The City Council met in regular adjourned meeting with Mayor de Leon
presiding. Upon roll call, Council Members Spierling, Gallagher, Schlegel and
Millis reported present.
FINDINGS RE. BADEN LOT SPLIT NO. 77-267 ON BRIGHTON
The Council reviewed the various actions and recommendations made by it and
the Planning Commission regarding the Baden Lot Sp lit, Case No. 77-267, at 1385
Brighton Avenue. A review was made of the findings in the Negative Impact Report
for said lot split. The last action by the Planning Commission was to find that
the barricading of Brighton Street (which was a condition of the appealers, the
Jacksons, for withdrawing their appeal) would not be inconsistent with the
Circulation Element of the City's General Plan. The following considerations by
the Council were then made: That said project might result in a potential impact
upon schools, sewage, and drainage problems, increased traffic generation, and
potential controversy could result therefrom, but
1) It is found that there will not be significant effect upon the school
district;
2) That the sewage problem is one that requires pumping of sewage into the
City main; and will have no significant effect un the environment;
3) While there could be potential impact relating to drainage problems
resulting from said project, no significant effect will result from said drainage
because of the mitigation measures which require the developer to provide for
~_ retention of "improvement water" on the site;
~ 4) While there might be a potential impact relating to traffic as a result
I of said project, no significant effect upon the environment will result in the area
~ of traffic generation because of the mitigation measure providing for the improvement
of Courtland Street from Brighton to Grand Avenue, and because the barricade across
Brighton Avenue required by the City will assist in decreasing traffic along Brighton
Avenue.
After Council discussion, a motion was made by Councilman Spierling, seconded
by Councilman Millis and unanimously carried, that the City Council, after an
examination of the preliminary environmental description of this project and review
of the Environmental Coordinator's recommendation, and the foregoing statement of
reasons supporting this finding, finds that this project will not have a significant
effect on the environment and that the City Council-issue its negative declaration.
STUDY OF PROJECTED WATER USE IN CITY
The Council reviewed a Water Study Report prepared by the Public Works
Department, in response to the Council's reQaeat for information regarding
potential development within the City o! Arroyo Grande unfler several zoning
conditions and the availability of water for this development.

Councilman Spierling introduced Mr. Clint Milne of the County Flood
Control Office. A great deal of discussion was held and concern indicated about
neighborhood communities pumping more from the ground water basin than they had in
past years, it was generally agreed, as recommended by Councilman.$pierling, to
have the staff investigate possible adjudication of the Arroyo Grande Ground Water
Basin. It was also suggested that the City Attorney review possible costs for such
an action. General discussion was held about the size of the basin, ground water
and the Lopez commitment. '
ADJOURNMENT
On motion of Councilman Millis, seconded by Councilman Schlegel and
unanimously carried, the meeting adjourned at 5:30 P.M.
