CITY COUNCIL

DECEMBER 28, 1982
The City Council met in reg~lar session with Mayor Smith presiding. ,Upon
roll call, Council Members Lawrence E. yandeveer, 'Matt Gallagher, Mark M. Millis,
and Karl A. Hogan reported present.
PLEDGE OF ALLEGIANCE
Council Member Hogan~ led the Pledge of Allegiance to our Flag.
Reverend AI. Gorsline, United Methodist Church, Ar~oyo Grande, delivered the
invocation.
APPROVAL OF MINUTES.
Council Member Millis indicated that the minutes of December 15,
1982 stated he was absent although he was present. On motion of Council
Member Gallagher, seconded by Council Member Hogan, the minutes of December 14,
1982 were approved as presented and the minutes of December 15, 1982 were
approved as amended.

APPROVAL OF WARRANTS
On motion of Cog~cil Member Yande~eer~ s~conded by Council
Member Hogan, Demand,Warrants #P463 through #P476 and #18905 through #18981
in the amount of $229,472.82 and Payroll Warrants #23981 th;ough #24093 in
th~amount of $79,414.41 were approved and ordered paid.

REQUEST BY DEPUTY CITY CLERK FOR COUNCIL AUTHORIZATION AND APPROVAL OF FUNDING
IN AMOUNT OF $390.00 TO ATTEND CONFERENCE FOR CONTINUING EDUCATION FOR PUBLIC
OFFICIALS
Acting Administrator Clark stated that the Deputy City Clerk is
requesting authorization to attend a conference for Continuing Education for
Public Officials to be held January 16-21, 1983. she..has received two
scholarships in the amounts of $200 and $75 from the California City Clerks
Association which would leave the total cost 'to the City at $315. On motion
of Council Member Gallagher, seconded by Council Member Hogan, it-was
unanimously voted to authorize the amount of $315 for the conference. Council
Member Millis stated that since it appears the City's revenues will be greater
than.originally anticipated, perhaps Staff will be able to attend more
training sessions.
REQUEST BY WILLIAM TEAL.FOR EXTENSION OF TIME:RE: BUILDING HOME AT 211 CANYON WAY
Acting Administrator Clark stated that' Mr.. Teal is asking for
an additional time extension on his permit to.maintain occupancy of tempo~ary
living quarters at this address. Council Member Hogan s~ated that Mr. Teal
should be granted this extension as he is making.every effort to finish the
residence. On motion of Council Member Millis, seconded by Council Member
Hogan, it.was unanimously voted to grant Mr. Teal an additional 45 days.
RECOMMENDATION .BY DIRECTOR OF PUBLIC SORKS FOR ACCEPTANCE OF IMPROVEMENTS,
TRACT 945, SaTO PARK TERRACE, CORNER OF SPRUCE AND ASH, RUDY VELAND
Public Works Director Karp stated that as conditions of approval
on the subject tract, the developer was required to comp~ete certain.street
and utility improvements. The work is nearly completed and will be ready
for acceptance by Council at the next meeting. He recommended that Council
accept on behalf of the public the improvements constructed with Tract 945
which lie within public .rights of way, and authorize. release of the subdivision
bonds. On motion of Council Member Hogan, seconded.by Council Member Vandeveer,
it was unanimously voted to accept the improvements for Tract 945 and authorize
the release. qf the subdivision bonds.
RECOMMENDATION BY PARKING AND TRAFFIC COMMISSION TO RELOCATE SCAT BUS STOP
AREA ON GRAND AVENUE AT LUCKY/PAYLESS SHOPPING.CENTER, ADOPT RESOLUTION FOR
NO PARKING STATUS
Acting Administrator Clark reported that the Parking and Traffic
Commission recommended ,at their meeting of .November 15" 1982 that. this area
be designated as "No Parking' and relocate the SCAT buststop. Attorney Shipsey
read the title of the resolution. On motion ofICouncil Member_Gallagher,
seconded by Council .Member Hogan, it was unanimously. voted to dispense with
further reading of the resolution.

