RESOLUTION NO. 3323
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE
ADOPTING THE BERRY GARDENS SPECIFIC PLAN
(APPLICANT: CHARLES BAKER)
WHEREAS, the City of Arroyo Grande General Plan Map indicates that the area
generally located south of Grand Avenue, north of Ash Street, east of Oak Park Blvd.,
and west of Spruce Street requires adoption of a specific plan prior to development;
. and
WHEREAS, the City of Arroyo Grande General Plan Land Use Element Policies 1.5,
2.1.j. and 2.2.g. indicate that the area generally located south of Grand Avenue, north
of Ash Street, east of Oak Park Blvd., and west of Spruce Street requires adoption of
a specific plan prior to development; and
WHEREAS, the applicant, Charles Baker, has submitted an application to amend the
General Plan and Development Code, and adopt the Berry Gardens Specific Plan for
the area described above; and
WHEREAS, adoption of the Berry Gardens Specific Plan would establish land use,
development and design standards for the above described area; and
WHEREAS, on August 25, 1998 the City Council has certified an Environmental
Impact Report prepared for the Berry Gardens Specific Plan; and
WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the
Berry Gardens Specific Plan at a duly noticed public hearing on August 4, 1998 in
accordance with the Development Code of the City of Arroyo Grande at which time all
interested persons were given the opportunity to be heard; and
WHEREAS, the City Council of the City of Arroyo Grande has reviewed the proposed
Berry Gardens Specific Plan at a duly noticed public hearing on August 25, 1998 in
accordance with the Development Code of the City of Arroyo Grande at which time all
interested persons were given the opportunity to be heard; and
WHEREAS, subsequent to the August 25, 1998 City Council meeting, the
applicant made changes to the proposed project, including increasing the minimum
lot size from 5,700 square feet to 6,000 square feet, increasing the average
minimum lot size from 6,000 square feet to 6,600 square feet, and reducing the
number of units from 191 to 180; and
WHEREAS, the City Council of the City of Arroyo Grande has reviewed the Berry
Gardens Specific Plan at a duly noticed public hearing on September 8, 1998 in
accordance with the Development Code of the City of Arroyo Grande at which time all

interested persons were given the opportunity to be heard; and
WHEREAS, the City Council find that the changes to the proposed project are
minor; and
WHEREAS, the City Council has reviewed and considered the information and public
testimony presented at the public hearings, staff reports, and all other information and
documents that are part of the public record; and .
WHEREAS, the City Council finds, after due study, deliberation and public hearing, the
following circumstances exist:
1 . Based on the information contained in the staff report and accompanying
materials, the proposed Berry Gardens Specific Plan is consistent with the
goals, objectives, policies, and programs of the General Plan and is necessary
and desirable to implement the provisions of the General Plan.
2. The proposed Berry Gardens Specific Plan will not adversely affect the public
health, safety, and welfare or result in an illogical land use pattern. The street
improvements, installation of public utilities, sewage. lift station, and drainage
basin proposed as part of the Specific Plan would mitigate any potential
adverse impacts to the public, health, safety, and welfare. The density of 4.8
dwelling units per gross acre and the land use pattern proposed for the Berry
Gardens Specific Plan are consistent with surrounding residential development.
3. The development standards contained in the Berry Gardens Specific Plan will
result in a superior development to that which would occur using standard
zoning and development regulations, including seven foot wide landscaped
parkways with detached sidewalks, street tree spacing of 30 feet, garage doors
setback a minimum of ten feet behind the front of the house de-emphasizing
the garage, decorative paving on Seabright and the private alley, entrance
identification signs, uniform wall/fence design along Courtland Avenue, and a
centrally located public park. All of these features create a visually enhanced
streetscape, a more pedestrian oriented neighborhood, and sense of
neighborhood by having a cohesive design theme.
NOW, THEREFORE, BE IT RESOLVEO that the City Council of the City of Arroyo
Grande, California hereby adopts the Berry Gardens Specific Plan as set forth in
Attachment A, subject to the conditions of approval set forth in Attachment B both of
which are attached hereto and incorporated herein by this reference.
BE IT FURTHER RESOLVED that any development application within the Berry
Gardens Specific Plan area shall comply with all mitigation measures set forth in the

Berry Gardens Specific Plan Environmental Impact Report certified on August 25,
1998.
BE IT FURTHER RESOLVED that this resolution shall become effective when
Ordinance No. 499 C. S. (Development Code Amendment 97-007) becomes effective.
On motion by Council Member Fuller, seconded by Council. Member Runels, and by
the following roll call vote, to wit:
AYES: Council Member Fuller, Runels, and Mayor Dougall
NOES: Council Member Tolley and Mayor Pro Tern Lady
ABSENT: None

CONDITIONS OF APPROVALS
BERRY GARDENS SPECIFIC PLAN
(APPLICANT: CHARLES BAKER)
1. A reproducible copy and 15 copies of the Final Berry Gardens Specific Plan
shall be submitted 30 days after the first reading of Ordinance No. 499 c.s.
(Development Code Amendment 97-007) subject to the following revisions:
a. The commercial areas of Subarea 3 (Matsumoto) and Subarea 4 (Air-Vol)
shall be responsible for constructing stormwater basins to accommodate
runoff from their respective sites. The basin(s) may be either new
facilities, or an expansion of the existing Poplar basin, subject to City
Approval and the necessary acquisition of easement rights. The sizing of
basin volumes within the specific plan area shall be determined at the
time an application is submitted to the City.
b. Incorporate all conditions of approval as adopted by the City Council.
c. Delete surplus, non-substantive wording as approved by the Community
Development Director.
