Upon roll call, Council Members Hugh Pope, Jr. "Matthew P. Gallagher, Jr., Gabe de Leon and B'Ann Smith reported present. PLEDGE OF ALLEGIANCE AND INVOCATION Mayor Millis led the Pledge of Allegiance to our Flag. Thereafter, Finance Director Bacon delivered the invocation. APPROVAL OF MINUTES & DENIAL TO REOPEN WILDWOOD RANCH REZONING PUB. HEARING Councilman de Leon mad~BmotionJ seconded by Councilman Pope, to reopen the public hearing of the Wildwood Ranch proposed development, to further consider the rezoning in view of changes the developer is willing to make on certain things which were of concern-to,'the Council and public. Discussion followed, among the Council and City Staff, regarding the normal review procedure of rezoning matters.' Concern was indicated that the public had felt a definitive, decision had been made at the end of the public hearing on this matter at the Council's last meeting, and reopening it at this time, without notice to the public, would not be proper. After Council discussion, a roll call vote on the above stated motion failed, as follows: AYES: Councilmen Pope and de Leon; NOES: Council Members Gallagher, Smith and Mayor Millis. Mayor Millis pointed out a correction of the last Council'meeting's minutes. A motion was then made by Councilman de Leon, seconded by Councilman Gallagher and unanimously carried, approving the minutes for the regular meeting of June 26, 1979, as prepared, 'with the following correction': Page is (or Pg. 198 of Book 10 of the Permanent Council Minutes Record), Paragraph 9 under the heading of IIPublic Hearing on Land Use - Buena Vista Terrace and Baden Prop~rtY"J the notice of a public hearing on Juiy 24th by Mayor Millis should not include "Buena Vista property and the.....". I, APPROVAL OF WARRANTS On motion of Councilman Gallagher, seconded by Councilman de Leon and unanimously carried, Demand Warrants No. 11083 through No. 11158, in the total amount of $240,743.12 (which includes a Lopez Contract Payment of $212,212.95); and Payroll Warrants No. 14295 through No. 14414, in the total amount of $44,884.31, were approved and ordered paid. NOTIFICATION OF ITEMS WITHDRAWN FROM AGENDA Mayor Millis noted that it has been requested that Agenda Item B-2 be continued until 8/14/79; and that Agenda Item D-l has been withdrawn for considera- tion this evening. RECEIPT OF DEPARTMENTAL REPORTS FOR JUNE, 1979 The Council received, reviewed and ordered filed the Depar~mental Reports for the month of June, 1979. ADOPT RESOLUTION - AUTHORIZE ADDITIONAL VEHICLE FOR FIVE CITIES TAXI Administrator Butch reviewed that a public hearing had been held at the Council's last-meeting regarding the request by Five Cities Taxi Company for an additional service vehicle, and a resolution is now ready approving said request. He then read the title of a resolution authorizing said additional taxi. A motion was then made by Councilman Gallagher, seconded by Councilman de Leon and unanimously carried, to dispense with reading the balance of this resolution. PROGRESS REPORT - CONTROL OF FILMS IN NEW THEATERS THROUGH ZONING City Attorney Shipsey reported that he has contacted the League of Calif- ornia Cities Library for help regarding control of the type of films that may be shown in any new theaters in the City, but as yet has had no response from them. RECEIPT OF 1978-79 ANNUAL REPORT FROM A.G. CHAMBER OF COMMERCE The Council reviewed the 1978-79 Annual Report from the Arroyo Grande Chamber of Commerce. Jim Moore, President of the Chamber, was present and requested a study session with the Council and Chamber Board of Directors, to discuss the pursuit of some of the projects recommended in the Annual Report. The Council agreed to meet with the Board on August 22, 1979 at 7:30 P.M. in the Council Chambers. u APPROVE CONTEST RE. NEW CITY EMBLEl-l Administrator Butch reviewed his recommendations regarding a contest open ' to County residents, for the development of a new City emblem. He suggested a $50 Savings Bond (costing the City $37.50) as a prize for the winning entry and that the deadline for entries be set for September 4th, with the winner to be announced as part of the Harvest Festival activities. Information and materials for the emblem would be supplied by the City to interested entrants. The Council discussed the idea, having varying opinions