RECOMMENDATION BY DIRECTOR OF PUBLIC WORKS RE: PROPOSED REVISION TO CROSS
SECTION STANDARD FOR EL CAMINO REAL-FRONTAGE ROAD, JAMES E. MEINERT, 1105
EL,CAMINO REAL-
Public Works Director Karp reported that at the last meeting,
Staff was asked to review a request by Mr. Meinert of Five Cities Rent-All
to modify the approved cross section for the frontage road; -El Camino Real.
The proposed revision indicates an 8 foot wide walk with a street 'tree planting
easement behind the sidewalk for the commercial cross section. This is the
most significant difference between xhe two cross sections. Mr. Karp stated
that Staff feels this is a workable solution and will compliment the improvements
required on the north Frontage Road'in front of K-Mart. He recommended
approval of the proposed revision. Mr. -Meinert indicated that he was in
agreement with 'the proposed revision~ After discussion, Council Member Hogan,
moved to accept the revision to the cross standard for El Camino Real-Frontage
Road and was seconded by Council Member Gallagher. All voted in favor.

Council Member Millis expressed concern that compact parking spaces',be
marked as such. Public Works Director Karp stated that the City's construction
standards will be amended to require some designation.

Planning'Director Hays stated ',that the ,Planning Commission will consider 'the
General Plan update in January. Acting'Administrator Clark 'stated that
inspections have been made as to the condition of the Council Chambers after
use by the Alcoholics Anonymous group and it has been found that on an average
basis it has not been left in an orderly manner. He pointed out that the
contract with'Aicohcil,ics Ano';ymous states that the Chambers will be left
in the order in which it is found. Council Member Millis stated that a
motion was passed"by~Council some years ago prohibiting smoking in the Chambers.
Mayor Smith stated it was her ,understanding that only the adjacent room
was to be used by AA and not the Chambers room. Mr. Bob Smith, 801 Merced,
Pismo Beach, stated that the Chambers will be properly monitored and that the
Chambers room has been used because of the group's growing attendance. It
was the consensus of Council to continue Alcoholics Anonymous' use of the :'T'O.1
CounciiL'Charnbers with the understanding that it will be returned to its
original condition. Acting Administrator Clark reported that the'Woodland
Drive residents have been sent a copy of the proposed agreement for their
review and Staff will have a report January 11, 1983, as well as the School
Facilities Fee Ordinance, Spheres of Influence, and Proposed Water Rate Increase
Matters. Attorney'Shipsey stated ,that Mr. Lemon has executed'twor'on conditional'
easements deeds 'in' favor of, the Pecks ,and ,the 'Honeycutts.' ,He has recorded
a notice releasing the ,previously recordedrlnotice. -At ~th~s' point, in the
Ci ty' s view i the matter has been completed. Mr. Shipsey,'also stated ,that, ,
a letter has been received .from Mr. 'Cool,. Mr. -Wells' attorney, r€!q-q,esting
a meeting.
COUNCIL,DISCUSSION RE: POSSIBLE TIME CHANGE TO COMMENCE COUNCIL MEETINGS
Acting Administrator Clark stated that it was requested this
item be p~acep on the agenda and a proposed meeting time of 7:00 P.M. was
suggested. Council Member Millis sbated he requested this item be discussed
because of the recent latenmeetings. Council Member Gallagher agreed with
the"proposed time of 7:00 P.M. Council Member Vandeveer stated he is not in
favor of the earlier time and in fact would be in favor of a later time.
Council Member Hogan agreed. Mayor Smith stated she is'not'in favor of the
earlier time. It was the consensus of Council to continue meeting at the
current time of 7:30 P.M.

ORAL COMMUNICATIONS
Council Member Vandeveer questioned the status of the proposed
crosswalk at the newly constructed condominiums on So. Elm Street.
Public Works Director Karp stated that item will be considered by the Parking
and Traffic Commission at their meetmng of January 17, 1983. Council Member
Gallagher questioned the status of the 'possibility of prohibiting left turns
from East Branch onto Bridge Street. Mr. Karp recommended that this matter 'U"r._'
be placed on the next agenda of the Parking and Traffic Commission.
Council Member Gallagher questioned mileage for council' members. Council
MembeL'Millis requested staff to research" the possible differences of the
designations of 'City Administr~tor' and 'City Manager'.
ADJOURNMENT
On motion of Council Member Hogan, .seconded by Council Member
Vandeveer, it was unanimously voted to adjourn -at 8:45 P..M. to an adjourned
session on January 8, 1983 at 8:00 A.M. at 214, East Branch Street for the
purpose of interviewing applications for the position" of 'City Administrator.

for the position of City Administrator.with Mayor"Smith presiding. Council

were present. Council adjourned to Closed Session at 8:20 A.M. and "returned
at 4:15 P.M. The meeting was adjourned at 4:30"P.M.
