ORDINANCE NO. 218 i

AN ORDINANCE OF THE CITY OF ARROYO GRANDE ESTABLISHING
A FIRE DEPARTMENT AND DEFINING THE ORGANIZATION, POWERS
AND DUTIES THEREOF.
The City Council of the City of Arroyo Grande does ordain as follows:
SECTION 1. MEMBERS
The Fire Department shall consist of a Fire Chief and Assistant Chief,
and as many other officers and firemen as may be deemed necessary for the
effective operation of the Department.
SECTION 2. APPOiNTMENT OF CHIEF
The Fire Chief shall be the chief executive officer of the Fire Depart-
ment and shall be appointed by the City Council, upon recommendation of the
City Administrator, for an indefinite period of time and with tenure of office
depending upon his good conduct and efficiency, and he shall not be removed
i.~om office except for cause after a hearing subject to all the rules and reg-
ulations of the personnel ordinance and resolution of the City of Arroyo Grande.
He shall be technically qualified through training and experience and shall
have the ability to command men.
SECTION 3. APPOINTMENT OF OFFICERS
The Fire Chief shall appoint all other officers and firemen with con-
currence of the City Administrator. Such appointments shall be insofar as
possible, following fair and impartial competitive examination. All officers
shall be accountable to the Fire Chief, or his representative.
SECTION 4. RULES AND REGULATIONS
The Fire Chief shall carry out strictly the enforcement of rules and
regulations of the Department as hereinafter referred to and is authorized
to suspend or remove from service any officer or firemen as provided In the
referred to Rules and Regulations. The Fire Chief shall cause to be adopted,
maintained and enforced, an up to date comprehensive set of Rules and Regula-
tions governing the discipline, training and operation of the Fire Department.
Such rules, regulations and any deletions, changes or additions shall be
effective when approved by and filed with the City Administrator. Such rules
and regulations shall not be deemed the exclusive authority or power of the
Fire Chief, but he shall have such further and additional authority reason-
ably necessary and convenient to carry out the purposes and intents of this
Ordinance and to fulfill the duties and requirements of the Fire Department.
SECTION 5. ANNUAL REPORT AND BUDGET AS PRESCRIBED IN THE BUDGET MANUAL OF
THE CITY OF ARROYO GRANDE
The Fire Chief shall be responsible to the City Administrator, and shall
submit to him a tentative budget for his Department, and shall make a complete
annual report and such other reports as may be required concerning the Fire
Department In general, giving suggestions and recommendations for major im-
provements, and I isting other data so as to .maintain a complete 'record of the
activities of the Department.
SECTION 6. PREMISES AFTER FIRE
AI! premises on which fires occur shOll! be Jeft in a condition which wIll
most readily permit reoccupancy, such premises shall also be left in such con-
dition that they will not rekindle or cause further damage to life and property,
SECTION 7. INSPECTION OF BUILDINGS
Inspection of b'Ji ldings shall be as provided by City of Arroyo Grande Ord-
inance No. 205 or such subsequent Ordinance as may hereafter be adopted to re-
gulate Inspection of buildings for fire prevention purposes.

SECTION 8. EQUIPMENT
The Fire Department shall be equipped with such apparatus and other fire
fighting equipment as may be required to maintain its efficiency. Suitable
arrangements and equipment shall be provided for citizens to turn in an alarm
of fire, and for notifying all members of the Department so that they may
promptly respond.
SECTION 9. DRILLS
The Fire Chief shall, at least four (4) times per month, provide for suit-
able drills covering the operation and handling of all equipment essential for
efficient department operation. In addition, he shall provide instruction in
first-aid, water supplies, and other related subjects generally considered
essential to good firemanshlp.
SECTION 10. MUTUAL AID
The City of Arroyo Grande is hereby authorized to enter into agreements
or contracts with nearby incorporated communities or governing bodies of other
organizations to provide the members of such communities or organizations with
fire protection or to establish a mutual aid system.
SECTION 11. EQUIPMENT ASSIGNMENT
No equipment or apparatus shall be hired out or permitted to leave the
City of Arroyo Grande except In response to a call for aid at a fire or emer-
gency in a neighboring community without the consent of the City Administrator,
Chief of the Department or his representative.
The officer in charge of the department shall have power to assign equip-
ment for response to calls for outside aid in accordance with Section 10 and
in other cases only when the absence of such equipment will not jeaprodize
protection in the said City of Arroyo Grande.
SECTION 12. RESPOND TO CALLS
It is hereby made the special duty of the Chief of Police and/or other
Peace Officers who may be on duty and available to respond to all fire alarms
and assist the Fire Department In the protection of life and property, regul-
,_ing traffic, maintaining order and in enforcing all sections of state and
loca I laws applicable.
SECTION 13. SEVERABiLITY
If any provision of this ordinance be held inval id, its I nva lid i ty sha I 1
not affect other provisions which can be given effect without the inval id pro-
visions and to this and the provisions of this ordinance are declared to be
severable.
All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
This ordinance shall take effect thirty (30) days after its adoption and
within fifteen (15) days after its final passage it shall be published once,
together with the names of the Councilmen voting thereon, in the Herald-Recorder
a newspaper published in the City of Arroyo Grande.
On motion by Councilman Burt, seconded by Councilman Levine, and on the
following roll call vote, to-wit:

and Mayor Wood
