R 3214 . . RESOLUTION NO. 3214 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I ARROYO GRANDE REQUESTING AUTHORIZATION TO \ CLOSE CITY STREETS AND USE CITY PROPERTY FOR .-.-. ARROYO VALLEY CAR SHOW ( l WHEREAS, organizers of the Arroyo Valley Car Show have requested closure of Olohan Alley, Bridge Street, portions of Nelson, Short and Mason Streets and use of City property for their annual car show, July 26, 1997; and WHEREAS, members of the. Arroyo Valley Car Club will be responsible for the organization and management of the event, including reimbursement to the City for the costs of City personnel needed for the event, and for cleanup at the event. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE HEREBY RESOLVES AS FOLLOWS: 1. Olohan Alley; Bridge Street; Nelson Street, between Bridge and Mason Streets; Short Street, between East Branch Street and Olohan Alley, and; City Hall parking lot shall be closed from 6:30 a.m. until 4:30 p.m., Saturday July 26, 1997 for the purposes of holdin9 the car show; and 2. Mason Street, between East Branch and Nelson Streets, shan be closed from 6:30 a.m. until 10:30 a.m., Saturday July 26, 1997 for the. purposes of holding the car show registration; and 3. That the Arroyo Valley Car Club will adhere to certain requirements and conditions set forth by the ~ublic Works, Police, and Building and Fire Department regarding security and traffic control and other applicable conditions of a Temporary Use Permit to be issued by the city. Subject: Temporary Use Permit for Car Show, Saturday, July 26, 1997 Dear Mr. Gastiger: On April _, 1997, after making the findings specified in Section 9-03.100 of the Development Code, the Community Development Director approved the above project, subject to the following conditions: 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. The event shall occur in substantial conformance with the application and plans on file in the Community Development Department office. 3. The event organizers shall comply with all conditions of City Council Resolution Number . - 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Parks and Recreation Department Conditions 5. The event organizers shall flag all sprinkler heads on turf and lawn areas to prevent damage. I 6. The event organizers shall coordinate the placement of waste containers by I Friday, July 11, 1997, with the Parks Division and the Director of Parks and Recreation. 7. The event organizers shall supervise all areas and pick up litter, waste, and debris, and shall empty all City waste containers in dumpsters provided by the Car Club. ._--~_._-~---- , Public Works Department Conditions 8. The event organizers shall be responsible for providing, setting up, and removing barricades for closures of City streets, alleys and parking lots and city facilities mentioned in the application. . 9. The event organizers shall coordinate with the Police, Public Works, and Fire Departments in the closures of City Streets, alleys, and parking lots and facilities. I Building and Fire Department Conditions 10. The event organizers must comply with the Fire and Building Department guidelines. 11. Emergency access must be maintained to the satisfaction of the Director of Building and Fire. 12; The use of generators must be reviewed and approved by the Director of Building and Fire. 13. All fire lanes must. be posted and enforced per Police and Fire Department guidelines. . 14. Fire Department food booth guidelines must be followed (reference attached guidelines). Non-compliant booths will not be permitted to operate. 15. The Fire Department must inspect all food booths and the generator, if used, prior to festival opening. 16. Provide one handicapped accessible restroom. Police Department Conditions 17. The event organizers shall pay Police Department coSts for officers assigned to the event. (The estimated cost of two officers working from 6:00 a.m. to 5 :00 p.m., is $985.12) Please note that some of the above conditions must be met prior. to start of the event. Fire and Health Department issues relating to tents and canopies that participate in. cooking and selling of food at special events within the County~ . - DEFINITIONS . Tent: A temporary structure. enclosure. or shelter construded of fabric or pliable material supported in any manner except ~y air or the contents it protects. . Canopy: A temporary structure. enclosure or shelter constructed of fabric or pliable materials supported by any manner. except air or the contents it protects and is .open without sidewalls or drops on 75 percent or more of the perimeter. . Booth: A temporary structure, with the lower portion constructed of wood up to three feet and a solid wood, metal saeen, and when . approved. a plastic tarp roof. The upper portion of the sides and the back may be of fly screening or like material. The portion of the booth adjacent to the cooking area must be of solid wood construction. . Heating: Raising the temperature of a cooked or prepared food, for service to the public. using electrical appliances~ open flame. steaming trays. or sterno. . Cookjng: Preparing food products by assembling tvtIO or more items and applying a heat source. Note: Individual tents and canopies located within tv.enty feet of another individual tent will be consider one structure.' AUTHORITY . Article 32 of the Uniform Fire Code . Division 104, Part 7. Chapter 4 of the Health and Safety Code . Uniform Fire Code Section 1102 COOKING AREA LAYOUT (see attached diagram) . Privately-owned tents used by vendors for cooking and serving shall meet the commercial tent standards set by the California State Fire Marshal, . the sponsoring organization" and the County Health Department . Based on the premise that most vendors use a 10 X 10 tent or canopy: a. A minimum of two-foot wide clear spaCe shall be provided between the cooking space area and the back of the tent as shown in the attached diagram. --.---~._.. - . , b. A minimum of 18-inch wide clear space shall be provided between the cooking space and the side and rear of the cooking area. USE OF (LPG) IN BOOTHS . Vendors may use Liquified Petroleum Gas in wooden booths, (as described above) when the booth is separated from other tents and canopies by at least twenty feet. BARBECUES . Trailer barbecues shall not be located within ten feet of combustible walls or roofs or other combusti~e material. . Charcoal and gas barbecues may be located in the cooking space, but in other use location shall not be located within ten feet of combustible walls, roofs or other combustible material. . Small barbecues and hibachis may be placed on tables in the cooking space adjacent to the tent if a thermal barrier is provided be1YJeen the barbecue and the table. This may be a concrete block underneath the barbecue, as long as the entire area of the. barbecue is provided. with protection underneath. . Warming appliancesJsteaming trays, electric andstemo types, may be located inside the tents. They will be monitored by the event organizers, the County Health . Department, and the local Fire Department . All vendors shall provide event organizers of the type of cooking methods and equipment to be used. . Vendors using LPG. or White Gas in a tent or canopy will not be allowed to participate in the event. Wood booths would be required. FIRE EXTINGUISHERS . AU vendors participating in an event who will be cooking or wanning food shall have a 2A: 1 oae fire extinguisher within their tent or canopy. . . Vendors failing to have an extinguisher will not be allowed to participate in the event LARGE TENT LAYOUT. . Large tents are defined as having more than 400 square feet and may be occupied by more than one vendor. . Cooking must be done twenty feet away fram the tent . Vendors within a large tent, who use warminglheating appliances will each be required to have their awn fire extinguisher. -_._~-'-- . '.
