A UESOLUTION OF TilE CITY COUNCIL OF TilE CITY OF
ARROYO GRANDE UPHOLDING TIlE APPEAL TO DELETE
CONDITION OF APPROVAL NO. 16 OF LOT LINE
ADJUSTMENT CASE NO. 95-523, J081 FARROLL A VENUE
WHEREAS, on March 21, 1995 the Planning Commission held a public headng pursuant
to State Law and City Codes on Lot Line Adjustment Case No. 95-523; and
WHEREAS, the Planning Commission amended and included Condition of Approval No.
16 requiring revisions to the design proposed by the applicant; and
. WHEREAS, on April 7, 1995, Ed Dorfman filed an appeal of the Planning Commission's
inclusion of Condition of Approval Number 16 and asked that said condition be deleted; and
WHEREAS, the City Council of the City of Arroyo Grande held a duly noticed public
hearing on April 25, 1995 to consider said appeal; and
WHEREAS, after due study, deliberation, and public hearing, the City Council finds that
the following circumstances exist:
l. Approval of Lot Line Adjustment Case No. 95-523 with deletion of condition number 16 will
not impair any existing access or create a need for access to any adjacent lots or parcels.
2. Approval of Lot Line Adjustment Case No. 95-523 with deletion of condition number 16 will
not constitute poor land planning.
NOW THEREFORE, BE IT RESOL VEl) that the City Council of the City of Arroyo Grande
hereby upholds the Appeal to delete of Condition of Approval No. 16 of Lot Line Adjustment Case
No. 95-523 subject to all other Planning Commission adopted conditions of approval:
On motion of Council MemberFu1ler; seconded by Council Member Lady , and by the
following roll call vote, to wit:
AYES: Council Members Fuller, Lady, Souza and Mayor Dougall
NOES: None
ABSENT:Council Member Brandy
