ORDINANCE NO. 79
An ordinance to prohibit' dogs and other an1Jnals running at large in
the City of Arroyo Grande and providing for the Poundkeeper and a city
pound and repealing Ordinance No. III of the City of ArTayO Grande and
prescribing penalties.
BE IT ORDAINJID, BY THE COUNCIL OF THE CITY OF ARROYO GRANDE .AS
FOLLOWS,
SEX;TION I. No person owning any dogs or an;y other animals or haT.lng

remain on an;y public street, road, alley, park, square or other public
place, or upon any private property, other than the property of the owner i

owner of such property within the corporate limits of said City of ArTayo I
Grande, and all dogs and other animals shall be deemed running at large
within the meaning of the ordinance unless tied, restained by chain, strap
or cord attached to their collars and actualJ.y held by some person or tied I

or restrained in an automobile or other vehicle, or unless said dogs or
other ani ....Is are staked or fastened for the purpose of grazing. Any dogs
or other ani11Ials found running at large on an;y public street, road, area,
park, square or other public place or upon an;y private property other than
the private property of owner or custodian of such dogs or other an'_'.
without the consent of the owner of such property within the corporate
limits of the City of ArToyo Grande, shall be subject to 8eisure and
1q)ounding in the City pound.
SiX:TION II. The City Council of the City of ArToyo Grande shall
provide a place to be used as a public pound for the impounding of dogs and
other sn'_l. pursuant of the provisiOIl8 of this ordinance. The City
Council ot the City of Arroyo Grande and said Councllshall fix his
ranUllleration. It shall be the duty ot the poundkeeper of the City of Arrayo
Grande to seize and impound in the public pound all dogs or other animals
found runn1ng at large on any public street, road, alley, park, square or
other public place or upon any private property other than the property of

the owner or custodian .of such dogs or other animals without the consant of
the owner of such property within the corporate limite of said city.
SIDTION III. Within twenty four (211) hours atter impounding any dog
or other animals in accordance with the provisioll8 of this ordinance the
poundkeeper shall post notices thereof in front of City Hall and at the
public pound in said CitT. Such notices shall bear the date and hour on
which they are posted and state that it is in the public pound where it can
be redeemed by the owner by pqing the accrued fees as fiXed by the
ordinance and if not so redeemed within three (3) days, it will be sold or
put to death.
SIDTION IV. The poundkeeper shall securely keep all dogs or other
animals so impounded for three (3) days after posting the notices hereby
required, supplying thelll with the necessary food and water, and during such
time the owner of any such dogs or other animals may redeem the same by
paying to the poundkeeper the following fees, to-wit: The sum of One ($1.00)
Dollar plus the S\ll1l of One ($1.00) Dollar for each day or traction thereof'
that such dogs or other animals have been kept in the pound after posting I

the notices as required by section 3 hereof. I

SID TION V. If a~ dogs or other ani.1s impounded under the provisioll8
of this ordinance be not redeemed within the time herein specified the pound-
keeper may sell the same, at public or private sale, to any person, and if
not sold, he shall cause such dogs or other animals to be put to death and
the carcass properly buried.
SIDTION VI. The poundkeeper shall keep a record of all dogs or other
animals impounded under the proVisions ot this ordinance and the d1spCl8ition
made thereof, and he shall, on the first clay ot each IIIOnth, tile with the
City Clerk an itemized, detailed and verified statement of all fees and
IIIOney received, and aU dogs or other animals ldlled and buried pursuant
to the provisions hereof during the proceding calendar IIIODth.
SIDTION VII. ~ person keeping or herboring a dog or other 8"1-].

SIDTION VIII. Every person who shall Violate any provision of this
ordinance, and every person who shall, in any manner, inter.fere or attempt I
to interefere with the poundkeeper, in the pertormance of any duty imposed
by the provisions hereof, and every person who shall unla~ take or
attempt to take any dog or other animal seized pursuant to the provisions
hereof from the oustod,y of the poundkeeper or any of his deputies, and
every person who shall remove or atempt to remove from the publio pouud
any dog or other animals impounded therein without having first redeemed
the same as herein provided, or obtained the permission of the poundkeeper
to do so, shall be deemed guilty ot a misdemeanor and upon conviction thereof
shall be punished by a fine ot not exceeding One hundred ($100.00) Dollars
or by iDprisonment for not exoeeding ninety (90) days or by both such tine
and imprisonment.
SIDTION IX. Ordinanoe Nwnber 3 of the City of Arroyo Grande and all
ordinances and parts ot ordinanoes in oonfliot herewith are each ot them
is hereby repealed.
SIDTION X. This Ordinance, together with the Ayes and Noes, shall be
published tor 2 publications before its !'1nal passage, in the Arroyo Grande
Herald Reoorder, a weekly newspaper printed and published in the City of
A:rroyo Grande, County ot San Luis Obispo, State ot Call1'ornia.
