PC R 11-2122 � RESOLUTION NO. 11-2122 ,� � � A RESOLUTION OF THE PLANNING COMMISSION OF . THE CITY OF ARROYO GRANDE APPROVING . � TENTATIVE PARCEL MAP 11-001; LOCATED AT 1184 EAST GRAND AVENUE; APPLIED FOR BY ORRIN COCKS WHEREAS, the applicant has filed Tentative Parcel Map 11-001 to subdivide an existing 1629 square foot condominium office unit into finro offices of 740 and 890 square feet as illustrated in Attachment 1; and WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Tentative Parcel Map 11-001 at a noticed public hearing on February 15, 2011 in accordance with the Municipal Code of the City of Arroyo Grande; and � WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan, Development Code and the environmental documents associated therewith, and have determined that this project is categorically exempt �per Section 15315 of the CEQA Guidelines: and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing that the following circumstances exist: i � . The proposed Tentative Parcel Map is consistent with goals, objectives, policies, . plans, programs, intent and requirements of the Arroyo Grande General Plan, as . �well;as any applicable specific plan, and the requirements of this title. .� The proposed Tentative Par�el Map and fhe existing office use on the property is consistent with the land use elemenf of fhe Cify's General Plan spec�cally LU5 � � .whiCh states °Community commercial, o�ce, residential and other compatible land � uses shall be locafed in Mixed Use (MU) ar�as and corridors, both north and south of the fieeway, in proximity to major arterial streets." 2. The site is physically suitable for the type of development proposed. The project site is physically suitable for the division of one condominium unit into two separate condominium units. The existing lot is 1,629 square feet in ar�a and will be splif into finro lots of 740 square feet and 890 square feet respectively. The property is located within an urhanized area with major infrastructur� already in place. The properly is zoned Fair Oaks Mixed Use, which is intended to pmvide for a combination of r�tail, commercial, office and residential uses compatible with surrounding residential districts. 3. The site is physically suitable for the proposed density of development. I The project divides the existing parcel into two (21 parcels but does �ot c�eate any additional deve%pment opportunities. Project meets all applicable site � � standards fo� the Fai� Oaks Mixed Use District. The design of the parcel map will not cause substantial environmental damage nor will it injur� either fish or wildlife or their habitat, as the site is located in an unbanized area. 5. The design of the subdivision or type of improvements is not likely to cause serious � public health problems. The design of fhe subdivision will not cause any serious public health problems, as � it seeks to divide an already developed property, provides adequate vehicular and pedestrian access to each proposed unit, and meets the performance standarcls . (16.48.120) of the Arroyo Grande Municipal Code. � 6. .The design of the Tentative Parcel Map or the type of improvements will not conflict with easements acquired by the public-at-large for access through, or use of,� property within the proposed tentative parcel map or that alternate easements . � . � . for access or for use will be provided, and that these altemative easements will be � substantially equivalent to ones previously acquired by the public. � � The design of the Tentative Parcel Map has been reviewed by City staff and will � � �not conflict with any public easemenfs. Access to the projecf will be from East � . � Grand Avenue and Brisco Road, which are both public right of ways. 7. The discharge of.waste from the proposed subdivision into an existing community � � sewer system will not result in violation of existing requirements as prescribed in Division 7 (commencing with Section 13000) of the Califomia Water Code. Conditions of approval ensure that the condominium division will abide by all City . and South County Sanitation District standards relating to sewer system design. � 8. Adequate public services and facilities exist or will be provided as the result of the proposed tentative parcel map to support project development. . . The project is located within an existing development and is adjacent to all � �necessary public facilities and will not negatively affect the adequacy of those facilities.
