As of May 31, 2000, the investment portfolio was in compliance with all State laws and the City's investment policy. Current Investments: The City is currently investing all short-term excess cash in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a very high quality investment in terms of safety, liquidity, and yield. The City may readily transfer the LAIF funds to the City's checking account when funds are needed. At this time, the City does not hold any other investments. The following is a comparison of investments based on book values as of May 31, 2000 compared with the prior month and the prior year. SNODGRASS, DIRECTOR OF FINANCIAL SERVICES~ SUBJECT: MILEAGE REIMBURSEMENT RATE FOR EMPLOYEES AND VOLUNTEERS DATE: JUNE 13, 2000 RECOMMENDATION: It is recommended the City Council/Agency establish .325~ per mile as the employee/volunteer mileage reimbursement rate for FY 2000-01 and FY 2001-02. FUNDING: There is no direct fiscal impact by increasing the reimbursement rate from .32~ to .325~ per mile. Sufficient funding is currently budgeted in respective Department accounts for mileage reimbursement. DISCUSSION: The City's Administrative Policy No. A-013, Mileage Reimbursement for Private Vehicles, states that authorized expenses shall be reimbursed at the per-mile reimbursement rate established by the City Council. Staff is proposing that the Council/Board establish the mileage rate at .325~ per mile for FY 2000-01 and FY 2001- 02. Mileage is currently being reimbursed, in most cases, at .32~ per mile in accordance with City Council action of June 9, 1998. However, in certain instances involving training, the Police Department reimburses using the POST (Police Officer Standards & Training) rate of .31 ~ per mile. The change to .325~, from .32~, will bring the City into compliance with the Internal Revenue Service rate. City Council/Aaency Alternatives The alternatives available to the City Council/RDA Agency Board are as follows: 1. Establish the mileage reimbursement rate for employees at .325~ per mile for FY 2000-01 and FY 2001-02. 2. Establish the rate at a cost figure established by the City Council. 3. Provide direction to staff. CITY OF ARROYO GRANDE ADMINISTRATIVE POLICY AND PROCEDURES .' . POLICY #: A-01.3 SUBJECT: MILEAGE REIMBURSEMENT FOR USE OF PRIVATE VEHICLES ISSUED: 6 /1.-/96 EFFECTIVE: 6/1./96 CANCELLATION DATE: N/A SUPERSEDES: NEW POLICY: It is the policy. of the City that employees and volunteers are eligible for the reimbursement of authorized expenses incurred directly by them in the use of their personal vehicle in the performance of City business. PROCEDURE : 1. . Authorized expenses shall be reimbursed at the per-mile reimbursement rates established by the City Council. 2. Authorized use of an employee's or volunteer's personal vehicle in the performance of City business shall be limited to: a. Travel within and outside the City as authorized by the employee's Department Director or Supervisor. b. Travel outside of normal working hours for required public meetings of the City Council, Planning Commission, or other appointed body. Reimbursement may be for mileage to and from the employee's residence (if the employee must return from his/her residence) or from a place of work and return. This type of reimbursement shall only apply to employees who do not receive a monthly mileage allowance. c. Employees who receive a monthly mileage amount shall not be reimbursed for mileage within the City limits. 3 . The approved mileage reimbursement rate includes all fixed costs to the employee or volunteer such as insurance, license, registration fees, taxes, depreciation, and finance charges; and all variable costs such as gasoline and oil, and maintenance. 4. In case of damage to the employee's or volunteer's vehicle while on City business, the employee or volunteer shall be responsible for the cost of repair and/or any insurance deductibles. POLICY #: A-013 PAGE 2 5. Reimbursement for mileage outside the City shall not exceed the cost of the coach-airfare for the same distance or designation. 6 . Reimbursement for mileage included as part of a travel authorization request shall be recorded on a Travel Authorization Request form. 7 . Request for mileage reimbursement for mileage not included on a Travel Authorization Request shall be itemized and recorded on the City's Claim on the Treasury form. SNODGRASS, DIRECTOR OF FINANCIAL SERVICES~ SUBJECT: FISCAL YEAR 2000-2001 APPROPRIATION LIMIT DATE: JUNE 13, 2000 RECOMMENDATION: It is recommended the City Council adopt the attached Resolution establishing the appropriation limit from tax proceeds for Fiscal Year 2000-2001. FUNDING: There is no fiscal impact with the adoption of the attached Resolution. DISCUSSION: Annually, the City is required to calculate the expenditure appropriation limit from tax proceeds to determine compliance with Propositions 4 (Gann Initiative) and 111 (Spending Limitation Act of 1990). This calculation is based on the previous year's appropriation limit ($10,742,035) multiplied by the per capita personal income percentage increase (4.91 %) and multiplied again by the population percentage change (2.62%). The State Department of Finance provides both the population change and the per capita personal income change for the previous fiscal year. The City is responsible for dividing Citywide revenues between tax and non-tax revenue, and applying the formula to the cumulative appropriation limit. For Fiscal Year 2000-2001 the appropriation limit has been calculated to be $11,563,602. This calculation means that the City cannot receive more than $11,563,602 in tax based revenues in Fiscal Year 2000-2001. The estimated tax-based revenues for Fiscal Year 2000-2001 have been calculated to be $6,881,566, over $4 million less than the appropriation limit. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ADOPTING A TAX PROCEEDS EXPENDITURE APPROPRIATION LIMIT FOR FISCAL YEAR 2000-2001 BE IT RESOLVED by the City Council of the City of Arroyo Grande that the Fiscal Year 2000-01 expenditure appropriation limit from tax proceeds is $11,563,602, in accordance with Article XIIIB of the California Constitution (PropA, SB1352). BE IT FURTHER RESOLVED THAT this year's calculation is to include the percentage change in California per capita personal income, rather than the percentage change in the local assessment roll due to the addition of non- residential new construction, as the price factor. Ella Honeycutt, 560 Oak Hill Road, submitted a document she wrote entitled "Arroyo Grande Prime Farmland, A National Treasure" for the record. Bill Pierce, 687 Printz Road, spoke in opposition of changing the residential designation in his area of 1 unit/2.5 acre to 1 unit/1 acre as proposed in the draft General Plan Land Use Element. Mayor Pro Tem Ferrara noted that in response to Mr. Pierce.s comments, an adjustment had been made to the draft Land Use Map to retain 1 unit/2.5 acre density in the area of Printz Road. 5. DISPOSITION OF GENERAL PLAN AMENDMENT REQUESTS Community Development Director McCants gave a summary of the first group of applications for conversion from Agriculture to a more intense land use; and the second group of applications for annexation. Consultant Harter reviewed why these requests were not included in the draft General Plan Land Use Element Update. He said the public comments received tonight were consistent with the input received from the Long Range Planning Committee. He stated that the Council could draft policies to look at ways to maintain agricultural land. There was discussion about the potential for a Transfer Development Credit program and the use of conservation easements. Council Member Runels asked if there was a definition of ..prime.. agricultural land and if it was tied to the dollar amount that the soil provides. Consultant Harter responded that the definition of prime agricultural soil is based on the U.S. Department of Agriculture standards. He stated he had relied on the CASP study criteria. There was further discussion about methods used to conserve agricultural land through conservation easements. Consultant Harter referred to two agriculture related policies that are in the Conservation Element (AG 1-4 and AG 1-4.2) that relate to this issue. Director McCants commented that policies could be put in place through the Planning Commission and City Council public hearing process. Council Member Dickens passed out data and charts he prepared which highlighted agricultural land ownership in the City of Arroyo Grande; the total acres of designated prime and non-prime agricultural land in the City; the percentage of commercial versus non-commercial agricultural land in the City; the number of agricultural parcels by acre in the City; and documentation dated 1977 regarding Greenwood Manor. 2 SPECIAL CITY COUNCIL MEETING MINUTES MAY 15, 2000 The Council began consideration of the disposition of the following requests for conversion from Agriculture to other land designations. APN No. 07-761-021 (Bean and Stava). 