A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE APPROVING AMENDED
PLANNED UNIT DEVELOPMENT NO. 12-001 FOR
PROPERTY LOCATED AT FAIR OAKS AVENUE AND
WOOD�AND DRIVE, APPLIED FOR BY ARROYO VIEW,
LLC (BUILDING 1 ONLY - UNITS 302, 304, 306)
WHEREAS, on September 26, 2006, the City Council of the City of Arroyo Grande
appr�ved Vesting Tentative Tract Map 05-003 and Planned Unit Development 05-007,
filed by Central Coast Real Estate Development, for a mixed-use development
proposed in two phases on a 5.5-acre site. Phase I includes thirty (30) 2-story town
homes and a 46,175 square foot open space lot, and Phase II includes up to 40,000
square feet of inedical office space on four (4) parcels; and
WHEREAS, On February 12, 2008 the City Council approved a Final Map f�r Tract
2792; and
WHEREAS, the Planning Commission has held a public hearing on the developer's
request to modify the building design and square footage for thirteen (13) of the thirty
(30) units; and
WHEREAS, the Planning Commission approved amendments to the three (3) unifis
contained in Building 1 and directed the applicant to return to the Architectural Review
Committee for review of amendments to Buildings 3, 4 and 5; and
WHEREAS, the Planning Commission finds that this project (amendments to Building
1) remains consistent with the City's General Plan, Development Code and the
environmental documents associated therewith, and has determined that the project is
exempt pursuant to CEQA Guidelines Sections 15301 and 15305; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances remain unchanged:
Planned Unit Development Findings
1. The proposed development is consistent with the goals, objectives, and programs
of the Arroyo Grande General Plan.
2. The project site is adequate in size and shape to accommodate �aid �ase and all
yards, open spaces, setbacks, walls and fences, parking areas, landscaping, and
other features required by the Development Code.
3. The site for the proposed development has adequate access, meaning that the
site design and development plan conditions consider the limitations of existing
streets and highways.

4. Adequate public services exist, or will be provided in accordance with the
conditions of the development plan approval, to serve the proposed development;
and that the approval of the proposed development will not result in a reduction of
public services to properties in the vicinity so as to be a detriment to public health,
safety, and welfare.
5. The proposed development, as conditioned, will not have a substantial adverse
effect on surrounding property, or the permitted use thereof, and will be compatible
with the existing single-family residential, hospital and medical office uses in the
surrounding area.
6. The improvements required, and the manner of development, adequately address
all natural and man-made hazards associated with the proposed development of
the project site, including, but not limited to, flood, seismic, fire and slope hazards.
7. The proposed development carries out the intent of the Planned Unit Development
Provisions by providing a more efficient use of the land and an excellence of
design greater than that which could be achieved through the application of
conventional development standards.
8. The proposed development complies with all applicable performance standards
listed in Development Code Section 16.32.050.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves Amended Planned Unit Development 12-001 for
Building 1, as shown in Exhibits "B1-B5" with the above findings and subject to the
conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this
reference.
On motion by Commissioner Ruth, seconded by Commissioner Sperow, and by the
following roll call vote, to wit:
AYES: Ruth, Sperow, Barneich, Keen and Martin

ABSENT: None

CONDITIONS OF APPROVAL
AMENDED PLANNED UNIT DEVELOPMENT 12-001
FAIR OAKS AVENUE AND WOODLAND DRIVE
(WALNUT GROVE)
This approval authorizes the modification of footprints, floor plans and exterior design of
three (3) units contained in Building 1 as provided in Exhibits "B1 — B5".
COMMUNITY DEVELOPMENT DEPARTMENT
PLANNING DIVISION
GENERAL CONDITIONS:
1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. All conditions of approval for Planned Unit Development 05-00 and Vesting
Tentative Tract Map 05-003, as amended, shall remain in full force and effect as
indicated in City Council Resolution No. 3955 approved in September 2006.
3. The applicant shall comply with all conditions of approval for Amended Planned
Unit Development 12-001.
4. Development shall occur in substantial conformance with the plans presented to
the Planning Commission at their meeting of April 17, 2012 and marked Exhibits
"B1 — B5".
5. The applicant shall, as a condition of approval of this application, defend,
indemnify and hold harmless the City of Arroyo Grande, its present or former
agents, officers and employees from any claim, action, or proceeding against the
City, its past or present agents, officers, or employees to attack, set aside, void,
or annul City's approval of this subdivision, which action is brought within the
time period provided for by law. This condition is subject to the provisions of
Government Code Section 66474.9, which are incorporated by reference herein
as though set forth in full.
6. Development shall conform to the OMU-D-2.20 zoning requirements except as
otherwise approved.
SPECIAL CONDITIONS:
7. The applicant shall submit a landscape plan that includes sufficient vegetative
screening between the balconies of Building 1 and the adjacent property to the
north. The landscape plan shall be reviewed and approved by the Community
Development Director and the Director of Recreation and Maintenance Services.
