Minutes 1990-11-27 -- --- --_.~-._---~~----~._...~--~_. ~--'--- 330 - MINUTES REGULAR MEETING OF THE CITY COUNCIL TUESDAY, NOVEMBER 27, 1990 CITY COUNCIL CHAMBERS, 215 EAST BRANCH STREET ARROYO GRANDE, CALIFORNIA The city Council of the City of Arroyo Grande met at 7: 30 P.M., with Mayor Pro Tem B'Ann Smith presiding. 1. AND 2. FLAG SALUTE AND INVOCATION Mayor Pro Tem smith led the Pledge of Allegiance to our Flag, and Council Member Pete Dougall delivered the invocation. 3. ROLL CALL " Present were Mayor Pro Tem Smith and Council Members Dougall, Moots and Olsen. Mayor Mark M. Millis was absent. staff Members present were Mr. Christiansen, city Attorney Judy Skousen, City Clerk Nancy Davis, Public Works Director Paul Karp, Parks and Recreation Director John Keisler and Tree coordinator Carolyn Leach. 4. PRESENTATION OF PLAOUE OF APPRECIATION TO FORMER SENIOR ADVISORY COMMISSIONER ROBERT GRUBER Mr. Gruber was unable to attend the meeting, and city Manager Chris Christiansen was directed to deliver the plaque to him. CONSENT AGENDA It was moved by Dougall/Olsen, and the motion passed, to approve Consent Agenda Items 6.A. through 6.F., with the recommended courses of action. 6.A. proclamation, "EOC - Silver Anniversary Month," December, 1990. Proclamation accepted by Biz Steinberg, Economic Opportunity commission director. 6.B. Proclamation, "Project Red Ribbon," November 20, 1990 - January 1, 1991. Proclamation accepted by Roger Freberg, Mothers Against Drunk Driving Legal Issues Chairman for the State of California. 6.C. Appointment of Alternate to SCAT. Approved. 6.D. Authorization to Request Bids for Rehabilitation of Building "C" at the corporate Yard. Approved. 6.E. Acceptance of Rights of Way for Grand Central Station: Grand Avenue at Barnett Street. Accepted. 6.F. Coordinated Agriculture Support Program Update. Information. ~ 7.C. REGISTER OF CHECKS It was moved by Dougall/Olsen, and the motion passed, to approve the cash disbursements in the amount of $222,638.S9, as contained in the November 20, 1990 Staff Report of Finance Director David Bacon. 8.A. HOOK RAMPS AT CAMINO MERCADO No Report. S.B. INTERSECTION IMPROVEMENTS AT WEST BRANCH STREET/GRAND AVENUE/TRAFFIC WAY AND WESLEY STREET No Report. S.C. UPDATE ON COUNTY PROJECTS AFFECTING THE CITY City Attorney Skousen said the County Board of Supervisors had denied the Mesa Drive project on the fringe of the city. She said 1 I I - 331 CITY COUNCIL MINUTES NOVEMBER 27, 1990 the developers would have to return to the board with an Environmental Impact Report and an alternate access route for the I proj~t. , S.D. WATER UPDATE - HYDRANTS Council Member Olsen reported that by the end of 1991, the City would have to stop using Lopez Lake as a drinking water source i if there is no wet season. She said the neighboring cities have I said they will not honor the "gentlemen' agreement" with regard to underground water. She discussed a possible cloud seeding program which may be undertaken by San Luis Obispo, Arroyo Grande, Grover ,- city and pismo Beach. Mr. Christiansen said if Arroyo Grande participated in the cloud seeding program the City's cost would be $25,000 through Zone 3. Council Member Olsen said there would be a joint meeting at 1:30 P.M. December 5, 1990 of the Water Resources Advisory Commi ttee and the South County Water Association at the City/County , Library, 995 Palm street, San Luis Obispo. Mr. Christiansen said that all construction water meters have been removed from hydrants in the City, as per Council direction. He said that contractors have called him to request permission to draw water from the hydrants for compaction of dirt at construction sites. Mayor Pro Tem Smith explained that the Council had directed that all meters be removed from water hydrants because there had been told of some abuse of the system, and that water was being sold outside the City. Requesting that they be