as to the amount of the winning entry's prize; the need for a monetary pr~ze, and the need for a I new emblem. After Council discussion, a motion was made by Councilman Gallagher;and seconded by Councilman de Leon, authorizing the City to sponsor a new emblem contest, as outlined above, with a $50 Savings Bond to be given to the winning entrant. The motion carried on the following roll call vote, to wit: AYES: Council Members Gallagher, de Leon and Mayor Millis; NOES: Council Members Pope and Smith; ABSENT: None. PUBLIC HEARING - LAND USE RECLASSIFICATION OF PROPERTY AT BRISCO & GRAND Planning Director Castro: clarified that only the Land Use question was being considered this evening, with the rezoning to be considered at a later meeting. He stated that the Planning Commission has recommended a uniform Land Use classification for the total Cocks-Harris property on the northeast corner of Grand and Brisco, as a spl~ use causes many problems. Part of the property is shown as Heavy Commercial-Light Industrial Use, and the portion fronting on Grand Avenue is designated for Highway Commercial. He further stated that existing industrial use on the property will be protected by the non-conforming law, if the Council does change the classification to Highway Commercial for the whole property. Councilman Gallagher stated he felt that Brisco Road should be reclassi- fied in the Circulation Element from a lIcollector" to a IImain thoroughfare". Planning Director Castro did not feel it necessary at this ti~e, bec~use of problems that would be encountered with existing developments and the short portion of Brisco within the.City. The hearing having been properly published and noticed, Mayor Millis declared it open for public comment. --Colonel Jacobs, 1136 Grand Avenue, requested clarification of the difference between liP-Mil and "H_S" classifica- tions, which was explained by Planning Director Castro~ He further assured Mr~ Jacobs that apartment houses are not allowed in either of these classifications. John Bainer, 1148 Grand, stated his feeling that when rezoning property, the City does not adequately consider the investments put into the industrial area and businesses by property owners, or the traffic generated by some types of businesses~ u There being no further public comment, Mayor Millis declared the hearing closed. Council discussion indicated general agreement that the land use should be the same for the whole property and that the Highway-Commercial ("H-S") is compatible in that area. PUBLIC HEARING - REZONE *77-103, GRANDE HIGHLANDS, "A" TO "P-D" - CONT'D TO 8/14/79 Planning. Director Castro reported receiving several calls from principals involved in the Grande Highlands,Planned Development project, requesting the hearing on this rezoning be continued until the Council's first meeting in, August, to enable them additional time to resolve some concerns raised. He further assured the Council that the presentation to be made to the Council on this development will, not be, altered from what was given the Planning Commis- sion, but that the developers would have alternatives available. The hearing having been properly published and noticed, Mayor Millis declared'it open for public comment, inviting those'persons present this evening to speak on the issue, if they felt they may not'be able to attend the hearing on August 14th. Lester Krushat, 222 W. Cherry, stated he was speaking for twenty-' one property owners whose property would be bordering the proposed development. He stated he is working on a petition,which he then read, protesting the develop- ment because of. increased traffic on Orchard Avenue and other streets' in that area. Paul Haddox; 587 Valley Road, also stated his concern about additional traffic on Orchard, feeling that if other access is not available for the proposed development, that the rezoning, should not be granted~ There being no further public comment, a motion was made by Councilman Pope, seconded by Councilman de Leon and unanimously carried, continuing the public hearing regarding'Grande Highlands Rezoning No. 77-103, to 8 P.M. on August 14, 1979. PUBLIC HEARING - REGULATIONS RE. CONVERSION OF APTS. TO'CONDOMINIUMS Planning Director Castro reviewed a proposed Ordinance setting forth regulations for the conversion of apartment houses to'condominium