Grande has no prospective use for the hereinafter
described parcel of property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE AS FOLLOWS:
1, The public interest and co.nience will be served if the hereinafter
described parcer of real property set fo1:th in Exhibit "A" attached
hereto is sold and conveyed,
2, That the City Council of the City of Arroyo Grande intends to sell and
convey the parcel of property described in Exhibit "A" attached hereto
and by referen~e incorporated herein, subject to the following restric~
tions, to wit:
a, No person may purchase an, parcel of property except and unless
the purchaser is t~ owner @f a parcel or parcels of real proper~Y
lying immediately adjacent and ~ontiguous to the parcel or parcels,
for which the purchase is attempted, provided that upon the consent
of the owner of the immediately adjacent and contiguous par~el of
real property, a person not the owner of immediately adjacent or
contiguous properi:ymay be permitted to becOllle the purchaser of
the hereinafter described parcel of real property.
b, The minimum bid which will be approved for the parcel shall be as
set forth in the following schedule, to wit:
A single bid of Qne -.ndred Dollars ($100.00),
3, That a hearing will be held in connection with said Council's intention
to sell and convey the parcel qf real proper!:,. described in Exhibit "A"
in accordance with the above restrictions, at whi~h time. any person
objecting to said sale o:r interested therein may appear and be heard
. tlumlal. Said hearing will be held on the 14th day of De~ember, 1971, at
the hour of 8:00 P,M, of said day in the Council Chambers in the City Hall, -
in the City of Arroyo Grande. County of San Dais Obispo, State of California,
4, The City Clerk of the City /Df Arroyo Grande is herewith ordered to publish
this resolution in the Five Cities Times-Press-Recorder at least five (5)
days prior to the date of said hearing,
5, The City Council will, at the con~lusion of said hearing, take action with
respect to the sale of the said par~el of real property, If it decides to
sell the said parcel'of resl property, it will thereupon issue a call for
bids for said parcel of real property, which bids shall be returnable not
less than 5 days after the date of the hearing referred to in Paragraph
3 ab01Pe, The terms of said call for bids will be determined by the City
Council at the conclusion of said hearing referred to in Paragraph 3,
