REGULAR MEETING OF THE CITY COUNCIL

The city Council of the City of Arroyo Grande met at 7: 30
P.M., with Mayor Mark M. Millis presiding.
l. & 2. FLAG SALUTE AND INV09ATION
Mayor Millis led the Pledge of Allegiance to our Flag, and the
Rev. Ken Lockwood of Seventh Day Adventist Church of Arroyo Grande
delivered the invocation.

5.A. Proclamation, "Arbor Day," March 21, 1992. Mr. Keisler -J
accepted the proclamation and invited the Council and public to a
tree planting on Arbor Day at Bennett Street and Halcyon Road, and
to an Oak Tree Workshop on March 27.
5.B. proclamation, "75th Birthday of the San Luis Obispo County
Chapter of the American Red Cross." Jeannie Nix, director of the
San Luis Obispo County Chapter of the Red Cross, accepted the
proclamation and invited the Council and public to an anniversary
celebration from 4 to 6 P.M. March 11.
5.C. proclamation, "camp Fire Birthday Week," March 15 - 21, 1992.
Mrs. Susie Miner, Beth Miner and Kerri Reynolds accepted the
proclamation.

It was moved by Dougall/Smith, and the motion passed to
approve Cash Disbursements in the amount of $261,029.91, as listed
in the March 5, 1992 Staff Report of the Finance Director.
7.Ao PUBLIC HEARINQ - INTENTION TO VACATE AND ABANDON A RESERVOIR
SITE EASEMENT AND A PUMP STATION EASEMENT BY THE CI~Y OF ARROYO
GRANDE. WHICH APPEARS TO BE UNNECESSARY FOR PRESENT OR PROSPECTIVE
PUBLIC USE: 313 MILLER WAY AND 206 MILLER WAY
Mr. christiansen said the City no longer needs these
I easements.
! After being assured that the Public Hearing had been duly
L- published and all legal requirements met, Mayor Millis d~clared
the hearing open and said all persons would be heard regardlng the
matter.
ROBERT FOLKERTS of 206 Miller Way, one of the owners of the
property affected by the easement abandonment, asked if the
easement property would revert to the land owners. Mr.
Christiansen said yes.
When no one further came forward to speak, Mayor Millis closed
the hearing to the floor.
It was moved by Dougall/Moots (5-0-0, Dougall, Moots,
Gallagher, Smith and Millis voting aye) to approve Resolution No.
2918 Ordering the Abandonment of a Water Reservoir Easement on Lot
14 of Tract 599, in the city of Arroyo Grande.
It was moved by Dougall/Moots (5-0-0, Dougall, Moots, smith,
Gallagher and Millis voting aye) to approve Resolution No. 2919
Order the Abandonment of a Pump station Easement on Lot 1 of Tract
577, in the city of Arroyo Grande.
7.B. PUBLIC HEARING - AMENDMENT TO THE MUNICIPAL CODE RELATING TO
INCREASES IN SEWER AND LOPEZ WATER RATES BY INCREASING CITY SEWER
CHARGES FOR SINGL~-F~MILY DWELLINGS BY 81.05 PER MONTH AND LOPEZ

Mr. Christiansen said the sewer charges had not been increased
since 1984. He said the Lopez rates are being, increased to
eliminate a fund deficit. He said costs have increased due to
cloud-seeding and rising operating capital costs.
After being assured that the Public Hearing had been duly

: HEATHER JENSEN of 569 May street said that her current water
~' bill already refers to a rate increase. The Finance Director said
that increase is the third in a series of three water rate
increases which were approved more than a year ago.

After Council questions, Mr. Christiansen read the title of
the proposed ordinance Amending the Municipal Code Relating to City
Sewer Charges by Amending Chapter 6 of Title 6, section 6-6.1001.
It was moved by Smith/Dougall, and the motion passed to dispense
with further reading of the ordinance. Mayor Millis said that
constituted the first reading of the ordinance.

Mr. Christiansen read the title of the proposed ordinance
Amending the Arroyo Grande Municipal Code Relating to Arroyo Grande
City Water and Lopez Rates by Amending Chapter 7 to Title 6,
Section 6-7.01(g), section 6-7.09 and section 6-7.16. It was moved
by smith/Dougall, and the motion passed to dispense with further
reading of the ordinance. Mayor Millis said that constituted the
first reading of the ordinance.
S.A. AGREEMENT BETWEEN THE CITIES OF ARROYO GRANDE AND GROVER CITY
REGARDING DON ROBERTS FIELD: TRACT 1769
Mayor Millis and Council Member Dougall said they may have 1
conflicts of interests in this agenda item and left the room. .
Mayor Pro Tem Moots presided.
Mr. Christiansen said the city Attorney had reviewed the
agreement, and recOmmended approval.
There were Council questions regarding scheduling and use of
the field.
It was moved by Smith/Gallagher, and the motion passed to
approve the Agreement Between the city of Grover city and the City
of Arroyo Grande Regarding Don Roberts Field.
Mayor Millis and Council Member Dougall returned to the dais.
9.A. RECYCLING BIDS: SETTING PUBLIC HEARING FOR MARCH 24. 1992
Mr. Christiansen said representatives from pismo Beach and
Arroyo Grande had joined together in a committee and had gone out
to bid for the recycling contract. He said the specifications
called for a three-year contract. He said the committee had
recommended that Ralcco be awarded the bid, and that a public
hearing be held March 24, 1992 on the matter.
There were comments and questions from the Council regarding:
1. Bid amounts by Ralcco and South County Sanitary service
2. Items which would be collected by each company
3. Collection of "green waste"
4. The current recycler's failure to achieve significant
participation in the recycling program by the business and
commercial community
5. The need for more of the city's waste to be recycled to reach
the State mandated 25 percent in 1995
6. Making it mandatory for commercial and business customers to 'I
recycle
7. Developing away to bill commercial and business customers
individually
Also speaking were STEVE ASLANDIS of Ralcco Recycling, TOM
MARTIN of South county Sanitary Service, HEATHER JENSEN of the
Arroyo Grande Chamber of Commerce and I. B. JENKINS of Pismo Beach.
It was moved by Moots/Smith, and the motion passed to set the
public hearing for awarding the recycling contract for the city
Council meeting of March 24, 1992.

It was moved by Dougall/Smith (5-0-0, Dougall, Smith,
Gallagher, Moots and Millis 'voting aye) to approve Resolution No.
2920 Establishing a "No Parking" Zone on a Portion of Oak Park
Boulevard (In Tract 1769).
10. WRtTTEN COMMUNICATIONS
None.
11. ORAL COMMUNICATIONS
JIM MC GILLIS of 238 West Branch street suggested that cans
and bottles not be accepted by the garbage collectors, and that
~, they be saved for the recyclers.
There was a discussion of San Luis Obispo County's
proposal that the entities contracting for water in the state Water
Project agree to give up the rights to their ground water supply.
12. CLOSED SE$SIOij
On the unanimously approved motion of Smith/Gallagher, the
Council adjourned at 9:00 P.M. to a Closed Session on:
(a) Personnel (Negotiations), pursuant to Government Code
section 54957.
(b) Pending Litigation, pursuant to Government Code Section
54956.9(a). Reade vs. City of Arroyo Grande; San Luis County
Superior Court Case No. 71037.
(c) Potential Litigation, pursuant to Government Code Section
54956.9(b).
13. ADJOURNMEN'f
The Council reconvened at 9:45 P.M. and immediately adjourned,
on the unanimously approved motion of Dougall/Moots.