units. He stated that since the presentation of the recommended draft ordinance for conversions, one major change has occurred, with the suggestion being made "that rather than po.lice .f:onversions via a vacancy rate, a phasing plan for the next 15 years" be, considered. He reviewed with the Council his memorandum explaining the phasing plan as opposed to the City's Housing Element recommenda- tions for number of apartment units to remain in the City. Also reviewed were two suggested "Requirements for. Auditory Standards" for inclusion in the proposed ordinance. The hearing having been properly published and noticed, Mayor Millis declared it open for public comment. Bill Kapp, 617 Woodland, stated his' concern regarding the' City mandating the number of certain types of housing in the City, such as low cost. Jim Moore, Montego Street, questioned the difference in building standards for apartments vs. condominiums. Planning Director Castro assured him that condominium standards are much more stringent, that conversion is very costly, and that even walls have to be exposed for inspection. Bill Lackey, 1270 Longview, Pismo Beach, disagreed with the require- ment that 25% of a-condomind!um-_complex be low cost housing, stating that this would mean that the remaining units were subsidizing the low cost units, which was not fair. Gregory Weiss, 300 Miller Way, asked whether any developers, within the last three years, built apartments with the idea of converting them later to condominiums and if there were, why were they denied permission to build condominiums in the first place. Planning Director Castro replied that most of them were in .violation of density requirements and some did not particularly want to build condominiums at that particular time. Off hand, City Staff could only think of one apartment complex which was built by stricter standards, for possible conversion in the future. Al Gorsline, Planning Commissioner, commented regarding the low income units requirement, stating that developers had indicated this would not be a problem since children are not allowed usually in condominium developments and the low income housing would be studios and the~'.smaller units. Planning Director Castro emphasized that the proposed ordinance is not to discourage con- versions, but to have certain amenities assured to property owners and that the conversion be done properly. Gregory weiss asked how much one has to'make a year to be considered "low' income". Planner Sullivan explained it is 80% or less of the median income of the County, which right now is about $12,500 annually for a family of four. The smaller the family structure, the income is adjusted. Roger Fuller, 222 McKinley, asked if there would be any subsidizing of the property owner for low cost housing~ Planning Director'Castro stated there are programs 208 CITY .COUNCIL ARROYO GRANDE,. CALIFORNIA JULY .1 0, 1979. PAGE 4 where a city can participate, property owner. There being no further public comment, Mayor Millis declared the hearing closed. Council discussion ensued, with Councilman Pope requesting more time to'; review.,. the proposed ordinance and phasing plan, and getting more public input. Councilman Gallagher felt the ordinance was good. Councilwoman Smith. agreed it was a good ordinance, but. wishes to study the figures for the phasing plan more. Councilman de Leon liked the ordinance, but questioned the review process if a conversion is requested. Planning Director Castro outlined the procedure, which. does not include the Council. Mayor Millis suggested that a Condominium Conversion Committee be. set up, made up of various City Staff members, and that all would have to be present to make a quorum when they meet. Said Committee would review a conversion request before it goes before the Planning Commission. After Council u. discussion, a motion was made by Councilman de Leon, seconded by Councilman Gallagher and carried, to continue consideration of the proposed Condominium Conversion Ordinance at the Council's July 24th meeting. to enable them addi- tional time to study the phasing plan figures. but it can also be the responsibility of the PUBLIC HEARING - APPEAL DENIAL OF USE PEm1IT #79-283, SO HALCYON '(FILER) ~ DENIED Planning Director Castro reviewed that an appeal had been filed before the Council on