MEMORANDUM TO: City Council FROM: Jessica Matson, Director of Legislative & Information Services/ City Clerk SUBJECT: Declaration of Results of the November 5, 2024 Consolidated General Municipal Election DATE: December 10, 2024 RECOMMENDATION: Adopt a Resolution declaring the official results of the General Municipal Election held on November 5, 2024, and the final Certificates of the Canvass. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There is no fiscal impact associated with the recommended action. An invoice for the costs to conduct the election has not yet been received from the County of San Luis Obispo; however, anticipated expenses estimated at $55,000 have been included in the FY 2024-25 Legislative and Information Services Department Budget. BACKGROUND: On November 5, 2024, a General Municipal Election was held in the City for the purpose of electing a Mayor; one (1) District 2 City Council member; one (1) District 3 City Council member, and, voting on one (1) ballot measure ("Measure E-24") asking voters if the City shall be authorized to increase the Transactions and Use (“Sales Tax”) by 1% to fund city services, such as: fixing potholes, maintaining city streets, sidewalks, parks, aging infrastructure, and community facilities; providing local fire protection, police, and 9 -1-1 emergency services; cleaning up litter/graffiti, and addressing homelessness. This was the City’s second by-district election. In accordance with City Council Resolutions Nos. 5359 and 5360, the City’s election was consolidated with the Statewide General Election that was conducted on the same day by the County of San Luis Obispo. The County Clerk-Recorder was responsible for canvassing all votes cast and certifying the election results. ANALYSIS OF ISSUES: Total voter registration for the City of Arroyo Grande was 13,223. The number of total ballots cast was 11,177 resulting in a 84.53% voter turnout. Results of the election are as follows: Page 7 of 215 Item 6.c. City Council Declaration of Results of the November 5, 2024 Consolidated General Municipal Election December 10, 2024 Page 2  Mayor (Vote for 1): Caren Ray Russom and Gaea Powell. o Caren Ray Russom received 6,564 votes (64.32%). Based on these results, Caren Ray Russom received the highest number of votes and is the candidate elected to the office of Mayor.  City Council District 2 (Vote for 1): Aileen Loe o Aileen Loe received 1,796 votes (100%). Aileen Loe ran unopposed and is the candidate elected as District 2 Member of the City Council.  City Council District 3 (Vote for 1): Jamie Maraviglia and Marlea Harmon. o Jamie Maraviglia received 1,120 votes (56.25%). Jamie Maraviglia received the highest number of votes from voters in District 3 and is the candidate elected as District 3 Member of the City Council.  Measure: Measure E-24 passed voter approval. 64.95% of the votes were a “Yes” vote, meeting the majority voter approval required to authorize the City to increase the Transaction and Use Tax (“Sales Tax”) by 1% to fund city services, such as: fixing potholes, maintaining city streets, sidewalks, parks, aging infrastructure, and community facilities; providing local fire protection, police, and 9 -1-1 emergency services; cleaning up litter/graffiti, and addressing homelessness. The County Clerk-Recorder has conducted the official canvass of the returns of the votes cast in the election and has certified the results to the City Council in accordance with California Elections Code Section 10262. In accordance with California Elections Code Sections 10262 and 10263, the City Council is to adopt a Resolution declaring the results of the General Municipal Election and the final Certificates of the Canvass, as shown in Exhibit A of Attachment 1. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Adopt the Resolution; or 2. Provide other direction to staff. ADVANTAGES: Adoption of the Resolution will ensure the City complies with State law as it relates to the declaration and acceptance of the election results. DISADVANTAGES: No disadvantages have been identified at this time. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Page 8 of 215 Item 6.c. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2024, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held in the City of Arroyo Grande, California, on Tuesday, November 5, 2024, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution Nos. 5359 and 5360, the San Luis Obispo County Clerk-Recorder canvassed the returns of the election and has certified the results to the City Council, which are attached hereto and made a part herein as “Exhibit A”. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande, California, that: 1. All of the above recitals are true and correct and incorporated herein by reference. 2. The whole number of ballots cast in the city was 11,177. 3. The names of the persons voted for at the election for Mayor are as follows: Caren Ray Russom, and Gaea Powell. 4. The names of the persons voted for at the election for District 2 Member of the City Council are as follows: Aileen Loe. 5. The names of the persons voted for at the election for District 3 Member of the City Council are as follows: Marlea Harmon, and Jamie Maraviglia. 6. The Measure voted upon at the election is as follows: Measure E-24: To provide funding for Arroyo Grande city services, such as: fixing potholes, maintaining city streets, sidewalks, parks, aging infrastructure, and community facilities; providing local fire protection, police, and 9-1-1 emergency services; cleaning up litter/graffiti, and addressing homelessness; shall City of Arroyo Grande’s ordinance establishing a one-cent sales tax for 10 years be adopted, providing $6,000,000 annually for general government use that can’t be taken by the State, with citizen oversight, independent audits, and all money locally controlled? 7. The whole number of ballots cast and the number of ballots cast for the abovenamed offices are listed in “Exhibit A”, attached hereto and made a part hereof. Page 10 of 215 RESOLUTION NO. PAGE 2 8. The City Council does declare and determine that as a result of the election:  Caren Ray Russom was elected as Mayor for a full term of two (2) years;  Aileen Loe was elected as District 2 Member of the Council Member for a full term of four (4) years;  Jamie Maraviglia was elected as District 3 Member of the City Council for a full term of four (4) years.  A majority of the voters voting on Measure E-24 relating to the City’s authority to increase the Transaction and Use Tax (“Sales Tax”) to fund city services, such as: fixing potholes, maintaining city streets, sidewalks, parks, aging infrastructure, and community facilities; providing local fire protection, police, and 9-1-1 emergency services; cleaning up litter/graffiti, and addressing homelessness voted in favor of it, and that the measure was carried, and shall be deemed adopted or ratified. 9. The City Clerk shall enter into the records of the City of Arroyo Grande a statement of the results of the election, showing: (1) The total number of ballots cast in the City; (2) the names of the persons voted for; (3) the measures voted upon; (4) for what office each person was voted for; (5) the total number of votes given at each precinct to each person and for and against each measure; and (6) the total number of votes given in the city to each person, and for and against any measure. 10. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. 11. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