allowed to use the water from hydrants to finish the projects on which they are currently working were BILL PAPPICH of 606 Prince Road and ROGER ORMONDE of Grover city, grading contractors: ARTHUR BIELECKI, owner of property under I construction, and SID WHITE, whose son-in-law has a house under I construction. I There was extensive council discussion about the matter, with Council Members Moots and Olsen expressing concerns about the city's short supply of water, and setting a precedent for other projects currently under construction. Council Members Smith and Dougall said the City should let the contractors finish their present projects because the city requires the contractors to use water for compaction and erosion control. . with the assistance in the wording by the city Attorney, it was moved by Dougall/Smith that those contractors who on or before November 27, 1990 at 5:00 P.M. had already pulled city grading r- permits for grading projects within the City of Arroyo Grande may : buy City water from metered fire hydrants only to complete that ! grading project. The motion passed with smith, Dougall and Moots I voting aye, Olsen voting no, and Millis absent. The Council discussed the proposed cloud seeding project. It was moved by Moots/Dougall, and the motion passed, to pay Arroyo Grande's Zone 3 share (up to $25,000) for the cost of Cloud Seeding before April 1, 1991, with the provision that the Cities of pismo Beach, Grover city and San Luis Obispo participate in the project. "ROYAL OAKS ESTATES." BY ALLOWING A CHURCH ON LOT B. AND APPROVING AND ADOPTING SPECIFIC DEVELOPMENT PLAN NO. 90-03: GRACE BIBLE CHURCH Council Member Dougall and Mr. Christiansen left the room because of possible conflicts of interests. It was moved by Moots/Olsen (4-0-1, Moots, Olsen, smith voting aye and Dougall and Millis absent) to adopt Ordinance No. 430 C.S. Amending ordinance No. 355 C.S. "Royal Oaks Estates" by Allowing a Church on Lot B, and Approving and Adopting Specific Development Plan No. 90-03. ~ Council Member Dougall and Mr. Christiansen returned to the room. 9.B. SECOND READING OF ORDINANCE ADOPTING A NEGATIVE DECLARATION AND AMENDING ORDINANCE NO. 333 C.S.. WHICH ESTABLISHED A COMPREHENSIVE COMMUNITY TREE PROGRAM: CITYWIDE: CITY OF ARROYO GRANDE PARKS AND RECREATION DEPARTMENT Objecting to the ordinance was MARIE CATTOIR of 195 Orchid Lane, who said it takes away the individual citizen's freedom of choice and will not save the trees in large scale developments. She said the new ordinance would not prevent the future widening of Trinity Way and the loss of oak trees and rocks there. CLARK MOORE of 1180 Ash Street said the new ordinance is too complicated and will be hard to enforce. DAVE REAGAN of 625 Jamison Court, a registered arborist, spoke in favor of the new ordinance. It was moved by DougalljMoots (4-0-1, Dougall, Moots, Olsen and Smith voting aye, Millis absent) to approve Ordinance No. 431 C.S. Adopting a Negative Declaration and Amending Ordinance No. 333 C.S., Which Established a Comprehensive Community Tree program. 10.A. DECLARATION OF SURPLUS EOUIPMENT It was moved by Dougall/Moots (4-0-1, Dougall, Moots, Olsen and Smith voting aye, Millis absent) to approve Resolution No. 2431 Declaring Items to be Placed on a Surplus List, Requesting Authorization for Sale at Public Auction and Donating Bicycles for Rehabilitation for Needy Children. 11. WRITTEN COMMUNICATIONS None. 12. ORAL COMMUNICATIONS Mayor Pro Tern smith said Mayor Millis intends to nominate Nancy Maynard of 833 Mesa Drive to the Senior Advisory Commission ~ on December 11, 1990. 13. CLOSED SESSION On motion of Moots/Dougall, the Council adjourned at 9:08 P.M. to a Closed Session on Coker Ellsworth & Vic Pace Construction Co., Inc. vs. the city of Arroyo Grande and vic Pace Construction Co., Inc. vs. the City of Arroyo Grande, Potential Litigation (Government Code Section S4956.9(b)(1).