the Planning Commission's denial of Gordon Filer's application for a Use Permit (Case No. 79-283) for construction of condominiums in a lip-eli, Professional Commercial District, at 321 and 327 So. Halcyon Road. The hearing having been properly published and noticed, Mayor Millis declared it open for public comment. Nash Brown, 1147 Marsh, San Luis Obispo, architect for the project, reviewed the background of this Use Permit application, stating that it had been aplied for, for.:.the same project, before but the time on the granted permit ha~run out because of a family tragedy. Now they are merely trying to pick-up the project again. He stated this project would be medium priced housing which is needed in the City. Elizabeth Jackson, 208 Fair View, asked what Mr. Nash means by "medium Price" range. Mr. Nash replied it meant probably in the high $50,000 range. - ?< ,/ // There being no further public comment, Mayor Millis declared the hearing closed. Council discussion indicated the majority felt. other areas to be better: , suited for housing and this area was better used for professi6nal~;,offices.. Council- man Pope stated he would rather see affordable housing than more Professional- Commercial uses. Councilman de Leon asked whether the Use Permit request is in i compliance with the City's provisions, which Planning Director Castro answered in the affirmative. Councilman de Leon stated he had no objection to the condominiUms. After Council discussion, a motion was made by Councilman Gallagher and seconded by Councilwoman Smith to deny the appeal of Gordon Filer and uphold the Planning Commission's denial of Use Permit Case No. 79-283. COUNTY AREA COUNCIL OF GOVE~rnNTS' ~rnETING Councilman Gallagher reported on the July 5, 1979 meeting of the San Luis Obispo County Area Council of Governments, stating that the SB 325 funds had been distributed. City Engineer Karp reported that the County is preparing bids to overlay and add a six foot shoulder for pedestrian use on the County's portion of Valley Road. The County is also preparing a joint powers agreement with the City to secure payment for the pedestrian walk from the City~ u PROGRESS REPORT - CITY CURFEW ORDINANCE FOR JUVENILES City Attorney Shipsey reported that he had revised the proposed Ordinance setting a City curfew for juveniles within the City of Arroyo Grande and had giv~n said revisions to the Police Chief for his review. ORDINANCE ADOPTING VARIOUS AMENDMENTS TO ZONING MAP - 1ST READING The Council reviewed a proposed ordinance adopting various amendments to the Zoning Map for consistency with the General Plan. Administrator Butch then read~. for its first reading, the title of an ordinance amending the Zoning Map by rezoning various areas in the City. A motion was then made by Councilman Gallagher, seconded by Councilman de Leon and unanimously carried, to dispense with reading, the balance of this ordinance. CITIES The Council received and reviewed the.latest Legislative Bulletins from the League of California Cities. n r '\ I J ,') r. 7 !'-UI I , I I CITY COUNCIL ARROYO GRANDE, CALIFORNIA JULY 10, 1979 PAGE 5 RECOMMENDATIONS OF THE PARKING & TRAFFIC'COMMISSION: A., SIGHT DISTANCE AT SCOLARI'S MARKET ON GRAND AVENUE ,City Engineer Karp'projected a photograph of the area, on Grand Avenue at Scolari's (aka Lucky's) Market, where a sight distance problem exists for shoppers exiting the parking lots adjacent to the market. He stated'that requests have been received to eliminate the parking between the driveways of the ' parking lots, and also adjacent'to the Fotomat business. After Council discussion, Administrator Butch read the title of a resolution establishing "No Parking" zones on the south side of a portion" of Grand Avenue. A'motion was then made by Councilman Gallagher, seconded by Councilman de Leon and unanimously carried, to dispense with reading the balance of this resolution. RESOLUTION NO. 1368 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY'OF ARROYO GRANDE, ESTABLISHING "NO. PARKING" ZONES ON A PORTION OF THE SOUTH SIDE OF GRAND AVENUE. SIGHT DISTANCE ON BRANCH AT GARDEN STREET City Engineer Karp reviewed the sight distance problem for persons coming from Garden Street onto Branch Street, and the recommendation that a "No Parking" zone be established on Branch to give better vision to the left