1167 and 1212 Flora Road. The request is that the designation of two parcels of 5.0 and 5.08 acres be changed from Agricultural to Residential use. Council discussion included whether or not there was a deed restriction on the property; what the intent of the "D" overlay on the agricultural zoning designation is; whether or not this property was considered ..prime" agricultural land; and if there were restrictions on placing wells on agriculture land regardless of parcel size. All Council Members stated they were not in favor of changing the designation of the agricultural land. There was Council consensus to not include the request in the draft General Plan Land Use Element Update. APN No. 06-761-032 (Huahes and Jones). 1189 Flora Road. The request is that 9.99 acres be changed from Agricultural to Single Family Residential. Otis Page, 606 Myrtle, stated he was not speaking on behalf of Mr. Jones; however, he did not think people were aware of what the Council was doing tonight. Council Member Dickens responded that specific letters were sent to the property owners regarding the date and time of the meeting. All Council Members stated they were not in favor of changing the designation of the agricultural land. There was Council consensus to not include the request in the draft General Plan Land Use Element Update. APN No. 07-791-022 (VanderVeen). 1273 Branch Mill Road. The request is that five acres be changed from Agricultural to Residential. There was Council consensus to not include the request in the draft General Plan Land Use Element Update. APN No. 06-341-018 (Church of Jesus Christ of the Latter Day Saints) Mayor Lady and Council Member Runels declared a potential conflict of interest on this item due to business and real property ownership, respectively, and stepped down from the dais. The property is located on Fair Oaks Blvd. The request i~ that four acres of a parcel of 13.15 acres designated Agricultural be changed to Public Facility to 3 SPECIAL CITY COUNCIL MEETING MINUTES MAY 15, 2000 allow construction of a new church with the remaining 9+ acres to remain as Agricultural. ~eff Wagner, Engineering Development Associates, spoke as a representative on behalf of the Church. He stated that the Church bought the property to build a church, and that the property across the street was zoned Public Facility. He suggested that instead of redesignating the property, the Council make churches an allowable use in the Agricultural zone. Howard Mankins, 200 Hillcrest Drive, stated he was a member of the Church which has 1,000 members. He spoke about the need for another church and that it would be close to the High School so that students could attend a program before school. He stated that the surrounding uses are compatible; spoke about the Church's welfare program which uses agricultural products; and requested an opportunity to present a plan to use the property for religious purposes. Jim !VIcGillis, a member of the Church, spoke about prime farmland, classification of soils, water issues, housing for farm workers, and stated that the parcel size mattered. He stated that the Church would be compatible with surrounding uses and would not be intrusive on the Saratari farm. Nanci Parker, 1127 Vard Loomis Lane, acknowledged the previous comments and stated that the issue is with prime farmland and this property was prime farmland. Karen Cross-Harmon, 390 Mercedes Lane, agreed that this was prime farmland and the neighborhood is farmland. She suggested an alternative site for the church and referenced a parcel near Rodeo Drive which she believed was not appropriate for homes. Ella Honeycutt, 560 Oak Hill Road, stated this was world class soil and is irreplaceable. Adam Saratari, 1038 The Pike, stated he farms next to the parcel in question. He stated that churches and schools are not compatible with farming and that Fair Oaks Avenue is the buffer between the uses. Dennis Donovan, 337 Galardi, spoke in favor of retaining the property as Agricultural. Bill McCann, 575 Crown Hill, spoke in favor of retaining the property as Agricultural and stated there were other places to put churches. Council Member Tolley said the Saratari land would be affected and did not support the request. Council Member Dickens said the City needed to do everything in its power to help the farmers; spoke about the issue of parcel size in relation to farming activities; did not favor adding other uses to the current zoning designation; and did not support the request for conversion. Mayor Pro Tem Ferrara spoke about the affect on the adjacent property owners; commented on Ms. Cross-Harmon's Rodeo Heights proposal; supported the suggestion of looking for an alternative site for the church; and did not support the request for conversion. There was Council consensus to not include the request in the draft General Plan Land Use Element Update. Mayor Lady and Council Member Runels returned to the dais. The Council began consideration of the disposition of the following requests for annexation. APN No. 75-011-041 and 75-011-042 (Ellsworth) The property is located on Halcyon Road adjacent to the City limits. The request is for both parcels to be annexed to the City and the designation changed on the second parcel from Agricultural to Residential. Director McCants noted for the record a letter received from Mr. Ellsworth requesting that if the Council scheduled a second meeting to consider the requests, that his request be considered then as he could not attend this meeting. Council and staff discussion included the location of the parcels and whether annexation would create an "island" of land between County and City limits. There was discussion about LAFCO requirements for annexation. Bill McCann, 575 Crown Hill, requested a more detailed map to show the current land uses. Leroy Saratari, stated he farms next to the parcels and reviewed the existing County and City land uses surrounding the parcels. Council Member Dickens commented on the intent of the proposed annexation and change in designation. APN No. 75-021-040 (Saint John's Lutheran Church). 959 Valley Road The property is 5.22 acres and the request is to annex to the City. Pastor Randy Ouimette, 327 Noguera Place, stated that the Church is located at the entrance to the City from Los Berros Road. He said a majority of the congregation lives within the Arroyo Grande City limits; police and fire services are currently provided by the County; the Church has a water well and a septic system; and the Church desires to be part of the City. Council Member Tolley asked if the City was mandated to provide water and sewer if the property was annexed into the City. Director McCants responded no. Mayor Pro Tem Ferrara asked about issues with maintenance of the creek. Director McCants replied that there was an Agreement with the County t~ maintain the creek and roads. Interim City Manager TerBorch commented that in regard to fire services, the City responds to calls as part of an Automatic Aid Agreement, and the police respond to calls for service at request of the County Sheriff. Council Member Tolley stated he would support looking at annexation of this property. Council Member Runels spoke about issues with the Los Berros Creek and stated he did not support annexation. Council Member Dickens stated he did not see the benefit to the City; however, he would not be against studying the feasibility of annexation. 6 - - SPECIAL CITY COUNCIL MEETING MINUTES MAY 15,2000 Mayor Pro Tem Ferrara commented that the property was outside the City's sphere of influence and asked if this would pose a problem. Director McCants replied that LAFCO would have to consider and approve changing the sphere of influence. He stated he needed clarification with regard to the creek; what the fiscal impact would be; and more clarification on the Church's potential to remain on a septic/well system. APN No. 75-001-045 and 75-001-046 (Hollywood). 