PC R 10-2110 RESOLUTION NO. 10-2110 I A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING THE � CITY COUNCIL ADOPT AN ORDINANCE TO AMEND THE CITY'S ZONING MAP, REZONING THE PROPERTIES LOCATED AT 188 & 194 NORTH ELM STREET FROM � SINGLE-FAMILY (SF) TO GATEWAY MIXED-USE (GMU) . AND THE PROPERTY LOCATED AT 704 BRANCH MILL ROAD FROM AGRICULTURE (AG) TO RESIDENTIAL RURAL (RR); APPLIED FOR BY THE CITY OF ARROYO GRANDE WHEREAS, the City of Arroyo Grande updated its General Plan in 2001, which included changing the land use category for two (2) properties located at 188 & 194 North Elm Street from Single-Family (SF) to Mixed-Use (MU) and one (1) property at 704 Branch Mill Road from Agriculture (AG) to Low-Density Residential (LDR); and WHEREAS, the City of Arroyo Grande has initiated a Development Code Amendment to achieve consistency between the City's General Plan and Zoning Map regarding the above properties; and -� . WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for Implementation of CEQA and has determined that the project is categorically exempt per Section 15305 of the CEQA Guidelines; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the project at a duly noticed public hearing on October 5, 2010; and . WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: � ' Development Code Amendment Findings: 1. The proposed change of zone (or revision to this title) is consistent with the goals, objectives, policies and programs of the general plan, and is necessary and desirable to implement to provisions of the general plan; The proposed change of zone is consistent with the goals, objectives, policies and programs of the General P/an and is necessary to implement the provisions of the General Plan, specifically as they relate to land use. 2. The proposed change of zone (or revision to this title) will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern; The proposed change of zone is consistent with existing and/or potential RESOLUTION NO. 10-2110 OCTOBER 5, 2010 PAGE 2 of 3 development of the subject properties and the surrounding areas; if wil/ not I adversely affect the pub/ic health, safety or welfare, nor would it result in an illogical land use pattem. 3. The proposed change of zone (or revision to this title) is consistent with the purpose and intent of the title (or the portion of this title it is amending); . The proposed change of zone is consistent with the purpose and intent of fhe title, as if provides and ensures compatibility between fhis title and the General Plan. 4. The potential environmental impacts of the proposed change of zone (or revision to this title) are insignificant, or there are overriding considerations that outweigh the potential impacts; The potential environmental impacts of the proposed change of zone were identified and addressed in fhe General Plan Update Program EIR. 5. For applications to amend this title for the purposes of rezoning property in an agricultural district to a non-agricultural district, the following additional findings of fact must be made in an affirmative manner; � Rezoning the property at 704 Branch Mill Road is necessary to be consistent with the General Plan and is consistenf wifh City Council Resolution No. 3699, which evaluated the viability of certain properties to support agricultural uses and found that this property did not warrant classificafion as an agricultural property. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby recommends the City Council adopt an ordinance to amend the City's Zoning Map, rezoning the properties at 188 & 194 North Elm Street from Single- Family (SF) to Gateway Mixed-Use (GMU) and the property located at 704 Branch Mill Road from Agriculture (AG) to Residential Rural (RR) based on the above findings. On motion by Commissioner Barneich, seconded by Commissioner Martin, and by the following roll call vote, to wit: AYES: Commissioners Barneich, Martin, Brown and Ruth .
