RESOLUTION NO. 803
RESOLUTION CALLING A SPECIAL MUNICIPAL ELECTION TO
CONSIDER AMENDING THE ARROYO GRANDE MUNICIPAL CODE
CONCERNING G('RBAGE AND REFUSE TO PROVIDE FOR A
MANDATORY GARBAGE SERVICE, THE GRANTING OF A GARBAGE
SERVICE FRANCHISE AND COLLECTION OF SERVICE CHARGES
BY THE CITY AND ORDERING THE CONSOLIDATION OF SAID
ELECTION WITH THE STATEWIDE GENERAL ELECTION IN NOVEMBER
BE IT RESOLVED by the Council of the City of Arroyo Grande
as follows:
l. A special municipal election to consider adopting an
ordinance amending the Arroyo Grande Municipal Code to provide
for the issuance of a garbage collection franchise by the Arroyo
Grande City Council, to provide for compulsory garbage service
within the City of Arroyo Grande and to provide for billing and
co!lection services to be performed by the City, shall be held
in the City of Arroyo Grande, a Municipal Corporation, located
in the County of San Luis Obispo, State of CalifQrnia, on
November 5, 1968.
2. That at said election to be held on November 5, 1968,
there shall be submitted to the electors of the City of Arroyo
Grande the following question, to wit:
Shall Chapter 4 of Title 6 of the Arroyo Grande Municipal
Code entitled "Garbage and Refuse" be amended to provide for the
c.
issuance of a garbage collection franchise and to make garbage
service mandatory on the owner and/or occupant within the City of
Arroyo Grande, with billing and collection of the service charges
to be performed by the City?
3. Opposite the foregoing statement of the issue to be
voted on, and to its right on the ballot, the words "YES" and "NO"
shall be printed on separate lines, with voting squares. If a
voter stamps a cross (+) in the voting square after the printed
word "YES 11, his vote shall be counted in favor of the adoption of
the ordinance. If he stamps a cross (+) in the voting square after
the printed word "NO", his vote shall be counted against its adoption.
4. If a majority of the voters voting on the proposed ordin-
ance vote in its favor, the ordinance shall be considered adopted.

5. That said special election hereby called to be held in I
the city of Arroyo Grande on the 5th day of November, 1968, shall
be and is hereby ordered consolidated with the statewide general
election to be held on said date, and within the City of Arroyo I
Grande and precinct~, polling places and officers of election for I

the special electiop hereby called shall be the same as those pro- !

vided for said general election. i

The Board of Supervisors of the county of San Luis Obispo
is hereby requested to order the consolidation of the special
election hereby called with said statewide general election and
said Board of Supervisors is authorized hereby to canvas the
returns of the special election hereby called, and the elections
shall be held in all respects as if there were only one election,
and only one form of ballot, namely the ballots used at such general
election, shall be used. Said Board of Supervisors shall certify
the result of the canvas of the returns of such special election
to the Council of the city of Arroyo Grande who shall thereupon
declare the result thereof.
6. That only qualified voters of the City of Arroyo
Grande shall be permitted to vote at the election hereby called.
7. Copies of the proposed ordinance shall be printed and
a copy enclosed in the envelope with the sample ballot mailed to
each voter at least 10 days prior to the election.
8. The City Clerk of the City of Arroyo Grande is hereby
directed, upon the passage and adoption of this resolution to
publish the same twice, and the first publication shall not be
earlier than seventy-five (75) days, nor later than fifty-four
(54) days prior to the election, in the Herald Recorder, a news-
paper of general circulation in the City of Arroyo Grande. Such
publication shall constitute notice of said election, notice of
measure to be voted on, and notice of request for consolidation
of said election with the county election to be held on the same
date.

9. This resolution shall take effect upon its adoption.
On motion of Councilman Levine, and seconded by Councilman
Schlegel, and on the following roll call vote, to wit:
AYES: Councilwoman Thompson, Councilmen Levine,
Schlegel, Smith, and Mayor Wood.
NOES: None.
ABSENT: None.
The foregoing Resolution is passed and adopted this
27th day of August, 1968.
