CALL TO ORDER - The Arroyo Grande Planning Commission met in regular session with Vice Chair Brown presiding; also present were Commissioners, Barneich and Keen. Commissioner Ruth absent. Staff members in attendance were Community Development Director Teresa McClish and Associate Planner Kelly Heffernon. ANNOUNCEMENTS: None AGENDA REVIEW: None APPROVAL OF MINUTES: Commissioner Keen made a motion, seconded by Commissioner Barneich and unanimously carried to approve the minutes of May 4, 2010, with the following modifications: • Page 2, first paragraph, last sentence, change the word "yard" to "foot"; • Page 3, under V. DISCUSSION ITEMS: add "and in the future there will be a call for nomination". I. A. ORAL COMMUNICATIONS: None � B. WRITTEN COMMUNICATIONS AFTER AGENDA PREPARATION: The Commission received from Associate Planner Heffernon a memo dated May 28, 2010, along with a revised map for TPM 09-003. This map correctly includes property adjusted from Tract 3017 through LLA 09-006. II. PUBLIC HEARING ITEM: . A. CONSIDERATION OF LOT LINE ADJUSTMENT CASE NO. 09-006; PLANNED UNIT DEVELOPMENT CASE NO. 09-002; VESTING TENTATIVE TRACT MAP CASE NO. 09-007; AND TENTATIVE PARCEL MAP CASE NO. 09-003; APPLICANT — CITY OF ARROYO GRANDE AND ROBERT ZOGATA; LOCATION — NORTH AND NORTHEAST OF PEARWOOD AVENUE Associate Planner Kelly Heffernon presented the staff report to consider adopting the Mitigated Negative Declaration, and approve the project, which includes Lot Line Adjustment No. 09-006, Tentative Parcel Map No. 09-003, Planned Unit Development No. 09-002, and Vesting Tentative Tract Map No. 09-007 (Tract 3017) to subdivide two (2) parcels totaling 8.03 acres into six (6) residential parcels ranging from 17,494 to 41,677 square feet and one open space parcel of 3.5 acres. A Planned Unit Development is required to allow clustered development on slopes of 7% to 25% to preserve open space. The Lot Line Adjustment will allow reciprocal access between the two properties and enable a shared driveway for the two parcels created with the proposed parcel map. Due to slope, length of cul-de-sac and size of building envelopes, second units are prohibited, which staff recommends be added to the resolution. In response to Commissioners' questions, Associate Planner Heffernon and Community Development Director McClish provided the following comments: the pedestrian path PLANNING COMMISSION PAGE 2 MINUTES JUNE 1, 2010 i wili be through the open space; revenue from sale of the property from the City to the I RDA will result in the development of affordable housing at suitable locations within the City for future land swap; one pine tree will be removed on the Zogata property to construct the road; the oak tree at the end of the cul-de-sac on the City property will most likely be removed; the City will review the final plans for the road construction where said tree is located; the cul-de-sac is designed to hill-side standard; the improvements will likely be done by the developer and not the City; the site is designed such that there are no drainage issues; Mr. Zogata is responsible for the road cut and can remain as a driveway; the City will be responsible for drainage within the open space parcel. Vice Chair Brown opened the meeting for public comments: Planning Consultant Rob Strong, representative of the City of Arroyo Grande and Robert Zogata, gave a brief history of the project; stated it is not the intent of the City to develop the subdivision but to convey to RDA for future sale; discussed intent of the temporary drainage slope easement; the pine and four inch oak tree will be removed and would be mitigated; the oak tree at the end of the cul-de-sac is six to 8 inches in size. Commissioner Keen clarified that in Mitigation 3.9 of the resolution of Planned Unit Development No. 09-002 and Tentative Parcel Map No. 09-003, "high pressure" sodium is what the City requires.