770 Vallev Road The property is 27.7 acres and the request is for annexation into the City. There was consensus of the Council to not include the request in the draft General Plan Land Use Element Update. APN No. 47-301-001 (Williams and Von Achen) The request is for the annexation of 200 acres located south of Arroyo Grande on the east side of Highway 101, adjacent to the Frederick's property. The current designation is Agriculture and the request is to change to Business Park/Light Industrial. Otis Page, 606 Myrtle, spoke in support of eventual annexation. Kirk Scott, 520 Via Vaquero, stated that growth down the 101 corridor makes logical sense. He suggested that the property be included in the City's sphere of influence. He stated that it was premature to consider annexation of this property . Alice Reinhart comme~ted that a lot of the people want to maintain the rural character of the area. She stated it was very premature to consider including this property in the sphere of influence. Karen Cross-Harmon, 390 Mercedes Lane, agreed that it was premature to consider annexation. AUTHORIZATION TO DISTRIBUTE THE DRAFT EL CAMPO ROAD/ROUTE 101 PROJECT STUDY REPORT (PSR) Director of Public Works Spagnolo highlighted the staff report. He explained that the draft PSR has been revised based on the comments provided by the Council at the April 11,2000 meeting. He stated that the draft report identifies the proposed project alternatives, including right-of-way requirements, estimated project costs, roadway geometric configurations, and a preliminary environmental assessment report. Staff recommended the Council authorize the distribution of the draft EI Campo Road/Route 101 Project Study Report for a 45- day public comment period and direct staff to return to the City Council with a summary of public comments and make any modifications deemed necessary or appropriate. Mayor Lady opened up the discussion for public comment. Mike Titus, 404 Lierly Lane, stated he was not opposed to the development of the Arroyo Linda Crossroad project or the annexation of the additional property proposed. He said there are many elements of the Specific Plan he disagreed with which he would provide in writing. He stated that he was confused about the timing, because the el Campo interchange seems to be connected to the proposed development. He commented that there was no funding mechanism in place. 3 CITY COUNCIUREDEVELOPMENT AGENCY MINUTES MAY 23, 2000 Otis Page, 606 Myrtle, stated he spoke on this matter at the last Council meeting and that it was his understanding there would be a funding plan coming forth. He stated that the document has language that would create a funding mechanism; however, that was not a funding plan. He said the Arroyo Linda Plan and the Interchange Plan were running parallel. He asked how a consultant could make a determination of the financial impact of the Arroyo Linda project until they know what the plan is on the interchange. He further stated that the key issue for the community is that the project cannot be done without the interchange. He said he was not opposed to distributing the PSR on the condition that the City discloses the funding mechanism. Hearing no further comments, Mayor Lady brought the discussion back to the Council for consideration. Council Member Tolley stated t~at the changes requested by the Council were made to the document. He agreed with Mr. Page's comments about the funding mechanism in that the City does not know where the money will come from. He stated he was in favor of distributing the PSR for a 45-day public review and comment period. Council Member Runels stated that this was a part of the process and spoke in favor of moving forward with the public review and comment period. Council Member Dickens commented that funding was a big issue. He stated the report was clear that the primary objective of the EI Campo Road interchange is to provide access to the Arroyo Linda Crossroads project. He read a portion of the language in the Introduction and Recommendation regarding funding from a regional agency and from the project applicant. He referred to page 5, 2nd paragraph, and requested staff add the word "as proposed" to the following sentence: "The development as proposed is to be constructed in. two phases...... Council Member Dickens asked for clarification on policy making regarding funding and referred to the construction cost differences between roadway segments and structures. Director Spagnolo explained that the structure was the bridge and concrete portions that are structural elements to hold the roadways; and that roadways are the approaches to the structures within the project limits. There was discussion about the cost difference between Alternative 1 and Alternative 2. Director Spagnolo explained the increased costs for Alternative 2 which relate to the physical location of the proposed interchange which would require more grading than Alternative 1. Mayor Pro Tem Ferrara referred to page 8, 2nd paragraph under Needs & Purpose, which states that "The project is needed due to continued growth within the City of Arroyo Grande's sDhere'of influence...". He requested that staff ensure that Dokken Engineering isn't drawing this conclusion and suggested it be clarified to say that "The Project Development Team asserts that the project is needed due to continued growth...". Mayor Pro Tem Ferrara referred to page 14, 2nd paragraph, and stated he didn't recall if the accident data was collected recently enough to take into consideration the northbound entry lane that's been installed on Highway 101. He requested that the data be updated so that it is current. Mayor Pro Tem Ferrara referred to page 19, 3rd paragraph, and asked for clarification on the discussion of a Mitigated Negative Declaration versus an EIR. Director Spagnolo explained that an initial environmental assessment was conducted and that more formal environmental documents would be prepared at the Project Report stage. Further Council discussion included the impact of development activity on the Mesa on the project, discussions with County Planning staff regarding the patterns of driving coming down from the Mesa, and the County's focus on fixing Halcyon Road and Highway 1 based on survey results that the patterns of driving will not change. Council Member Dickens clarified some comments he made at the last General Plan Update workshop. He reported he had taken a tour of Petoseed, gave a brief overview of highlights on the tour, and distributed a handout of information from the website of Seminis. 14. STAFF COMMUNICATIONS Interim City Manager TerBorch stated that the City Engineer intends to accept Parcel Map AG 00-0037, owned by Mary A. Adams. The subject parcel is located at 198 South Alpine Street. This is a split of one parcel of 24,279 square feet in size into two separate lots of 13,241 and 11,038 square feet in size. There are existing single family residential units on each of the proposed parcels. Unless appealed, the Final Map will be approved or disapproved by the City Engineer within ten days following the date of this meeting. There was no appeal by the Council. 15. Adopt a resolution requesting the Board of Supervisors of the County of San Luis Obispo to consolidate the General Municipal Election to be held on November 7, 2000, with the Statewide General Election to be held on the same date pursuant to Section 10403 of the Elections Code; . Adopt a resolution calling and giving notice of a General Municipal Election to be held in the City on Tuesday, November 7,2000, for the election of certain officers of the City; . Adopt a resolution establishing regulations for candidates for elective office pertaining to materials submitted to the electorate for the General Municipal Election on November 7,2000; and . Adopt a resolution providing for the conduct of a special runoff election for elective offices in the event of a tie vote. FUNDING: An appropriation of $7,300 is needed to fund the November 2000 General Election. Such an appropriation is included in the Administrative Services Fiscal Year 2000-01 budget requests. DISCUSSION: This year, the terms of Mayor Lady, Council Member Runels, Council Member Tolley, City Clerk Davis, and City Treasurer Wizemann are expiring. The California Elections Code establishes procedures and requirements for conducting a Municipal Election. As the first step in the election process, certain resolutions must be adopted by the local governing agency. 