CC 2024-03-12_10a AGMC Update Regarding Accessory Dwelling Units_PP Accessory Dwelling Unit (ADU) Ordinance Update 8/21/2024 1 Background & Purpose ADU Ordinance was last updated in September 2022 to comply with State housing bills passed in 2019 and 2020 Eliminated lot size requirements Reduced setbacks and parking requirements Created objective design standards for ADUs Prohibited front yard ADUs in most circumstances 8/21/2024 2 State Laws Affecting ADUs New bills (2022 and 2023) Ordinance updated to include State mandated changes to: Height limits Owner occupancy Prohibition of front setback standards 8/21/2024 3 Summary of Changes New Permit Type Height Limits Development Standards 8/21/2024 4 Planning Commission January 16, 2024 Recommends CC adopt the amendments with the recommendation to: Increase the maximum height; and Increase the size trigger for development impact fees 8/21/2024 5 ADU Permit State law requires agencies to approve four (4) categories of ADUs with building permit: Conversion of existing space or accessory on SFR lot Detached ADUs on single family lot and less than 800sf ADUs created through the conversion of non-livable space in MFR Up to two detached ADUs on MFR lots with height <18 ft 8/21/2024 6 Height With SFR - 16 feet New height limits for: Detached ADU, MFR - 18 feet.