when exiting Garden Street. Martin Poole, 132 Le Point, stated he'had lived on Garden Street and elaborated on the sight distance problem. A motion was made by Councilman Gallagher, seconded by Councilwoman Smith and WITHDRAWN after discussion, to uphold the Parking & Traffic Commission's recommendation for th~---,establishment of a "No Parking" zone,on a portion of Branch at Garden Street. "Councilman Pope objected to the fact that property owners on Branch, who would~be affected by the parking elimination, are not properly notified so they may speak on the matter. Councilman de Leon made a motion to table the, matter for further study, which died for lack of a second. City Engineer Karp pointed out that this was a safety problem at Branch and Garden Streets and should be taken care of by the Council, not public opinion. k motion was. then made by Councilman Pope, seconded by Councilman de Leon and unanimously carried, directing City Staff to investigate and prepare an ordinance regarding, notification to property owners, if no emergency exists, of the City's consideration to eliminate parking adjacent to their private property. After further Council discussion, a motion was made by Councilman Pope, seconded by Councilman Gallagher and unanimously carried, that the sight distance problem on Branch at Garden be brought back before the Council at its July 24th meeting, and that the involved property owners be notified of this. APPEAL OF PLANNING COMMISSION DECISION RE. LOT SPLIT CASE *79-303 (POOLE/HEAD) Planning Director Castro reviewed an appeal filed by Lot Split applicants Martin Poole and Thomas. Head, regarding the Planning Commission's clarification of the "-D" override on Tract 600 to mean that none of the parcels could be split further. They feel that this action was eqUivalent to a zone change without a public hearing. Planning Director Castro disagreed that a hearing was necessary, since the Commission was only reconsidering an item referred back to them by the Council, with the instruction that the "_D" override is to be considered as no further division of any of the 35 acres, etc. (See 6/26/79 meeting Minutes). The Council discussed with City Staff the appeal procedures for the City, with Attorn~y Shipsey researching various sections of the Code. Itdwas then agreed to hold this matter off temporarily until later in the meeting, to give City Attorney shipsey time to research the appeals process further. Later in the meeting, City Attorney Shipsey read various sections of the Municipal Code relating to appeals. It was noted that a $50 appeal filing fee had not been paid by Mr. Poole or Mr. Head. ' RECEIPT OF BIDS & AWARD FOR TWO POLICE CARS (CHRISTIANSON CHEVROLET) The Council reviewed a report from Police Chief Clark, which "etsccforth the bids received from the two,local agencies - Christianson'Chevrolet and Paul Reynolds Ford - for two new vehicles, as budgeted for 1979-80. After Council discussion, a motion was made by Councilman de Leon, second~d by Councilwoman Smith and unanimously carried, accepting the low bid of Christianson Chevrolet for two 1980 Chevrolet Malibu vehicles, at a cost not'to exceed a 5% increase over the quoted 1979 price of $12,302.00 for both vehicles. APPOINTMENT OF PLANNING COMMISSIONER - ROBERT CARR Mayor Millis nominated Robert W. Carr to the Planning Commission, to fill the vacancy created by Ron Harris' absences a The motion was seconded by Council- man de Leon and unanimously carried a u PROGRESS REPORTS: VARIOUS CITY PROJECTS FIRE STATION SITE: Administrator Butch reported that everything is going along'fine. The acquisition of the Traffic Way property is in escrow. A description of the access easement is being worked on for inclusion.. COMMUNITY BUILDING: Administrator Butch stated there is nothing new to report. The agreement is still being discussed and it is hoped that something affirmative will be presented to the Council at its next meeting. STROTHER COMMUNITY PARK: Administrator Butch reported the paving has been completed. ELM STREET SPORTS COMPLEX: preliminary plans show five tennis Recreation is reviewing the plans Administrator Butch stated that the basic courts will fit on the property. Parks & now. The grading plans are being redrawn. WATER SYSTEM: The City is waiting to discuss the actual site location with the property