Amend Agreement for Inspection ServicesMEMORANDUM TO: CITYCOUNCIL FROM: TERESA MCCI,ISH, COMMUNITY DEVELOPMENT DIRECTOR BY: MIKE LINN, ASSISTANT CITY ENGINEER rlCI SUBJECT: CONSIDERATION OF A FIRST AMENDMENT TO AGREEMENT WITH TERRY PARIS INSPECTION SERVICES FOR CAPITAL PROJECT AND DEVELOPMENT INSPECTION SERVICES DATE: OCTOBER 9,2012 RECOMMENDATION: It is recommended the Council: 1. Approve a First Amendment to the Agreement for Consultant Services with Terry Paris lnspection Services to increase the "not to exceed" amount by $30,500 and extend the contract time by six months to May 31, 201 3; and 2. Authorize the Mayor to execute the amendment. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: Payment for Terry Paris lnspection Services will be funded from capital project budgets and developer contributions for assigned projects. There are no anticipated impacts to staff time or resources. BACKGROUND: On July 25, 2011, the City Manager executed a contract with Terry Paris lnspection Services to provide on-site construction inspection for the El Camino Real Rehabilitation and Enhancement Project in the amount of $24,500. Based on the quality of the services provided, staff negotiated a separate contract agreement with Terry Paris to provide similar inspection services for various capital projects, encroachment permits, and development projects. On April 1, 2012, the City Manager executed a separate contract with Terry Paris lnspection Services for the "not to exceed" amount of $24,500, with the term of the contract extending to December 31, 2012. ANALYSIS OF ISSUES: A First Amendment to the Agreement for Consultant Services with Terry Paris lnspection Services is recommended to continue to provide additional construction support services through May 31, 2013. All services will be billed on a time and materials basis and are performed solely at the City's direction. Item 8.f. - Page 1 CITY COUNCIL CONSIDERATION OF FIRST AMENDMENT TO AGREEMENT WITH TERRY PARIS INSPECTION SERVICES FOR CAPITAL PRO.IECT AND DEVELOPMENT INSPECTION SERVICES OCTOBER 9,2012 PAGE 2 The Community Development Department is currently reviewing applications for the Associate Engineer position. The position has been vacant for nearly 15 months and will include project management and inspection duties. As the Associate Engineer gains in experience, it is anticipated that the volume of Terry Paris' inspection assignments will be reduced accordingly. ALTERNATIVES: The following alternatives are provided for the Council's consideration: Approve a First Amendment to the Agreement with Terry Paris lnspection Services; Do not approve the amendment; or Provide staff direction. ADVANTAGES: Approval of the contract amendment will enable Terry Paris lnspection Services to continue to assist staff to provide inspection duties as assigned. Terry Paris has provided valuable assistance to staff as the on-site inspector and construction liaison for El Camino Real Rehabilitation and Enhancement Project and through a variety of assignments on various City capital and development projects. This has enabled the City to complete an increased number of projects on schedule and within budget. DISADVANTAGES: No disadvantages regarding the recommendation have been identified. ENVIRONMENTAL REVIEW: Not applicable. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted in front of City Hall on Thursday, October 4, 2012. The Agenda and staff report were posted on the City's website on Friday, October 5, 2012. No public comments were received as of the time of preparation of this staff report. Attachment: 1. First Amendment to the Agreement for Consultant Services with Terry Paris lnspection Services Item 8.f. - Page 2 ATTACHMENT 1 CONSULTANT SERVICES AGREEMENT AMENDMENT NO. 1 This First Amendment ("First Amendment") to Consultant's Services Agreement ("CSA) by and between the CITY OF ARROYO GRANDE and TERRY PARIS INSPECTION SERVICES is made and entered into this day of October 2012, based on the following facts: WHEREAS, the parties entered into a CSA dated April 1, 2012, to provide inspection and engineering support for various capital and development projects as assigned; and NOW THEREFORE, for the good and valuable consideration, the receipt and sufficiency of which is acknowledged, the parties agree that the CSA is in full force and effect as modified, and subject to the new terms and conditions set forth below: 1. Increase the not-to-exceed cost of the CSA from $24,500 to $55,000. 2. Extend the term of the CSA to expire on May 31, 2013. 3. Except as modified herein, all other terms and conditions set forth in the CSA, as amended, shall remain unchanged.
