ORD I NANCE NO. 130 C.S,
AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING
CHAPTER 4 OF TITLE 9 OF THE ARROYO GRANDE MUNICIPAL
CODE BY ADDING ARTICLE 18A THERETO TO PROVIDE FOR
AN AGRICULTURAL PRESERVE OR "_P" DISTRICT WITHIN THE
CITY OF ARROYO GRANDE.
THE CITY COUNCil OF THE CITY OF ARROYO GRANDE DOES HEREBY ORDAIN AS
FOllOWS:
SECTION I: Chapter 4 of Title 9 of the Arroyo Grande Municipal Code is
amended by adding Article 18A thereto, to read as follows:
Article 18A. Combining Agricultural Preserve or
"_P" Di strict.
Section 9-4.18A-OI. Scope and Purpose ("_p").
It is the intention of this Combining District to encourage and
promote the implementation of the State of California land Conservation Act of
1965 (Chapter 7 of Part I, Division I, Title 5, of the Government Code of
California) . The regulations of this Combining District are designed to be
used In conjunction with the Agricultural District for the purpose of negotiating
land conservation agreements as provided for by the Code.
Section 9-4.18A-02. Standards ("_p").
The Agricultural Preserve District shall be combined only with
a basic Agricultural District or "A" District, as set out in Article 4 of this
Chapter, and the following conditions must exist to qualify for Agricultural
Preserve Contract:
(a) land use must comply with the land Use Element of the
General Plan.
(b) Existing uses must comply with the Agricultural Zoned
District.
(c) Property must have been under agricultural production
for a period of five (5) years prior to application
of contract.
(d) Property must consist of not less than ten (10) acres
under single ownership or Joint ownership, and minimum
contract shall be ten (10) years.
Section g-4.18A-03. Bas I c Requl rements and Fees ("_ptI),
The Open Space Implementation Program and rules of procedure
setting forth basic requirements, fees, and other pertinent requirements. shall
be set forth by resolution in a policy statement adopted by both the -Commission
and the Council,
Section g-4.18A-04. Procedures ("_ptl),
Bonafied requests from property owners for establishment of an
Agricultural Preserve under the terms of the land Conservation Act of 1965 may
be considered at the same time as the petition for rezoning to an Agricultural
District,
Contract requests and all necessary required Information must be
filed simultaneously.

SECTION 2: This Ordinance shall be In full force and effect thirty (30)
. days ..fter I ts passage, and wi thi n fi fteen (15) days after its passage It sha 11
be published once, together with the names of the Councilmen voting thereon, In
the Five Cities Tlmes-Press-Recorder.
On motion of Councilman Millis, seconded by Councilman de Leon and on the
following roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley

ABSENT: None
