R 3065 . RESOLUTION NO. 3065 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING LOT LINE ADJUSTMENT CASE NO. 94-520, LOCATED ON RODEO DRIVE, APPLIED FOR BY THE COUNTY OF SAN LUIS OBISPO WHEREAS, the City of Arroyo Grande has received applications from the County of San Luis Obispo for a General PIL\n Amendment, Rezone and Lot Line Adjustment for properties owned by the County on Rodeo Drive between West Branch Street and Mercedes Lane; and , WHEREAS, said applications were reviewed by the Planning Commission at a duly noticed public hearing on November 29, 1994; and WHEREAS, after due study, deliberation, and public hearing, the Planning Cv nmi~s;lII! recommended approval of said projects to the City Council; and WHEREAS, the City Council, on December 13, 1994 adopted Resolution :No. 3062 approving General Plan Amendment Case No. 94-001; and WHEREAS, the City Council, on January 10, 1995 adopted Ordinance No. 465 C.S. approving P.D. Rezone Case No. 94-002; and WHEREAS, the City Council of the City of Arroyo Grande has held a public hearing on Lot Line Adjustment Case No. 94-520, in accordance with City Code; and WHEREAS, the City Council has found that this lot line adjustment is consistent with the approved General Plan amendment and rezone; and WHEREAS, the City Council has reviewed this project and the draft negative declaration in compliance with the California Environmental Quality Act (CEQA); and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the following circumstances exist: This Lot Line Adjustment will not: 1. Create any new lots. 2. Include any lots or parcels created illegally. 3. Impair any existing access or create a need for access to any adjacent lots or parcels. 4. Impair any existing easements or create a need for any new easements serving adjacent lots or parcels. 5. Constitute poor land planning or undesirable lot configurations due to existing environmental conditions or current zoning development standards. . - Resolution No. 3065 Lot Line Adjustment Case No. 94-520 County of San Luis Obispo Page Two 6. Require substantial alteration of any existing improvements or create a need for any new improvements. 7. Create a non-conforming lot in the PF/P-D-l.3 zoning district. Department of Fish and Game Required Findings of Exemption 1. The City of Arroyo Grande has prepared an initial study pursuant to Section 15063 of the Guidelines of the California Environmental Quality Act for Lot Line Adjustment Case No. 94-520. 2. Based on the initial study, a negative declaration was prepared for review by the public and review and approval by the City Council. 3. After holding a public hearing pursuant to State and City Codes, and considering the record as a whole, the City Council adopted the negative declaration and found that there is no substantial evidence of any significant adverse effect, either individually or on the habitat upon which the wildlife depends as a result of development of this project. NOW, THEREFORE, DE IT RESOLVED that the City Council of the City of Arroyo Grande hereby adopts a negative declaration, instructs the City Clerk to file a Notice of Determination and approves Lot Line Adjustment Case No. 94-520 subject to the following conditions: General Conditions: 1. This application shall automatically expire on January 24, 1997 unless the lot line adjustment is recorded. Prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 2. The lot line adjustment shall occur in substantial conformance with the plans presented to the City Council at the meeting of January 24, 1995 and marked "Exhibit A". Planning Depm1ment Conditions 3. All easements shown on the final map for Tract 1390 shall remain. Fire Department Conditions 4. Upon any new construction, existing access must be upgraded to comply with the 1991 State Uniform Fire Code and any such new construction must comply, at a minimum, with the then current edition of the State Building and Fire Codes. - Resolution No. 3065 Lot Line Adjustment Case No. 94-520 County of San Luis Obispo Page Three On motion of Council Member Souza , seconded by Council Member lady , and by the following roll call vote, to wit: AYES: Council Members Souza, Lady, Brandy, Fuller and Mayor Dougal NOES: None ABSENT: None the foregoing Resolution was adopted this 24th day of January, 1995 .
