MEMORANDUM TO: City Council FROM: Brian Pedrotti, Director of Community Development BY: Shayna Gropen, Assistant Planner SUBJECT: Authorize the Village Holiday Parade and Jingle Bell Dash on December 1, 2024 (TUP 24-008) and Find the Action Categorically Exempt from CEQA DATE: November 12, 2024 RECOMMENDATION: 1) Adopt a Resolution approving Temporary Use Permit 24-008 authorizing the closure of streets and the Arroyo Grande Village Holiday Parade and Jingle Bell Dash to take place in the Village; and 2) Find the action exempt from CEQA pursuant to Section 15304 of the CEQA Guidelines. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The expenses associated with the street closures for this event align with those of a medium road closure, amounting to $15,866 as outlined in the City’s fee schedule effective January 16, 2024. As this is a City-sponsored event, the City will assume responsibility for these costs. In an effort to offset expenses, the City charges an entry fee of twenty-five dollars for the parade and is also pursuing sponsorship opportunities. BACKGROUND: The Arroyo Grande Holiday Parade is a longstanding tradition, having been established by Eddie El Helou, former owner of Broadway Jewelers, in 2003. This event was traditionally held on the Sunday immediately following Thanksgiving, until the City Council directed the event to occur on the first Sunday of December. Historically, the City has co- sponsored the parade; however, beginning in 2022, the City has taken on the role of sole applicant due to the unavailability of a community sponsor. ANALYSIS OF ISSUES: This year’s event is proposed to be held on December 1, 2024, which is both the first Sunday in December and the Sunday following Thanksgiving. The event will include two separate events utilizing the same road closure: the Jingle Bell Dash and the Holiday Parade. The Jingle Bell Dash is a running race for the community’s youth, utilizing the Page 88 of 174 Item 9.e. Jingle bells will be given to all participants to attach to their shoes and the race will be run in a horseshoe pattern with increasing distances for older age groups. There will be five (5) separate categories with ages ranging from Preschool to 6th grade. Registration for the Jingle Bell Dash will begin at 3:30 pm. The races will begin at 4:15 pm and conclude at 4:45 pm to allow enough transition time for the parade to begin at 5 pm. Staging for the event will occur in Olohan Alley. The proposed route for the Holiday Parade will begin with staging starting at the west end of Olohan Alley and the parade will officially begin upon the eastbound entrance to Mason Street, before turning north to East Branch Street. The parade will then continue on East Branch Street, westbound onto West Branch Street, finally turning north on Wesley Street and into the Bank of America parking lot. The parade route requires the following traffic control from 3:00 pm to 8:00 pm on December 1, 2024: 1. “No Parking” restrictions and the closure of Olohan Alley from Bridge Street to Mason Street; 2. “No Parking” restrictions and the closure of Branch Street from Mason Street to Wesley Street; 3. “No Parking” restrictions and the closure of Bridge Street from Nelson Street to Branch Street; 4. Closure of Wesley Street from Branch Street to Larchmont Drive ; 5. Closure of Nevada Street from Branch Street to Le Point Street; 6. Closure of Mason Street from Nelson Street to Branch Street; 7. Closure of Le Point Street from Nevada Street to Miller Way; Staff is proposing the “No Parking” restrictions in Olohan Alley to begin at 12:00 pm and conclude at 8:00 pm on December 1st. A map depicting road closures, detour routes and event areas is included as Attachment 2, and the “No Parking” restrictions will be posted a minimum of 72 hours ahead of the event. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Adopt a Resolution approving Temporary Use Permit 24-008 authorizing the closure of streets and the Arroyo Grande Holiday Parade and Jingle Bell Dash to take place in the Village; or 2. Provide other direction to staff. Page 89 of 174 Item 9.e. City Council Authorize the Village Holiday Parade and Jingle Bell Dash on December 1, 2024 (TUP 24-008) and Find the Action Categorically Exempt from CEQA November 12, 2024 Page 3 ADVANTAGES: The Holiday Parade and Jingle Bell Dash provide a traditional and cherished community event, offering residents and visitors opportunities to celebrate and experience the holiday season in the Village. DISADVANTAGES: “No Parking” restrictions and the closure of sections of Branch Street, Olohan Alley and portions of Wesley Street will have an impact on traffic congestion and parking. Motorists driving in the area surrounding the parade route will have to use detours to get to their destinations, which may increase travel time. ENVIRONMENTAL REVIEW: The authorization of the Holiday Parade and Jingle Bell Dash and closure of City streets is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 4 exemption, which applies to minor public or private alterations in the condition of land, water, and/or vegetation where the project does not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes. (State CEQA Guidelines, § 15304.) The Class 4 exemption applies to this project because it involves a minor temporary use of land having negligible or no permanent effects on the environment. Specifically, the project involves an eight-hour closure of certain streets and parade involving negligible to no permanent effects on the environment. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING TEMPORARY USE PERMIT NO. 24-008 AUTHORIZING THE CLOSURE OF STREETS AND THE ARROYO GRANDE VILLAGE HOLIDAY PARADE AND JINGLE BELL DASH TO TAKE PLACE IN THE VILLAGE AND FIND THE ACTION EXEMPT FROM CEQA PURSUANT TO SECTION 15304 OF THE CEQA GUIDELINES WHEREAS, the City has applied for a Temporary Use Permit for the Holiday Parade and Jingle Dash event which, amongst other things, helped establish conditions to ensure the safety of the event; and WHEREAS, the implementation of safety measures including no parking zones and street closures will help to facilitate a safety for all individuals participating in the event and traveling through the Village area; and WHEREAS, the Arroyo Grande Municipal Code (AGMC) provides for the issuance of Temporary Use Permits for events, AGMC Section 10.16.050 authorizes the City Council to restrict parking on any street, and California Vehicle Code Section 21101(e) authorizes the closure of streets for parades and local special events. The purpose of this Resolution and the below findings is memorialize the opinion of the City that closure of the streets is necessary for the safety and protection of persons who are to use those portions of the street during the event; and WHEREAS, the City Council finds, after due study, the following circumstances exist: NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande finds, determines, resolves, and recommends: 1. Recitals. All recitals above are true and correct and hereby incorporated by reference. 2. CEQA. The authorization of the Holiday Parade and Jingle Dash and closure of City streets is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 4 exemption, which applies to minor public or private alterations in the condition of land, water, and/or vegetation where the project does not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes. (State CEQA Guidelines, § 15304(e).) The class 4 exemption applies to this project because it involves a minor temporary use of land having negligible or no permanent effects on the environment. Specifically, the project involves an eight hour parade and closure of certain streets involving negligible to no permanent effects on the environment. 3. Findings. The City Councils makes, after due study and deliberation, the following Temporary Use Permit findings: a. The operation of the requested use at the location proposed and within the time period Page 91 of 174 RESOLUTION NO. PAGE 2 specified will not jeopardize, endanger, or otherwise constitute a menace to the public health, safety or general welfare. The streets will be closed to ensure easy pedestrian access on the streets and reroute traffic to avoid hazards from vehicles at the parade. The parade is limited to the hours of 12:00 pm to 8:00 pm such that the parade activities will not be disruptive to residential uses. Public Works staff will provide clean-up of all materials associated with the parade at the conclusion of the event. b. The proposed site is adequate in size and shape to accommodate the temporary use without material detriment to the use and enjoyment of other properties located adjacent to and in the vicinity of the site. The streets are sufficiently large for the parade event, and the event has operated without material detriment to the use and enjoyment of other properties since 2003. The event is held on Sunday to prevent the parade from interfering with ordinary business of other properties in the City. 48 hours prior to the event, adjacent business owners will also be notified about the event. c. The proposed site is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic that the temporary use will or could reasonably be expected to generate. “No Parking” restrictions will be implemented, and various streets will be closed to facilitate the operation of the parade. With the road closures, detour routes, and staged event areas, the streets will be sufficient to allow the temporary use. Such road closures and parking restrictions have historically allowed for sufficient space to accommodate the parade traffic. d. Adequate temporary parking to accommodate vehicular traffic to be generated by the use will be available either on-site or at alternate locations acceptable to the City Council. Existing parking lots north of the Village off Le Point Street as well as on-street parking throughout the surrounding Village area will provide adequate temporary parking during the event. 4. Approval. The City Council hereby approves Temporary Use Permit 24-008, authorizing the use of City property as presented to the City Council on November 12, 2024, with the above findings and subject to the conditions as set forth in Exhibit “A,” attached hereto and incorporated herein by this reference. This Temporary Use Permit authorizes the Holiday Parade and Jingle Dash and directs staff to implement related safety measures including no parking zones and street closures on Sunday, December 1, 2024. 2. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 3. The event shall occur in substantial conformance with the application and plans on file in the Community Development Department. 4. The applicant shall comply with all of the Conditions of Approval for Temporary Use Permit 24-008. 5. The applicant shall agree to indemnify and defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney’s fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 6. The Director of Recreation Services shall notify all affected businesses and residents of street closures and parking restrictions at least 48 hours prior to the event. 7. The applicant shall clean up all debris associated with the event to the satisfaction of the Director of Public Works. 8. Traffic detouring and road closures shall be coordinated by the Police Department. 9. The Public Works Department shall be responsible for ordering and directing the setup of all traffic control equipment through a private purveyor.