2000 General Municipal Election Page 2 Pursuant to Municipal Code Section 2-9.01, the City's general municipal election shall be held on the same day as, and consolidated with, statewide general elections. Therefore, the City is requesting the County Board of Supervisors consolidate the City's General Municipal Election with the Statewide General Election on Tuesday, November 7,2000, for the purpose of electing a Mayor, two members of the Council, a City Clerk, and a City Treasurer. By consolidating the election with other jurisdictions, costs are substantially reduced. Following the election, the County invoices the City for its share of the costs. The County Elections Department has provided the City with an estimate for election-related costs, which staff has included in the Preliminary Fiscal Year 2000- 01 Budget. The Council is also requested to set the policy regarding candidates' statements. If the Council adopts the resolution regarding materials submitted to the electorate, the candidate's statement, written on a form provided by the Deputy City Clerk, will include name, age, and occupation of the candidate and a brief statement of no more than 200 words. The statement will be filed with the Deputy City Clerk at the time the candidate's nomination papers are filed. Finally, the Council is requested to adopt a resolution providing for the conduct of a Special Runoff Election for elective offices in the event two or more persons receive an equal number and the highest number of votes for an office to be voted for within the City. Alternatives The following alternatives are provided for the Council's consideration: - Approve staff's recommendations; - Do not approve staff's recommendations; or - Provide direction to staff. DISCUSSION: The components of Phase II of the Scenic Creekside Walk Through the Historic Village of Arroyo Grande project were based on the Council's priorities developed at its October 26, 1999 regular meeting. The design was developed through meetings with the Public Works and Parks Departments, the Arroyo Grande Village Improvement Association, the South County Historical Society, and the Consultant. Phase" consists of the construction of a bluff top walk and overlook along the south bank of Arroyo Grande Creek between Mason Street and Short Street. Phase" also includes the reconstruction of the lower portion of the stairway on the north side of the creek near the swinging bridge. The contract time for this project has been estimated at 60 calendar days. Work is expected to begin in August and be completed in late October as shown in the attached project schedule. FUNDING: There is no immediate fiscal impact. Maintenance of these facilities will be funded from Public Works maintenance funds in future years. DISCUSSION: , The Le Point Street Addition project included the construction of several homes as well as improvement of the public right of way and installation of utilities. A Security Agreement for the improvements was approved by the City Council on July 11, 1989. A letter of credit (Irrevocable Letter of Credit # 7-136) was provided in the amount of $75,000 (150% of improvement cost for the completion of these improvements). The public improvements covered under the Security Agreement include the following: . Road widening, curb and gutter and sidewalk on Le Point Street and Highway227. . Sewer main in Highway 227 and Paseo Street. . Fire hydrant on Highway 227. The construction of the improvements was completed in early 1990 but have yet to be accepted by the City. Acceptance requires that a formal request be submitted by the developer upon completion of the improvements. Based on the recent request by Stanley Bell (Developer) for acceptance, staff is recommending that the improvements be accepted and maintained by the City and that the letter of credit be released. MEMORANDUM TO: CITY COUNCIL ~ FROM: RICK TerBORCH, CHIEF OF POLlC SUBJECT: ADOPT CONTRACT WITH THE COUNTY OF SAN LUIS OBISPO FOR ANIMAL CONTROL SERVICES DATE: JUNE 13, 2000 RECOMMENDA TION: It is recommended that the City Council approve the contract for animal control services with the County of San Luis Obispo. FUNDING: The cost for animal control services for FY 2000-01 will be $34,100. Funding for this amount has been included in the Preliminary FY 2000-01 Budget. DISCUSSION: The City currently contracts for animal control services with the County of San Luis Obispo. The animal control program is administered by the Sheriff's Department. The current cost to the City of Arroyo Grande for the program is $31,000. The Sheriff's Department has informed staff that it will be increasing the contract rate by 10% for FY 2000-01 and by 5% per year for each of the two (2) fiscal years thereafter. This will be the first increase in contract rates in three (3) years. Given this, in reality, the costs for the contract will average 3.33% per year for the six year period, including the three (3) years with no increases. Currently, the County Animal Control Services program is the only such program available to the City. The quality of the services provided since the Sheriff's Department has taken over the program has been good. Staff has, in the past, examined options for providing animal control services. . These options included starting a program run by the City or developing a program in partnership with surrounding communities. It was found that these options, excluding start-up costs, would cost significantly more than the cost of the contract services provided by the County. Based on projected costs two years ago, a City run operation would cost over $120,000 per year and the cost for a joint partnership with surrounding communities would cost a minimum of $55,000 per year. Attachment: Agreement for Animal Control Services ~--- SAN LUIS OBISPO COUNTY SHERIFF'S DEPARTMENT ANIMAL SERVICES DIVISION AGREEMENT FOR ANIMAL CONTROL SERVICES This Agreement is made and entered into on July 1,2000, by and between the County of San Luis Obispo, hereinafter referred to as "County," and the City of Arroyo Grande, hereinafter referred to as "City," and shall be and remain in effect through and including June 30, 2003, unless sooner terminated as herein provided. WITNESSETH: . THAT WHEREAS, The City is desirous of contracting with the County for performance of the hereinafter described animal control services within its boundaries by the County of San Luis Obispo through the Division of Animal Services; and WHEREAS, the County is agreeable to providing such services in accordance with the provisions of the San Luis Obispo County Code Title 9, which provides for the licensing of dogs, the establishment of a public pound, and for the collection and care of stray, diseased and vicious animals; and WHEREAS, the County of San Luis Obispo has established Animal Services to enforce the ordinances of the County Code Title 9 within the unincorporated areas of the County; and WHEREAS, the City is desirous of contracting for said Animal Control services. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: Page 1 of 12 -----_._...._~-_.~-_.- DEFINITIONS - Used throughout as follows: Aggressive means a dog attacking a human (not dog to dog or dog to livestock) and the human is in immediate danger of being injured. Household/Domestic Pets or Small Animals means but is not limited to cats, dogs, canaries, fish, hamsters, rabbits, turtles, reptiles and other kindred animals usually and ordinarily kept as household pets. Injured domestic animal means life-threatening (not an abscess or other non emergent condition) to the animal requiring intervention by a veterinarian. Livestock or Large Animals means horses, ponies, mules, cattle, goats, swine and all other domestic or domesticated animals other than household pets. Small Wildlife means racoons, possums, foxes and other similar sized wildlife. COUNTY RESPONSIBILITIES: Maintain an Animal Services Division - to provide management and supervision of programs, to maintain records and statistics, and enforce laws and ordinances. Animal Shelter - maintain, or cause to maintain an animal shelter to provide for the care, housing, and disposal of animals impounded within the City or County or delivered by City or County residents. Operation Permit Services - to provide permit services to all citizens of the County regardless of jurisdiction. Humane Education - to provide humane education regarding responsible pet ownership, advantages of spay/neuter, rabies control information, regardless of jurisdiction. Performance Standards - County will provide measurable standards to contracting City related to licensing, services from the field, outcomes, and category of contacts. DESCRIPTION OF SERVICES: 1. SHELTER PROVISIONS/ANIMAL DISPOSAL The availability of a shelter to provide care for stray animals transported by citizens from the City incorporated boundaries. This shall include the administration necessary for surrender of animals at the shelter, the care of animals during the five (5) day holding period, and final disposal of animals through redemption, adoption, or destruction. a) The receipt of household pets delivered to the shelter or at drop-off kennels. b) Sheltering of household pets received at the shelter in accordance with state regulations, local ordinances, and policies governing humane treatment of such animals. ANIMAL BITE INVESTIGA TIONS/OUARANTINES The taking of animal bite reports and subsequent investigations and quarantine of bite animals. Investigation of all animal bites involving humans and tbe quarantine of biting animals pursuant to state regulations and local ordinances. The keeping of such records and reporting ofinformation to the State Department of Health Services. 3. RABIES CONTROL/SUSPECT RABID ANIMAL HANDLINGffESTING The response to and attempted capture of suspect rabid wildlife and domestic animals. The destruction of such animals, proper laboratory preparation for rabies testing, transport of tissue to the County Public Health Department for testing, and proper disposal of remains when found to be positive. Investigations of exposures to rabid animals or suspect rabid animals at large and the quarantine or destruction of animals which were in contact with rabid animals. 