ORDINANCE NO. 223 c.s.
ORDINANCE OF THE CITY OF ARROYO GRANDE TO AMEND CHAPTER 5
OF TITLE 8 OF THE ARROYO GRANDE MUNICIPAL CODE TO ADOPT BY
REFERENCE THE 19~UNIFORM PLUMBING CODE INCLUDING AMEND-
MENTS THERETO CO D RNING STOP ORDERS, FEES, AND WATER
HEATERS, REPEAL ALL CONFLICTING ORDINANCES.
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS:
Section 1: Chapter five of Title 8 of the Arroyo Grande Municipal Code is
amended to read as follows:
Section 8-5.01 ADOPTION OF UNIFORM PLUMBING CODE I
There is adopted for the purpose of providing minimum requirements and stand-
ards for the protection of the public health, safety and welfare, that certain code
known as the Uniform Plumbing Code, 1979 Edition, inclusive of appendises and
installation standards, published by the International Association of Plumbing and
Mechanical Officials three (3) copies of which have be~n filed for use and ex-
amination by the public in the office of the City Clerk is hereby adopted by
reference and made a part of this chapter as though set forth in this chapter in
full, subject, however, to the amendments, additions and deletions set forth in
this chapter, and said code shall be known as the Plumbing Code for the City of
Arroyo Grande.
Section 8-5.02 ADMINISTRATION
A new section entitled "Administration" is hereby adopted to read as follows:
In order for the orderly enforcement of the Uniform Plumbing Code, 1970
Edition, as adopted by Section 8-5.01 there is hereby adopted the Uniform Adminis-
trative Code, Chapters 1, 2, 3, and Table No. 3-D-Plumbing Permit Fees, as published
by the International Conference of Building Officials, save and except such portions I
as are hereinafter deleted, added thereto, changed or amended, not less than three (3)
, copies of said Uniform Administrative Code are now on file in the office of the City
Clerk and said Administrative Code is hereby adopted and incorporated herein by
reference as though herein set forth in full.
Section 8-5.03 ADMINISTRATIVE AUTHORITY I
Whenever the term "Administrative Authority" is used in this code, it shall I I

be construed to 'mean the Building Official or his Authorized Representative. , I
Section 8-5.04 AMENDMENT TO SECTION 202 (d) UNIFORM ADMINISTRATIVE CODE
Section 202 (d), Stop Orders of said Uniform Administrative Cod~ is amended I
to read as follows:

(d) Stop Orders. Whenever any work is being done contrary to the provisions
of this Code and the Technical Codes, or in violation of any other Code or City ,

Ordinance the Building Official may order the work stopped by notice in writing ,

served on any persons engaged in the doing or causing such work to be done, and
any such person shall forthwith stop such work until authorized by the Building
Official to proceed with the work. If unable to serve such persons with a notice,
the Building Official shall post the stop order in a prominent place on the site.
Such posted notice shall only be removed by the Building Official. Any person
proceeding with unauthorized work after being served or having a notice posted
on his or her job site, shall be deemed guilty of a separate offense for each
and every day or portion thereof during which such work is being performed.
Section 8-5.05 PART 1-20.7 - SCHEDULE OF FEES OF SAID UNIFORM PLUMBING CODE

Section 1310 (a) OF SAID UNIFORM PLUMBING CODE IS HEREBY AMENDED TO
READ AS FOLLOWS:
(a) Water heaters generating a glow, spark or flame capable of igniting
flammable vapors shall not be installed in any group M occupancy (garage) unless
such water heater is installed in an approved one hour fire resistive compartment
having access only from outside of the garage. Required combustion air must also
be obtained from a source other than the garage.
Section 2. That Ordinance No. 17 C.S. of the City of Arroyo Grande
entitled an Ordinance of the City of Arroyo Grande amending Chapter 5, of Title 8,
of the Arroyo Grande Municipal Code to provide for adoption of the 1976 Edition of
the Uniform Plumbing Code and all other Ordinances or parts of Ordinances in conflict
[ herewith are repealed.
Section 3. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this Ordinance. The Council hereby
declares that it would have adopted the Ordinance and each section, subsection;
clause or phrase thereof, irrespective of the fact that anyone or more sections,
subsections, sentence, clause or phrases be declared invalid.
Section 4. This Ordinance shall be in full force and effect thirty
days (30) after its passage, it shall be published once, together with the names
of the Council persons voting thereon, in the Five Cities Times-Press Recorder.
On motion of Council Member Smith, seconded by Council Member Vandeveer,
and on the following roll call vote, to wit:
AYES: Council Members Smith, Hogan, Millis, Vandeveer, and Mayor Pope
NOES: None
ABSENT: None
the foregoing ordinance was passed and August, 1980.
