SPECIAL MEETING OF THE CITY COUNCIL
THURSDAY, JULY 16, 1992

The city Council of the City of Arroyo Grande met at 7:00 P.M.
for the continuation of a Public Hearing on an amendment to the
Mobile Home Rent Stabilization Ordinance, with Mayor Mark M. Millis
presiding.
1. FLAG SALUTE
Mayor Millis led the Pledge of Allegiance to our Flag.
2. ROLL CALL
Present were Mayor Millis and Council Members M. P. "Pete"
Gallagher, Gene Moots and B' Ann smith. Council Member A. K. "Pete"
Dougall arrived at the meeting at 7:15 P.M. Staff members present
were city Manager Chris Christiansen, city Attorney Judy Skousen ,~
and City Clerk Nancy Davis.
3. ORAL COMMUNICATIONS
HOLLIS MC NEELEY of 293 Sunrise Drive urged the Council to
make a, final decision on vacancy control at this meeting.
4. CONTINUATION OF PUBLIC HEARING - PROPOSED ORDINANCE AMENDING THE
MOBILE HOME RENT STABILIZATION ORDINANCE. TITLE 5. CHAPTER 16. OF
THE ARROYO GRANDE MUNICIPAL CODE. TO INCLUDE VACANCY CONTROL AND TO
ESTABLISH A MOBILE HOME RENT REVIEW BOARD
City Attorney Skousen said the revised proposed ordinance is
an attempt to make it more equitable and fair to those who
purchased their mobile homes after October, 1989, when the Council
adopted an interpretation of the Rent Control Ordinance allowing
decontrol on the rent of any mobile home sold after October, 1989.
She said the new proposal is to put vacancy control into the
ordinance to prohibit increasing the rent upon sale. She said the
latest revision of the proposed ordinance contains vacancy control "
and freezes rent on those spaces which had a change in occupancy
and a substantial change in rent after October, 1989. She said
those mobile home owners would not be subject to annual rent
increases until more than 50 percent of similarly situated spaces
in the same park had reached 8 percent of the same amount.
After being assured that the Public Hearing had been duly
published and all legal requirements met, Mayor Millis declared the
hearing open and said all persons would be heard regarding the
matter. When no one carne forward to speak, the Mayor closed the
hearing to the floor.

Among issues discussed by the speakers were:
1. Roll back of high and illegally raised rents.
2. A common annual date for rent increases.
3. Raising of below-the-market rents at the time of the resale of
the mobile home.
4. Returning of high rents to a lower rent rate at the time of the

resale of the mobile home.
5. Disagreement with the latest revised proposed ordinance gradual
decrease of high rents, which would take 17 years to become
equitable.
6. The poor quality of park maintenance at Sunrise Terrace.
7. The moral duty of the Council to observe "natural justice" in
its treatment of mobile home tenants.
Also discussed by the speakers was the statement that the
owners of Sunrise Terrace had illegally raised rents on those homes
purchased between the dates of August, 1988, and March, 1989. The
City Attorney said the City's records indicate that the city had
'- brought that park into compliance by directing the park owners to
roll back the rent increases for said tenants. Park residents at
the meeting said those rents were not rolled back by the owners.
,. Mr. Christiansen said he would investigate the matter. Ms. Skousen
said the "statute of limitations" may make it impossible for the
city of assist those tenants.
There was considerable discussion by the Council of the
October, 1989, date listed in the latest revised proposed ordinance
as the date after which high rent raises would be frozen.
Council Members decided to change that date to the date the Mobile
Home Rent Stabilization Ordinance went into effect, June 13, 1986.
When no one further came forward to speak, Mayor Millis closed
the hearing to the floor.
council Members discussed the various issues brought, up by the
park tenants, and finally expressed their agreement with the latest
revised proposed ordinance.
Mr. Christiansen read the title of the ordinance Amending the
Mobile Home Rent Stabilization ordinance, Title 5, Chapter 16 of
the Municipal Code to Include Vacancy Control and to Establish a
Mobile Home Rent Review Board. It was moved by Smith/Gallagher,
and the motion passed unanimously, to dispense with further reading
of the ordinance. Mayor Millis said that constituted the first
reading of the ordinance, and the second reading would take place
at the regular meeting of the City Council on July 28, 1992.