owner. APPROVE CONTRACT WITH G.C. SENIOR CITIZEN CLUB FOR SENIOR VAN PROGRAM The Council reviewed a report from Administrative Inte~n Randy Wagner, regarding a proposal by Emery Welker of the Grover City Senior Citizen Club to take over the Arroyo Grande Senior Van Program at a yearly cost of ~1500. Services rendered to Arroyo's Senior Citizens would be as follows: 24-hour service 5 days a week;-24-hour emergency service 7 days a week; and free transportation to the Nutrition Center. Transportation will also be provided anywhere'in the Five, Cities area for $1.00; and $3.00 will be charged if two or more people travel together to either San Luis Obispo or Santa'Maria to visit doctors, hospitals, etc. After Council discussion, a motion was made by Councilman Gallagher, seconded by Councilman de Leon and unanimously carried, authorizing the City to enter into a contract with the Grover City Senior Citizen Club to include Arroyo: Grande Seniors in the proposed Van Program. NOTICE OF PUBLIC HEARING SET RE. BLUE CURB ORD. FOR HANDICAPPED: 7/24/79 The Council was informed that a public hearing will be set for 8:00 P.M. on July 24, 1979, to consider adoption of a Blue Curb Ordinance, which would provide special parking for physically handicapped persons. u ',"REQUEST FOR ,RELIEF' FROM REQUIRED STREET IMPROVEMENTS (LACKEY) - DENIED The Council read a letter from Bill Lackey, requesting relief from the requirement that he put in street improvements upon application for a building permit to rebuild his fire damaged house at,433 So. Halcyon Road. The Council reviewed a memo from Director of Public Works Anderson; noting that Municipal Code Section 9-4.2421 requires that installation of curb, gutter, sidewalk and pave out is required with a building permit. After Council discussion, a motion was made by Councilman Gal~agher, seconded by Councilwoman Smith and carried, with Councilman de Leon dissenting, denying the request of Bill Lackey to be exempted from the street improvement requirements and upholding the City's Municipal Code provisions. Councilman Pope and Mayor Millis suggested that the property owners on Halcyon Road be contacted to see what can be done to complete the installation of curbs, gutters and sidewalks on this street. APPROVAL OF TRACT 689, OAK PARK VILLAS (FOREMASTER) - HELD OVER This agenda item had been withdrawn at the beginning of the meeting, for consideration at a future Council meeting. PROGRESS REPORT - CANYON WAY ASSESSMENT DISTRICT Director of Public Works Anderson stated that preliminary petitions regarding the assessment spread have been received. AUTHORIZE PROGRESS PAYMENT NO.1 TO SULLY-MILLER FOR STREET PAVING PROJ.90-79-3 City Engineer Karp reviewed that although the Street Paving Project No. 90-79-3 is not completed enough to accept said project, he recommended that Progress Payment No. 1 to the contractor Sully_Miller be approved. The project involves paving of portions of Halcyon Road and Fair, Oaks Ave. After Council discussion, a motion was made by Councilman de Leon, seconded by Councilman Gallagher and unanimously carried, authorizing Progress Payment No. 1 in the amount of $143,662.87 to Sully-Miller for Street Paving Project No. 90-79-3. PROGRESS REPORT - SOUTH SAN LUIS OBISPO COUNTY SANITATION DISTRICT The Council received and reviewed the monthly report for June, 1979, from the South San Luis Obispo County Sanitation District's Chief Plant Operator. Administrator Butch reported that construction on the ocean outfall line will being August 6, 1979. ORAL COMMUNICATIONS: JIM FORTSON of "Up With Families", reviewed verbally the research he has done in regard to other cities trying to control the type of films shown in theaters through zoning. He stated his finding is that zoning does not effectively control "red lightll districts. MAYOR MILLIS offered to personally add to the City Emblem Contest prize, to make it a $75 Savings Bond. Other Council Members objected to this, so he will personally give a separate $25 Savings Bond prize in addition to the City's, to the person submitting the winning entry. COUNCILMAN POPE suggested, and the Council agreed, that a plaque and Certificate of Appreciation be prepared and presented to Cathy Jansen for her years of service to the City in various capacities, including most recently as Deputy City Clerk.