4. EMERGENCY SERVICES The response to and attempted capture of injured domestic animals, transport of and medical aid to animals when needed for stabilization and subsequent sheltering of animals. Response to potentially rabid wildlife and domestic pets when someone is on the scene. Response to aggressive animals or animals that have bitten and the owner is not available. Hold animals relative to an arrest or accident. Emergency services shall be provided 24 hours a day, seven days a week. Page 4 of 12 -_..~.__.-._-~_..__._-----~-"-_.._- Emergency and after hour services for any of the following: a) Severely injured/sick dogs or cats when legal owner unknown or unavailable. b) Hold animals relative to an arrest or accident. c) Aggressive/vicious dogs when legal owner unknown or unavailable and reporting party is standing by. d) Bite dogs/cats when legal owners are unknown or unavailable and reporting party is standing by. e) Potentially rabid animals including wildlife when reporting party remains on the scene. 5. PICK UP OF UNLIMITED STRAY. DOMESTIC ANIMALS FROM ONE DESIGNATED LOCATION The pick up of UNLIMITED numbers of stray, domestic animals from one designated location within the contracting City. The City will be responsible for providing food, water, and the cleaning of designated kennels. 6. FIELD PICK UP OF UNLIMITED DOMESTIC ANIMALS \ The response to and pick up of UNLIMITED numbers of stray, confined, domestic animals. The transport and care of impounded animals at the shelter as described above. Pick up shall include dogs, cats, other domestic animals during normal hours of operation, including domestic animals dead on arrival. Page 5 of 12 --~--_.._._.- FIELD SERVICES - defined as follows: Response of an Animal Control Officer during regular business hours to pick up any of the following within city limits on an UNLIMITED basis: 1) Confined stray domestic animal pick-up 2) Dead stray domestic animal pick-up 3) Owned animal pick-up (fee paid by citizen) 4) Owned dead animal pick up (fee paid by citizen) 5) Euthanasia of owned animals (fee paid by citizen) 6) Transportation to veterinarian of owned animal (fee paid by citizen) 7) Respond to the humane care of injured/sick stray domestic animals by Good Samaritans. Medical treatment and emergency veterinary care for stray domestic animals presented to veterinarians by Animal Services employees and Good Samaritans. 7. CITIZEN COMPLAINTS The processing of citizen complaints, response to complaints, maintaining cumulative records, and action taken on complaints including, but not limited to: barking dogs, leash law violations, animal abandonment, and animal cruelty. NUISANCE ABATEMENT /HEARING & COURT PROCEEDINGS The recording, filing, investigation, office hearings, issuance of orders to abate, and processing to court of nuisance abatements through City Attorneys' offices. All activities involved in the processing of nuisance abatement petitions, investigations, orders, hearings, including preparation for court proceedings when necessary. 9. FIELD ENFORCEMENT Processing and performing patrols within a specified area when requested by a citizen and issuance of citations for violations. The addition of further field enforcement other than field pick-up as described above, but not limited to: random patrol, patrol requests, ordinance violation citations, and agency assists. 10. COURT FILINGS & PROCEEDINGS Filing aggressive, cruelty, or abandonment cases to court with approval of City Attorneys' office. Collection of incident reports, photographs, etc. Court appearances and follow up related to these cases. ANIMAL SERVICES CONTRACT ENFORCEMENT COMMITTEE - There shall be an Animal Services Contract Enforcement Committee whose responsibility it will be to review and recommend on all matters of Division policy regarding overall program administration, level and quality of service, budget, and ordinance development and amendments. This Committee shall be made up of: one representative from each City contracting with the County, one representative from the County's Veterinarians' Association, one representative ofthe Highway Patrol, one representative from Animal Services, and one representative from the County Sheriffs Department. The Committee shall receive staff support from Animal Services. Page 7 of 12 COOPERATION - To facilitate the performance of the foregoing functions, it is hereby agreed that the County shall have the full cooperation and assistance from the City, its officers, agents, and employees. EMPLOYEE COMPENSATION AND LIABILITY - City shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other compensation to any County personnel performing services hereunder, or any liability other than that provided in the Agreement. The City shall not be liable for compensation or indemnity to any County employee for injury or sickness arising out of his/her employment. INDEMNIFICATION - Nothing in the provisions of the Agreement is intended to create duties or obligations to, or rights in third parties not party to this contract, or affect the legal liability of either party to contract, by imposing any standard of care respecting the regulation and enforcement oflaws regarding animals different from the standard of care imposed by law. It is understood and agreed that neither City, nor any officer or employee thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by the County under or in connection with any work, authority or jurisdiction delegated to the County under this Agreement. It is also understood and agreed that pursuant to Government Code 895.4, County shall defend, indemnify and save harmless the City, all officers and employees from all claims, suits or acti'ons of every name, kind and description brought forth or on account of injuries to or death of any person or damage to property resulting from anything done or omitted to be done by the County under or in connection with any work, authority or jurisdiction delegated to the County under this Agreement except as otherwise provided by Statute. It is understood and agreed that neither County nor any officer or employee thereof, is responsible for any damage or liability occurring by reason of anything done or omitted to be done by the City under or in connection with any work, authority or jurisdiction delegated to the City under this Agreement. It is also understood and agreed that pursuant to Government Code Section 895.4, City Page 8 of 12 --~--~--._--~.~ -, .. shall defend, indemnify and save harmless the County, all officers and employees from all claims, suits or actions of every name, kind and description brought forth on account of injuries to or death of any person or damage to property resulting from anything done or omitted to be done by City under connection with any work, authority or jurisdiction delegated to the City under this Agreem~nt except as otherwise provided by Statute. EMPLOYEE STATUS - All persons employed in the performance of the services and functions specified in "Indemnification" paragraph 2 of this Agreement shall be County employees; no present City employee shall become a County employee by reason of this Agreement; and no person employed hereunder shall have any City pension, Civil Service, or any similar status or right. For this Agreement, and for the sole purpose of giving legal status to the performance of the duties and responsibilities herein, every County officer and the employee engaged in their performance of any service hereunder shall, where necessary, be deemed an officer or employee of City while performing the services for City. PROSECUTION - It shall be the duty of the City Attorney, exercising the discretion vested in his office, to prosecute violations of the City Animal Ordinance, and take appropriate legal action with respect to the abatement of any public nuisance involving animals occurring within City's corporate limits. TERM AND RENEWAL - This Agreement shall be effective on the 1 st day of July 2000, and shall be subject to termination by either party upon thirty days advance written notice to the other party. Assuming neither party exercises its right to terminate this Agreement, the Agreement shall terminate on June 30,2003. CITY NOTIFICATION - no later than May 1st of each year, each City shall be notified of proposed changes to current service level charges. The City shall notify the County no later than July 1 st of their agreement to pay for services. Attachment A reflects the annual costs. CITY RESPONSIBILITY - City agrees to pay to Coun~ for County Services under this contract the dollar amount as set forth in Attachment A which is attached to the contract and incorporated by reference. Page 9 of 12 _'__'___.n._______ . COUNTY BILLING - County shall bill City quarterly for their contracted services. Billing shall be submitted at the end of each quarter. City shall remit payment within thirty days of