A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE APPROVING LOT LINE
ADJUSTMENT 10-001; LOCATED AT 366 AND 370 TALLY
HO ROAD; APPLIED FOR BY RODERICK DENHAM
WHEREAS, the applicant has applied for a lot line adjustment to move the lot line
approximately fifteen (15) feet to the northeast, transferring 1,386 square-feet from APN
007-791-030 to APN 007-791-031; and
WHEREAS, the Planning Commission has found that this project is consistent with the
City's General Plan and Development Code; and
WHEREAS, the Planning Commission has reviewed this project in compliance with the
California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo
Grande Rules and Procedures for Implementation of CEQA and has determined that the
project is categorically exempt per Section 15305 of the Guidelines; and
WHEREAS, the Planning Commission finds, after due study and deliberation, the
following circumstances exist: �
The lot line adjustment does not.
1. Create any new lots;
The lot line adjusfinent involves moving the lot line between hnro (2)
existing lots.
2. Include any lots or parcels created illegally;
Both lots were created legally as part of the Hilliker and Woodbury
subdivision.
3. Irnpair any existing access or create a need for access to any adjacent lots
or parcels;
The lot line adjustment does not affect access to either lot.
4. Impair any existing easements or create a need for any new easements
serving adjacent lots or parcels;.
The lot line adjustment does not affecf any existing easements, nor does it
create the need for any new easements.

5. Constitute poor land planning or undesirable lot configurations due to
existing environmental conditions or current zoning development
standards;
The lot line adjustment would nof substantially alter the existing lot
configuration; however, it would provide for a conforming inferior side yard
setback where none currently exists.
6. Require substantial alteration of any existing improvements or create a �
need for any new improvements;
The lot line adjustment does not impact any existing improvements, nor
does it create a need for any new improvements.
7. Create a nonconforming lot in the development district in which it exists,
except as allowed in Section 16.48.110 of this title.
Both lots involved in the lot line adjustment would continue to conform to
minimum development standards for lot size, width and depth.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves Lot Line Adjustment 10-001 with conditions of approval
as set forth in Exhibit "A", attached hereto and incorporated herein by this reference.
On motion by Commissioner Keen, seconded by Commissioner Ruth, and by the
following roll call vote, to wit:
AYES: Commissioner Keen, Ruth and Vice Chair Brown

REVISED CONDITIONS OF APPROVAL
LOT LINE ADJUSTMENT 10-001
366 AND 370 TALLY HO ROAD
This approval authorizes an adjustment of the lot line between the properties located at
366 and 370 Tally Ho Road. I
STANDARD CONDITIONS
1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Lot Line Adjustment
10-001.
3. Development shall occur in substantial conformance with the plans presented to
the Planning Commission at its meeting of June 15, 2010.
4. The applicant shall, as a condition of approval of this tentative or final map
application, defend, indemnify and hold harmless the City of Arroyo Grande, its
present or former agents, officers and employees from any claim, action, or
proceeding against the City, its past or present agents, officers, or employees to
attack, set aside, void, or annul City's approval of this subdivision, which action is
brought within the time period provided for by law. This condition is subject to
the provisions of Government Code Section 66474.9, which are incorporated by
reference herein as though set forth in full.
ENGINEERING DIVISION
GENERAL CONDITIONS:
5. The applicant shall submit all information required by Municipal Code Sections
16.20.070 and 16.20.140.
6. The applicant shall pay all applicable fees at the time they are due.
7. The Lot Line Adjustment shall be finalized by recording a Final Parcel Map or
Certificates of Compliance or a Lot Line Adjustment Map, and by subsequent
deed transfers.
8. A current�preliminary title report shall be submitted to the Director of Public
Works prior to checking the final documents.

9. The applicant shall furnish a certificate from the tax collector's office indicating
that there are no unpaid taxes or special assessments against the property.
10. A Final Parcel Map or Certificate of Compliance for Lot Line Adjustment shall be �,
recorded with all pertinent conditions of approval satisfied prior to issuing a
building permit.
