� A RESOLUTION OF THE PLANNING COMMISSION OF THE �
CITY OF ARROYO GRANDE APPROVING AMENDED j
PLANNED UNIT DEVELOPMENT NO. 12-001 FOR f
PROPERTY LOCATED AT FAIR OAKS AVENUE AND �
WOODLAND DRIVE, APPLIED FOR BY ARROYO VIEW, LLC '
(BUILDINGS 3, 4 AND 5)

WHEREAS, on September 26, 2006, the City Council of the City of Arroyo Grande ;
approved Vesting Tentative Tract Map 05-003 and Planned Unit Development 05-007, �
filed by Central Coast Real Estate Development, for a mixed-use development proposed �
in two phases on a 5.5-acre site. Phase I includes thirty (30) 2-story town homes and a �
46,175 square foot open space lot, and Phase II includes up to 40,000 square feet of G
medical office space on four (4) parcels; and �
WHEREAS, on February 12, 2008 the City Council apprr�ver� � Fin�l 6VIap for Tract 2792;
and
WHEREAS, on April 17, 2012 the Planning Commission held a public hearing on the
developer's request to modify the building design and square footage for thirteen (13) of �
the thirty (30) units and approved amendments to tl�:� three (3) units contained in Building �
;! 1 and directed the applicant to return to the Architectural Review Committee for review of
! amendmPnts to Buildings 3, 4 and 5; and �
WHEREAS, on May 7, 2012 the Architectural Review Committee considered amendments
to Building$ 3, 4 and 5 and recommended approval to the Planning Commission with
minor modifications; and
WHEREAS, on May 15, 2012 the Planning Commission has held a public hearing to
reconsider the developer's request to modify the building design and square footage of ten
(10) units contained in Buildings 3, 4 and 5; and �
WMERE,�S, the Planning Commission finds that this project remains consistent with the �
City'� General Plan, Development Code and the environmental documents associafed �
therewith, and has determined that the project is exempt pursuant to CEQA Guidelines [
Sections 15301; and
WN�ff�EAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances remain unchanged: �

2. The ro'ect site is ade uate in size and sha e to accommodate said use and all �

yards, open spaces, setbacks, walls and fences, parking areas, landscaping, and !
other features required by the Development Code.
3. The site for the proposed development has adequate access, meaning that the site
design and development plan conditions consider the limitations of existing streets
and highways. �
4. Adequate public services exist, or will be provided in accordance with the conditions
of the development plan approval, to serve the proposed development; and that the
approval of the proposed development will not result in a reduction of public services
to properties in the vicinity so as to be a detriment to public health, safety, and
welfare.
5. The proposed development, as conditioned, will not have a substantial adverse effect
on surrounding property, or the permitted use thereof, and will be compatible with the
existing single-family residential, hospital and medical office uses in the surrounding
area.
6. The improvements required, and the manner of development, adequately address all
natural and man-made hazards associated with the proposed development of the
project site, including, but not limited to, flood, seismic, fire and slope hazards. �
7. The proposed development carries out the intent of the Planned Unit Development
Provisions by providing a more efficient use of the land and an excellence of design �
greater than that which could be achieved through the application of conventional �
development standards.

8. The proposed development complies with all applicable perFormance standards listed
in Development Code Section 16.32.050.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo �
Grande hereby approves Amended Planned Unit Development 12-001 for Buildings 3, 4 and
5 as shown in Exhibits "B1-B8" with the above findings and subject to the conditions as set
forth in Exhibit "A", attached hereto and incorporated herein by this reference.
On motion by Commissioner Keen, seconded by Commissioner Sperow, and by the
following roll call vote, to wit:
AYES: Keen, Sperow, Barneich, Martin, Ruth
NOES: None
ABSENT: None

(WALNUT GROVE)
This approval authorizes the modification of footprints, floor plans and exterior design of ten
(10) units contained in Buildings 3, 4 and 5 as provided in Exhibits "B1 — B8". Option B was
selected for Building 3, which includes brick wainscoting on the front/right and front/left
elevations instead of a pop-out at the upper floor with siding.
COMMUNITY DEVELOPMENT DEPARTMENT �
PLANNING DIVISION
GENERAL CONDITIONS:
1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. All conditions of approval for Planned Unit Development 05-00 and Vesting Tentative
Tract Map 05-003, as amended, shall remain in full force and effect as indicated in �
City Council Resolution No. 3955 approved in September 2006.
3. The applicant shall comply with all conditions of approval for Amended Planned Unit
Development 12-001.
4. Development shall occur in substantial conformance with the plans presented to the
Planning Commission at their meeting of May 15, 2012 and marked Exhibits "B1 —
B8".
5. The applicant shall, as a condition of approval of this application, defend, indemnify
and hold harmless the City of Arroyo Grande, its present or former agents, officers
and employees from any claim, action, or proceeding against the City, its past or
present agents, officers, or employees to attack, set aside, void, or annul City's
approval of this subdivision, which action is brought within the time period provided
for by law. This condition is subject to the provisions of Government Code Section
66474.9, which are incorporated by reference herein as though set forth in full.
6. Development shall conform to the OMU-D-2.20 zoning requirements except as
otherwise approved.
SP�CIAL CONDITIONS:
7. The applicant shall consult with the Tree Guild on selecting the species and location ;
for three (3) skyline trees within the project boundary. The trees shall be planted prior
to issuing a certificate of occupancy for the first unit in Building 4. '