receipt of billing. MODIFICATION - This contract constitutes the entire understanding of the parties hereto and no changes, amendments or alterations shall be effective unless in writing and signed by both parties. ORDINANCE CONFORMITY - City agrees to adopt animal control ordinances which conform to and are not in substantial conflict with Chapter 9 ofthe San Luis Obispo County Code. Changes and modifications to City codes may be conducted with the County Division of Animal Service's consultation before adoption. County Division of Animal Services may also make recommendations to City for changes or modifications to their City ordinance. BOOKS AND RECORDS - County agrees to keep such books and records and in such form and manner as County Auditor-Controller shall specify. Said books shall be open for examination by City at all reasonable times. NOTICES - Any notice required to be given pursuant to the terms and provisions of this agreement shall be sent by certified or registered mail to the County at: San Luis Obispo Sheriff's Department Animal Services Division P.O. FUNDING: None. DISCUSSION: On March 27, 1990, the City Council enacted Resolution No. 2381 establishing permitted parking zones within the City of Arroyo Grande (see Attachment "A"). It was intended that the Chief of Police administer the permit parking program. The resolution stated the Chief of Police is to "provide and install sufficient signs and/or markings to indicate sa'id No Parking Except by City Permit zones." However, the Resolution did not specifically address the authority of the Chief of Police to establish policies and procedures for the implementation and enforcement of restricted parking zones in that it was implied the Chief of Police had such authority under State law. Recently, parking citations which were issued in a restricted parking zone on Arroyo Avenue were challenged in court. While Traffic Commissioner Sefton upheld the citations, he opined that the City Council, in passing Resolution No. 2381, had not specifically given the Chief of Police the authority to administer and enforce provisions regarding restricted parking zones. FUNDING: City Council action on this matter will have no fiscal impact. DISCUSSION: Title 5, Chapter 10 of the Arroyo Grande Municipal Code sets out specific requirements for the application and operation of taxicab companies within the City limits of Arroyo Grande. Taxicab companies must obtain a Certificate of Public Convenience and Necessity from the City in order to commence operations. As part of the process, the City Council must conduct an advertised public hearing and determine if there is a public need or demand for additional taxicab service in the City. Currently, Central Coast Taxicab Services is the only taxicab service operating within the City with a Certificate of Public Convenience and Necessity, and serves as the provider for the City's Senior Dial-a-Ride Taxi Program. A proposal to operate a taxicab service in the City has been made by Jeff Goldenberg of Beach Cities Cab Company. Mr. Goldenberg has also submitted applications to the cities of Grover Beach and Pismo Beach for Certificates of Public Convenience and Necessity, which are currently in process. Beach Cities Cab Company is proposing to operate three Crown Victoria vehicles with a yellow color scheme and white lettering. The vehicles will be 1993 models or newer, with a passenger seating capacity of 4. Should the Council approve Mr. Goldenberg's application, his vehicles shall be examined and inspected by the Police Department; he shall supply evidence of the required insurance; obtain a business license; as well as obtain taxi driver permits from the Police Department for aU drivers prior to the issuance of the Certificate of Public Convenience and Necessity. Late Charge. Any taxicab not returned to appropriate location within 1/2 hour of the termination of a shift, shall insure a charge for an additional shift, Advance waivers of said late charge may be obtained on reasonable grounds and notice. . 6, Maintenance of Vehicle, Lessor shall maintain the leased taxi cab, its radio, meter and other equipment at its expense, save and except maintenance and repairs caused by the abusive, negligent or unlawful operation of Lessee. Lessee shall be responsible for the exterior and interior cleaning of each vehicle and shall be responsible for the exterior and interior cleaning of each vehicle and shall advise Lessor at the commencement of each shift if the vehicle is in need of water, oil or battery fluid. Any other mechanical deficiencies of the vehicle shall be reported by Lessee to Lessor upon their discovery, 7. Obedience to LAW. Lessee agrees to operate the taxicab in accordance with all applicable laws, including but not limited to, the laws of the cities of San Luis Obispo, Five Cities area and the state of California, Lessee is aware that the cities of San Luis Obispo, and the Five Cities areas have adopted ordinances which regulate the fares(including discounts for senior citizens and others) which may be charged within their jurisdictions, and that the taxi meters are set with for those fares. Said ordinances of the various public entities include requirements for dress codes, wearing of identifying badges or hats, observation of vehicular rules and other similar requirements. Said requirements are imposed by ordinances are not the requirements of Lessor, 8. Fuel. lessee shall obtain and pay for all gasoline used in the leased taxicab during each shift together with any cleaning expense incurred. Lessor may have gasoline available at reduced rates, but Lessee is under no obligation to purchase gasoline from Lessor. (a) Gasoline Deposit. Upon commencement of the lease, Lessee shall deposit and maintain a gasoline under fill deposit of Thirty Dollars ($30) against under filling of the vehicle at the end of any shift, If Lessee determines upon obtaining the vehicle that it has been underfilled, Lessee must report the underfilling to the Lessor within 15minutes of the commencement of a shift, fill the vehicle and bring the gasoline receipt to the office for reimbursement from the deposit of the previous Lessee. (b) Cleaning Materials, Lessor may, but is not obligated to provide cleaning equipment and materials at its principal place of business for use by Lessee without charge. 9. Licenses-Permits. Lessee shall either purchase or reimburse Lessor for the costs of aU licenses, medallions, or similar permits required for the operation of the taxicab, Obtaining such permits and qualifying by skill, driving record, and other requirements for taxicab drivers is the sole responsibility of lessee, lessor shall pay all fees associated with the vehicle such as license fees to the state of California. lessee shall pay for all parking tickets and moving violations fines or citations incurred by Lessee during the course of his/her use of the vehicle under this agreement. 10, Insurance, Lessor shall provide liability insurance for the vehicle for property damage and personal injury in accordance for the vehicle for property damage and personal injury in accordance with the requirements of the ordinances of the County of San Luis Obispo and the various cities in which the taxicab will operate. lessee is responsible for unintentional collision damage which is caused by Lessee negligence in whole or in part. Nature of Relationship. The parties agree that the relationship established by this lease is that of the Lessor/Lessee with Lessee serving as an independent contractor and not an employee. Lessee further understands that as an independent contractor, Lessor will not be making deductions for federal or state taxes SDI, or Medicare and will not be making contributions for unemployment insurance or similar items which would be required if Lessee were an employee. Similarly, Lessor may not provide workers' compensation benefits to Lessee. a, Separate Business, Lessee, by leasing this taxicab, is establishing a separate business for which Lessee may make any independent effort to generate business, including but not limited to, independent advertising such as business cards, flyers, distribution of a cellular telephone number or pager number. The name, Beach Cities Cab Co, (BCCC), which is adbaoflessor is on the vehicle because of requirements of public entities, but the vehicle shall have printed upon it "Leased to Driver" and lessee is free to put up further indicia of his independent status within the vehicle to generate his private business, and to place his or her name and cellular telephone number on a magnetic sign immediately adjacent to the designation "Leased to Driver". As part of the consideration furnished in this lease, Lessor maintains a dispatching office and will refer calls on a non-discriminatory basis to all lessees. Lessee is not required to take any referral from the dispatcher and may accept or reject any referral