This Necessity Hearing is the first step to securing temporary construction easements (TCEs) for the Traffic Way Bridge Replacement Project if City is unable to negotiate mutual agreements
with five property owners.
Steps required for a Necessity Hearing:
Staff presentation
City Clerk to note any written objections, protests, or requests to be heard
Open Public Hearing for the property owners to testify before Council
Open regular Brown Act public comment
Close the hearing
Consider adoption of a Resolution of Necessity by 4/5th vote

Bridge is scour critical.

Temporary access to/staging for construction needed across 9 properties for 36 months starting August 1, 2024.
City hired Hamner, Jewell, and Associates for right-of-way acquisition.
Procured preliminary title reports
Obtained third party appraisals for larger easements
Agreement offers made to all nine properties in March – four have already signed
Negotiations continue with remaining properties

Findings
The public interest and necessity require the proposed project.
The project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury.
The real property to be acquired is necessary for the project.
The offer of just compensation has been made to the property owner.

California law requires a Resolution of Necessity after providing property owners opportunity to be heard on each of the following findings:

Traffic Way Bridge needed for traffic circulation.
New bridge reduces future scour potential.
Premature closure will disrupt traffic.
New bridge improves public safety.
Failure to secure easements by August 2024 jeopardizes schedule.

Constructing the bridge elsewhere will require permanent easements.
City only needs temporary easements for project.
A planned replacement project prior to bridge failure is preferable to emergency or premature bridge closure.

Contractor needs access to the construction site.
Heavy equipment and materials need to be stored and staged to facilitate efficient and cost-effective construction.
Not proceeding with construction can lead to an emergency failure or premature bridge closure.

Appraisals were prepared by independent state-licensed third-party appraiser
Offer of just compensation using fair market appraisals was made to each owner of record
