RESOLUTION NO. 3213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AUTHORIZING CLOSURE OF A PORTION OF OLOHAN ALLEY AND USE CITY PROPERTY FOR ARROYO GRANDE VALLEY KIWANIS CLUB WESTERN DANCE WHEREAS, organizers of the Arroyo Grande Valley Kiwanis Club have requested closure of a portion of Olohan Alley and use of City property for the Western Dance, June7, 1997; and WHEREAS, members of the Arroyo Grande Valley Kiwanis Club will be responsible for the organization and management of the event, including reimbursement to the City for the costs of City personnel needed for the event, and for cleanup at the event. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE HEREBY RESOLVES AS FOLLOWS: 1. Closure of Olohan Alley, between Mason and Short Streets, and the area behind City Hall shall be closed from 3:00 p.m. to 12:00 p.m., on Saturday, June 7th for the western dance; and 2. That the Arroyo Grande Valley Kiwanis Club will adhere. to certain requirements and conditions set forth by the Public Works, Police, and Building and Fire Department regarding security and traffic control and other applicable conditions of a Temporary Use Permit to be issued by the City. "'~' DRAFT TEMPORARY USE PERMIT April ,1997 James Wray Arroyo Grande Valley Kiwanis Club 550 Karl Court Nipomo, CA 93444 Subject: Temporary Use Permit for a Western Dance, Saturday, June 7, 1997 Dear Mr. Wray: On April ,1997, after making the findings specified in Section 9-03.100 of the Development Code, the Community Development Director approved the above project, subject to the following conditions: 1 . The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. The event shall occur in substantial conformance with the application and plans on file in the Community Development Department office. 3. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees' which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of' his/her obligations Linder this condition. Parks and Recreation Department Conditions 4. The event organizers shall develop a plan that identifies the location of dumpsters and waste containers by May 23, 1997. 5. The event organizers shall develop a fence construction plan which shows the location of stakes/posts and the fence, and how it will be installed. Care must be taken to ensure no damage to the City's irrigation system occurs. 6. All areas shall be left clean and free of debris and litter. Public Works Department Conditions 7. The event organizers shall provide and be responsible for the installation and removal of the fence. .~ 8. The event organizers shall provide a $1,000,000 insurance policy for the event that includes the City as an additional insured. A copy of the insurance policy shall be provided to the City Clerk by May 23, 1996. Building arid Fire Department Conditions 9. The event must comply with Fire and Building Department guidelines. 10. Emergency access must be maintained to the satisfaction of the Director of Building and Fire. 11 . The use of generators and/or generator powered lighting must be reviewed and approved by the Director of Building and Fire. .Police Department Conditions 12. The event organizers shall obtain a Public Safety and Welfare Permit for the event. 13. The event organizers shall pay' the cost. for two officers for security (The estimated cost for two officers working between 6:00 and 10:00 p.m. is $351.201. Please note that some of the above conditions must be met prior to start of the event. Failure to adhere to all the above conditions invalidates the temporary use permit. The Kiwanis Club is making application for a temporary use permit for June 7, 1997 for the purpose of putting on a Western Dance as a fund raiser for the Club. Specifics regarding the event are included below and in Attachment A, the schematic of the events at the Dance: Set-Up: Set-up will be coordinated with John Clark to ensure that there is minimal conflict with the Farmers Market. Event Times: . Dinner begins at 5:00 an will end at 7:30 . The Country/Westem Band will begin playing at 6:00 . Dancing will begin at 6:30 . All activities will end promptly at 10:00 Equipment Removal: Most equipment will be removed by Midnight. Any equipment left overnight will be moved tothe rear of the parking spaces to allow vehicles access. Fencing Removal: The fencing across the driveways to the area will be removed to provide vehicle access by midnight. The balance of the fencing will be removed by 10:00 AM the next moming. ~ Clean-Up: The area will be cleaned of any litter or debris by 10:00 AM the next morning. Primary Event Activities: The Hoe-Down will include a BSa Dinner and dancing to a live Country/Westem band. Possible Event Activities: . Local FFA and 4-H groups will be invited to participate with events such as a roping contest, pie auction, etc. . Local county/westem dance groups will be invited to attend to give demonstrations, etc. . The club will work to identify other means of involving community and other local groups that may want to participate in this event to add to the enjoyment of the evening.