as it deems fit. Lessee should advise the dispatcher any referral as it deems fit. Lessee should advise the dispatcher of Lessee's desire to either receive or not receive referrals. Lessor does not commit to furnishing any particular level of business. b, Use of Vehicle. ONLY Lessee is authorized to drive the taxicab pursuant to this lease, but save and except for that limitation, Lessee is free to use the taxicab for any LEGAL purpose, private or business, during the period of the lease which is consistent with the use of the vehicle as a passenger car. Lessee may schedule meal or other breaks as Lessee sees fit without notice to Lessor. c, Form of payment. Lessee may accept any form of payment for fares which is acceptable to Lessor for convenience, has extended credit to various entities which may use such credit for taxicab services. Lessee accepts liability for all risk of loss from payments other than cash. If Lessee elects to accept a referral to such an entity, Lessor will reimburse lessee for any charge amounts accepted from an approved entity. Lessor does not require any reports of fares received, passengers carried, or any other information about Lessee's activities during a shift, concerning alleged mechanical defects. Lessee is solely responsible for furnishing financial information to the appropriate taxing authorities. d. Dress Code, Lessor does not have a dress code, but references is made to paragraph 7. above concerning requirements of various ordinances. e. Driving Record, Lessee acknowledges that driving a taxicab requires a good driving record with the Department of Motor Vehicles of the State of California for Lessee to obtain the necessary permits from the public entities required. 12. lessor's Business. lessor's primary business is the leasing of taxicabs. Lessor also has intent to of other business including an air porter service and a taxicab service which utilizes up to three employee taxi drivers on any shift so that coverage of all calls, including those referral calls declined by lessees, can be met in accordance with the franchise requirements of the various public entities, 13. Termination. This lease can be terminated by lessor only for cause or by Lessor or lessee on 30 days written notice of intent not to renew the lease. If Lessee fails to give 30 day written notice of intent to terminate this lease, the parties agree that Lessors damages will be extremely difficult to calculate and on that basis agree that liquidated damages for failure to give such notice shall be the sum of $200. Failure to abide by the laws of any governmental entity having jurisdiction over taxicabs or their component parts (e.g. FCC radio regulations) shall constitute cause for termination of this lease. If Lessees driving record precludes Lessor from continuing or obtaining liability insurance as provided herein above, that shall be cause for termination, 14, Use of Alcohol-Controlled Substances. License ~ No certificate of public convenience and necessity shall be issued or continued in operation unless the holder' thereof has paid an aJU1Ual license tax as set forth in Section 3- 1.419 of Articie 4 of O1apter 1 of Title 3 of this Code. Such license tax shall be for the calendar year and shall be in .addition to any other license feeS or charges established by proper authority and applicable to such holder of the vehicles under his operation and control; provided, however, whenever any vehicle is placed in service after the begirming of the calendar year, the tax for such vehicle shall be prorated on 'a monthly basis. All taxicaoo operated by the holder of such a certificate shall be painted and marked in accordance with the statement currently on file with the City Oerk. No holder of a certificate shall file' any statement of colors, markings, or insignia which is the same as, or similar to, the colors, markings, or insignia then currently on file by any other holder of a certificate. Each taxicab shall, in plain view on the exterior thereof, have the business name and address of the owner painted in letters at least one-half (1/211) inch high. (Sec. 1, Ord. 91 C.S., eff. Prior to the use and operation of any vehicle ptn'SUant to the provisions of this O1apter, such vehicle shall be thoroughly examined and inspected by the Police Department and found to comply with all of the laws of the State and the City and with such reosonable rules and regulations for safety as may be prescribed by the OIief of Police or by the Council. Every vehicle operating pursuant to the provisions of this O1apter shall be periodically inspected by the Police Department every six (6) mmths to insure the continued maintenance of safe operating conditions. A fee, as established by resolution of the City Council, for each inspection shall be paid to the City. In addition, every vehicle operating pursuant to the provisions of this chapter shall be kept in a clean and sanitary condition. (Sec. 1, Ord. 91 C.S., eff. No driver of any taxicab shall solicit business for any hotel or rootel or attempt to divert patronage from one hotel or rootel to another. Any holder who shall refuse to accept a call anywhere in the Qty at any time when such holder has available taxicabs, or who shall fail or refuse to give overall service, shall be deemed a violator of the provisions of this O1apter, and the certificate granted shall be revoked at the discretion of the Council. (Sec. 1, Ord. 91 C.S., eff. September 13, 1973) ~ 5-10.08. Qperating regulations: Direct routes. (a) Any driver employed to transport passengers to a definite point shall take the roost direct route possible which will carry his passenger to his destination safely and expeditiously. (b) No driver of any licensed taxicab shall refuse any person prompt taxicab service in the Qty at any tinie while such taxicab is' on the public streets ready for service, unless such taxicab is already engaged in the carrying of one or m:>re passengers or is enroute to answer a call for taxicab service; provided, further, nothing in this. Subsection shall require any owner or driver to furni?h taxicab service to any person under the influence of intoxicating liquor or narcotics or to, any person who is insane or who is a known criminal. (c) Every driver, upon request, shall give a correct receipt for the aroount of payment received. (g) Every driver shall at all times display his driver's permit and picture in a conspicuous place in the taxicab which he is operating. (h) Any violation of the provisions of this Section shall be ca1.5e for the revocation of the pennit of the driver guilty of such violation. (Sec. I, Ord. 91 c.s., eff. September 13, 1973) ~ 5-10.09. Taxicab drivers: pennits. (a) No person shall drive or operate any taxicab in the Cty without havirg first obtained a pennit in'writirg to do so fran the QUef of Police or any person designated by' him. Such pennit issued will entitle the driver to work only for those persons whose names appear on the pennit. A new pennit will be required for each subsequent empJoyment; provided, however, no application shall be necessary other than a ratification of c~e of employment. (b) Applicants for such pennits shall file applications therefor with the Otief of Police. The application shall contain the follo~ infonnation, t~ethE!r with a fee, as established by resolution or the aty Council, and pictures of the applicant: (1) 'The name, marital status, age, ,residence, last previOl5 address, and the length of residence .at such last address and in the atyj and (2) 'The names and addresses to two (2) residents of the aty -acquainted with the applicant. Each application shall be accompanied by a certificate from a reputable physician certifyirg that in his opinion the applicant is not inflicted with any disease or infinnity which might make him an unsafe or unsatisfactory driver. (d) All applicants for drivers' permits shall be fingerprinted; and their applications will then be considered by the Chief of Police and either granted or denied within thirty (30) days.. unless, for good cause, tirre for further consideration is needed. Before any application is finally passed upon, the Police Department shall conduct an investigation of the applicant. (e) Upon the approval of an application, the Chief of Police shall issue a driver's permit to the applicant, \'fhich permit shall bear the name, address, race, and other identifying characteristics of the applicant, including the signature of the applicant:, Such permit shall be fixed in a conspicuous place in the taxicab so as to be seen from the passengers I corcparbnent. (g) W1en issued, the driver's permit shall be valid for one (1) year from the date of issuance, unless the permit has been revoked for any of the 'causes set forth in this section. The driver, in making an application for a renewal of this permit, shall follow the same procedure as set forth in making hisjher original application, except he/she shall not be fingerprinted or be required to furnish a photograph. The applicant appealed the Planning Commission's decision to the City Council. On January 25, 2000 the City Council adopted Resolution 3426 denying the appeal of the Planning Commission's denial of Conditional Use Permit No. 99-014. The applicant has submitted an amended application with the addition of a detached' carport to address parking requirements for the project. Development Code Section 9-11 .140 (Attachment 4) regulates the construction of second residential dwelling units. The purpose of these standards is to ensure that second residential dwelling units located in single-family residential districts do not adversely impact either adjacent residential parcels or the surrounding neighborhood, and are developed in a manner that protects the integrity of the residential district. Second residential dwelling units are permitted subject to approval of a CUP, per Development Code Section 9-03.050 (Attachment 5). The proposed 627 square foot second residential unit consists of a living room, kitchen, laundry room, bedroom and bathroom. The proposed unit meets all the 'requirements of Development Code Section 9-11. 1 40 for second residential Staff Report: Amended Application Conditional Use Permit No. 99-014 June 13, 2000 Page 2 dwelling units. This includes such requirements as minimum lot size (1 2,000 square feet, subject lot size is 21,189 square feet), and maximum building size (640 square feet, proposed secondary unit is 627 square feet). The proposal also meets the parking requirements of the Development Code for second residential dwelling units, which requires one covered parking space and one uncovered parking space. Section 9-11.140C.6 of the Development Code specifically states that "the one covered space may be a carport." The amended application includes plans for a 207 square foot detached carport adjacent to the proposed second residential unit. A copy of the plans for the carport is attached (Attachment 2). As part of the CUP process for second residential dwelling units, the Community Development Director is required to consider the adequacy of water, sewer, drainage, fire and emergency services, and the impact of additional dwelling units on traffic flow. In consultation with other departments, the Community Development Director has determined that this proposed second unit would not have a significant effect on the listed areas of concern. ISSUE: The original project proposal designated one covered parking space in the three- car garage of the main residence for use by the occupants of the second residential unit. The basis for the City Council's finding that the project did not comply with provisions of the Municipal Code Section 9-11. 140C.6 was that the one covered parking space proposed was located too far from the second residential unit and would not adequately serve the occupants. The applicant has amended the application to include a detached 207 square foot carport immediately adjacent to the second residential unit. The carport design includes a tile roof, stucco and fascia to match the existing features of the second residential unit. The Architectural Review Committee unanimously approved plans for the carport at its meeting of June 5, 2000. The draft minutes from that meeting are attached (Attachment 3). LA VINE CONSTRUCTION CO, AMENDED APPLICATION FOR CUP 99- 014, LOCATED AT 1237 TALLY HO ROAD Teresa McClish told the Committee that the Planning Commission had previously denied this project and that denial was upheld by the City Council. One of the findings that could not be made related to the parking requirements for the project. There was one covered and one uncovered space required. The covered space was located in the garage of the main residence and was for use by the occupants of the second residential unit. The applicant has now amended the application to include a carport to address the covered parking space. The carport is adjacent to the second residential unit and has architectural features to match. The Development Code specifically says that for a second residential unit the covered space may be a carport. Warren Hoaa said there is already and asphalt drive up to an open area right next to the house, so it is basically just putting a roof over this area: He said it was a better idea to have this separate carport for the second home on the site, rather than to use space in an enclosed garage, in another structure, especially if the occupants of both houses are not members of the same, family. The carport looks like the same design as the house and it is not located in an obtrusive part of the site. Chuck Fellows asked if there were any potential grounds for not supporting this proposal the way it is now? Warren Hoaa said he could not think of a single reason not to approve this. Joe Tavlor asked it there could be any lateral problems with this? He said he could not see any bracing on the plans. Warren' Hoaa said that the Building Department would take care of this. Chet Kielan made a motion, seconded by Chuck Fellows to approve the carport as proposed. Section 9-11.14,0 Second Residential Dwelling Units A. B. Applicability 1. Second residential dwelling units may be permitted in any single family district except the RE District, subject to obtaining a Conditional Use Permit pursuant to Section 9-03.050 of this Title and as otherwise provided in this Section. Second residential units are prohibited in the RE District since it is an area of the City that is not served by the City water or sewer systems but by individual wells and septic systems. Second residential dwelling units shall be prohibited on lots containing a guest house, converted garage, mobile home, or more than one existing single family dwelling. An -attached second residential dwelling unit,. shall mean a dwelling unit that is either combined within the living area or attached to the primary residence. For the purposes of this Section, "dwelling unit,. shad not inctude a garage or any accessory structure. "Primary residence" shaft mean an existing detached residential structure that conforms' with all applicable zoning regulations. 3. A second residential dwelling unit may be constructed simultaneously with ' or after construction of the principal residence. In addition, an existing principal residence may, with the approval of the Community Development Director, be considered the second residential dwelling unit, and a new residence may be constructed which woutd then be considered the primary residence. C. Property Development Standards The second residential dwelling unit shall comply with all property development standards of the District in which it is located, existing building and fire codes, and architecturat review criteria, including, but not limited to, setbacks, height limits and maximum lot coverage. Purpose and Intent The purpose of this Section is to ensure that self-storage warehouse operations, commonly known as "mini-warehouses," do not result in an adverse impact on acfJ8Cent properties by reason of parking demand, traffic generation, fire, or safety hazard, visual blight. or use indirectly supportive of illegal or criminal activity. The special conditions COI dained in this Section are intended to serve to differentiate self-service storage warehousing uses from more intensive wholesale or general warehousing uses, especially in regard to the diftering parking requirements for these uses. B. Applicability All self-storage warehouses shall comply with the property development standards for the . District in which it is to be located and with the special standards listed below. The provisions of this Section shall apply to all new self-storage warehouse uses and to all existing facilities at such a time as the storage area of the existing business is expanded. C. LaVine I am a resident of the "Cul-de-sac" that Mr. LaVine claims as his, off Tally Ho. His new construction is certainly a fine design, improving the neighborhood, but under the oricinal rules of develooment, only one primary residence is allowed per lot. The smaller guest unit is designed for occasional occupancy only. If the City again allows Mr. LaVine to do as he pleases, without regard for the rules.. a precedent will be set.. that will allow a multitude of "Conditional Use" requests. I live at 143 Tally Ho, another residence with a guest unit, originally built by Mr. LaVine. If you grant this request, then I, too, can request to have my lot rezoned, and sell my guest unit as an individual home. However, Primary residences are required to be built to current resident building codes, and these little guest units are an exception for occasional occupancy. Mr. LaVine's certainly is NOT built to primary residence code. It has only been covered to appear so. it seems that the rules should apply equally to all of us.. INCLUDING Mr. LaVine.
