SUBJECT: CONSIDERATION OF CONFIRMATION OF ASSESSMENTS FOR
TRACTS 1 158,1769,231 0, AND 2236

RECOMMENDATION:
It is recommended the City Council:
Adopt a Resolution confirmi~g landscaping assessments for all parcels within Tract
1 158;
Adopt a Resolution confirming landscaping and lighting assessments for all parcels
within Tract 1769;
Adopt a Resolution confirming the assessments for the Parkside Assessment
District for all parcels within Tract 2310 (Parkside Village Subdivision);
Adopt a Resolution confirming the assessments for the Grace Lane Assessment
District for all parcels within Tract 2236 (Grace Lane Subdivision).
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The City entered into agreements with four assessment districts to provide lighting and
landscaping maintenance. The assessments are placed on the affected property
owner's tax roll each year. The total amount of revenue to be received from the
assessment districts in Fiscal Year 2012-13 is $56,764.
The staff time for the administration of the assessments is minimal and will be
reimbursed annually through the City's Cost Allocation plan.
BACKGROUND:
On June 9, 1992, Landscaping and Lighting Assessment District No. 1 was created to
provide landscaping and lighting improvements and maintenance for Tract 1769. The
annual assessment was $100 per parcel located within Tract 1769 (a total of $3,000).
The Tract 1769 landscaping and lighting assessment must be confirmed by the Council
each year.
On May 28, 1996, at the request of the homeowners within Tract 11 58, the City agreed
to provide landscaping and related maintenance to a portion of the greenbelt and
appurtenances located on Oak Park Boulevard for the benefit of parcels located within

Tract 1158. The City Council and parcel owners agreed to an annual $40 per parcel
City charge (for a total of $2,800) for this service.
On November 8, 2005, at the request of Parkside Village LLC, the sole owner and
developer of the Parkside Village Subdivision (Tract 2310), the City Council approved
the formation of the Parkside Village Assessment District. At the June 12, 2012
meeting, staff presented a Supplement to the Engineer's Report to reduce the
assessment for the Parkside Village Assessment District. Based on concerns
presented b the property owners, the Council continued consideration of the item to
t ! the June 26 meeting. A meeting was held with the property owners on June 18'" The
recommended assessments for FY 2012-1 3 include the proposed revised amounts for
the Parkside Village Assessment District. The revised annual assessments vary from
$414 to $682 per parcel for a total of $40,846 annually. This is a decrease of $17,836
from the prior year.
On November 28, 2006, at the request of Vista Roble LLC, the sole owner of the Grace
Lane Subdivision (Tract 2236), the City Council approved the formation of the Grace
Lane Assessment District. This assessment is also adjusted annually by the April
Consumer Price Index (CPI) or 1.5% in 2012. The annual assessment ranges from
$498 to $662 per parcel for a total annual assessment of $10,118. This is an increase
of $130 above the prior year.
ANALYSIS OF ISSUES:
All of the listed assessments must be confirmed each year. The assessments will be
added to the tax roll of the affected property owners and collected by the San Luis
Obispo County Tax Collector.
ALTERNATIVES:
The following alternatives are presented for the City Council's consideration:
- Approve staff recommendations;
- Include assessments for Parkside Village Assessment District based on the
original Engineer's Report, which would be $626 for properties in Zone A and
$988 for properties in Zone B.
- Do not approve staff recommendations;
- Modify staff recommendations and approve;
- Provide direction to staff.
ADVANTAGES:
By confirming the assessments, the City will continue to receive the funding to maintain
the landscape districts.
DISADVANTAGES:
There is no disadvantage identified in this recommendation.

OF ARROYO GRANDE CONFIRMING A LANDSCAPING
ASSESSMENT FOR TRACT 1158
WHEREAS, on May 28, 1996, the Arroyo Grande City Council approved an
Amendment to Covenants, Conditions, and Restrictions for Tract 11 58 (Oak Park Villas)
whereby the City of Arroyo Grande agreed to provide certain specified landscaping and
related maintenance on real property located along Oak Park Boulevard adjacent to
Tract 1158, Arroyo Grande, California, which maintenance was previously provided by
the homeowners in Tract 1 1 58 and administered by the Oak Park Villas Homeowners
Association; and
WHEREAS, the owners of Lots 1 through 70, Tract 1158, agreed to pay an annual
assessment of $40 per parcel, in exchange for the City's agreement to provide said
maintenance services.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo
Grande as follows:
1. That the above recitals are true and correct and incorporated herein.
2. That the assessment for the 2012-13 fiscal year shown on Exhibit "A", attached
hereto and incorporated herein by this reference, are confirmed as true and correct.
3. Immediately after adoption, a certified copy of this Resolution shall be filed with the
County Auditor.
4. The assessment shall be collected at the same time and in the same mariner as
County taxes are collected, and all laws providing for the collection and enforcement
of County taxes shall apply to the collection and enforcement of the assessments.
After collection by the County, the remaining amount of the assessments, after
deducting compensation due the County for collection, shall be paid to the City.

WHEREAS, on June 9, 1992, the City Council of the City of Arroyo Grande ordered the

Tract 1769, containing 30 single-family home sites located at Farroll Avenue and Oak
Park Boulevard; and
WHEREAS, it is the intention of the City Council of the City of Arroyo Grande to levy
assessments totaling $3,000 ($100 per assessable parcel) for Landscaping and Lighting
Assessment District No. 1 for the Fiscal Year 2012-1 3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo
Grande as follows:
1. That the above recitals are true and correct and incorporated herein.

ASSESSMENT DISTRICT (TRACT 2310)
WHEREAS, the owner (Parkside Village, LLC) of Lots 1 through 67, Tract 2310,
requested the City form a maintenance assessment district, commonly referred to as
the Parkside Village Assessment District to provide means to finance the costs of
maintenance, operation, and service of certain specified improvements; and
WHEREAS, on November 8, 2005, the Arroyo Grande City Council adopted Resolution
No. 3888 ordering the formation of the Parkside Village Assessment District, confirming
assessments, assessment district diagram, and approving the levying of assessments
for Tract 231 0 (Parkside Village); and
WHEREAS, assessments for the Parkside Village Assessment District must be
confirmed by the City Council for each fiscal year.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo
Grande as follows:
1. That the above recitals are true and correct and incorporated herein.
2. That the assessment for the 2012-13 fiscal year shown on Exhibit "A, attached
hereto and incorporated herein by this reference, are confirmed as true and correct.
3. Assessments shall be adjusted annually by modifying the adopted value up or down
in conformance with the Consumer Price lndex for the Los Angeles region. The
factor for the adjustment of the assessments shall be calculated using the April index
and established by the Director of Administrative Services, utilizing the following
formula:
