O 650Will THE CITY COUNCIL OF OF - -• • GRANDE DOES ORDAIN FOLLOWS: SECTION 1: Arroyo Grande Municipal Code Chapter 2.12 "Fire Department" is hereby renamed "Five Cities Fire Authority" and Section 2.12.010 is amended in its entirety as follows: FIVE CITIES FIRE AUTHORITY 2.12.010 Five Cities Fire Authority. Pursuant to the Joint Exercise of Powers Agreement creating the Five Cities Fire Authority, the Five Cities Authority shall be deemed to be the fire department of the City of Arroyo Grande for all purposes related to ordinances, laws and regulations relating to the City or adopted by this Code. All references in this Code to "Fire Chief' or "Fire Department" shall be deemed to mean the Fire Chief of the Five Cities Fire Authority and the Five Cities Fire Authority, respectively. SECTION 2: Arroyo Grande Municipal Code Sections 2.12.020 through 2.12.120 are hereby repealed in their entirety. SECTION 3: Arroyo Grande Municipal Code Chapter 2.16 "Financial Services Department" is renamed "Administrative Services Department" and Sections 2.16.010 through 2.16.050 are hereby amended as follows: ADMINISTRATIVE SERVICES DEPARTMENT Sections: 2.16.010 Created. 2.16.020 Functions and duties. 2.16.030 Administrative services director -- Position created-- Appointment -- Responsibilities. 2.16.040 Administrative services director -- Financial and accounting duties. 2.16.050 Administrative director - -Bond required. 2.16.010 Created. An administrative services department is created and established and shall be subject to the general administrative direction of the city manager. *RDINANCE NO. 650 PAGE 2 2.16.020 Functions and duties. The administrative services department shall be responsible for the entire financial, accounting, and human resources operations of the city, including, but not necessarily limited to, the receipt, disbursement and deposit in the treasury of all city moneys, assistance in the preparation of the city budget, maintenance of all accounting procedures and records, centralized purchasing for all city departments, personnel administration and any other duties and responsibilities that may be assigned by the city manager, council or state laws. 2.16.030 Administrative services director -- Position created-- Appointment -- Responsibilities. The position of administrative services director is created and established and shall be filled by appointment of, and serve at the pleasure of, the city manager. The administrative services director shall be fully responsible for all the functions and duties of the administrative services department as established by state laws, ordinances, or resolutions. 2.16.040 Administrative services director -- Financial and accounting duties. Pursuant to the provisions of Section 37209 and 40805.5 of the Government Code of the state, all the financial and accounting duties imposed upon the city clerk by Sections 37201 through 37208 and Sections 40802 through 40805 of said Government Code are transferred to the administrative services director, who shall be deemed to be the city's director of finance for any and all purposes required by law. 2.16.050 Administrative services director - -Bond required. Before entering upon the duties of office, the administrative services director shall execute a bond to the city. Except as may otherwise be provided, such bond shall conform to the provisions of the Government Code of the state relating to bonds of public officers, and the penal sum of the bond shall be in a reasonable amount recommended by the city attorney and fixed by the council by resolution. Any premium for such required bond shall be assumed by the city. SECTION 4: Arroyo Grande Municipal Code Section 2.17.040 is hereby added to Chapter 2.17 "Community Development Department" as follows: 2.17.040 Community development department, engineering division. 1. The engineering division administers the design, construction and inspection of all major publicly funded capital projects involving the upgrade of the City's infrastructure and facilities. The engineering division ensures all construction in the public right -of -way related to land development entitlements comply with adopted codes and engineering standards. The engineering division is also responsible for all subdivision processing, approval of final subdivision maps, accepting related offers of dedications and entering into agreements to complete subdivision agreements. IMAM SECTION : Arroyo Grande Municipal Code Chapter 2.20 "Parks, Recreation and Facilities Department" is renamed to "Recreation Services Department" and is hereby amended in its entirety as follows: RECREATION SERVICES DEPARTMENT Sections: 2.20.010 - Created. 2.20.020 - Functions. 2.20.030 - Recreation services director — Powers and duties. 2.20.010 - Created. The recreation services department is established for the city. 2.20.020 - Functions. The functions of the recreation services department shall be to provide opportunities for wholesome, year -round public recreation services for each age group and to manage scheduling and reservations for all recreational facilities, including parks and barbeque areas, community centers, and athletic fields. 2.20.030 - Recreation services director — Powers and duties. The Recreation services director shall: A. Attend meetings of the parks and recreation commission and make such reports to the commission and to the council as shall be required; B. Recommend to the city manager required personnel and budget needs; C. In cooperation with the director of public works, administer, operate and maintain existing park and recreation areas and facilities and plan for acquisition, development and operation of the proposed facilities in accordance with policies approved by the parks and recreation commission and the council; D. Inform the general public of the services and facilities being provided by the recreation services department; E. Solicit suggestions from the general public to improve or increase the effectiveness of the services being provided; F. Coordinate with governmental and voluntary organizations and agencies in the furtherance of recreation opportunities; and G. Conduct studies of local conditions and needs for recreation services and park and open space facilities, and assist with the recruitment and training of recreation personnel. ORDINANCE NO. PAGE 4 SECTION : Arroyo Grande Municipal Code Subsection 2.24.050(B) and Section 2.24.060 of Chapter 2.24 "Parks and Recreation Commission" are hereby amended as follows: 2.24.050.B. Secretary. The director of recreation services shall appoint a secretary to the commission who shall maintain accurate minutes of the activities of the commission. 2.24.060 Powers and Duties. The duties and responsibilities of the parks and recreation commission shall be to: A. Act in an advisory capacity to the council and the recreation services and public works directors in all matters pertaining to parks and public recreation and to cooperate with other governmental agencies and civic groups in the advancement of sound park and recreation planning and programming; B. Formulate policies on recreation services for approval by the council; C. Meet with the council when necessary to discuss proposed policies, programs, budgeting, future needs, or other matters requiring joint deliberation; D. Advise the recreation services and public works directors on problems of administration, development of recreation areas, facilities, programs, and improved recreation services; E. Make periodic inventories of recreation services that exist or may be needed and interpret the needs of the public to the council and to the recreation services director; F. Aid in coordinating the recreation services with the programs of other governmental agencies and voluntary organizations; G. Interpret the policies and functions of the recreation services department to the public with regard to parks and recreation programs and facilities; and H. Advise the recreation director and the public works director in the preparation of the annual budgets for parks, recreation services, and facilities and a long -range recreation capital improvement program; and I. Adopt rules and regulations for the use of recreation areas and facilities in accordance with the laws of the city; and; J. Review tree removal appeals and other decisions regarding urban forestry management. SECTION 7: Arroyo Grande Municipal Code Sections 2.30.020 and 2.30.030 of Chapter 2.30 "Public Works Department" are hereby amended as follows: a 2.30.020 Functions. The functions of the public works department shall be to serve the city and the public in providing professional services to maintain the city's infrastructure for use by residents, businesses, and visitors. In coordination with the community development department's engineering division, the public works department administers construction and inspections of capital projects related to ongoing maintenance of the City's infrastructure. The public works department operates and maintains the equipment, tools, and other resources necessary to construct, operate and maintain the city's infrastructure. Infrastructure consists of water system, sewer system, road network, storm drain system, city facilities, parks, urban forest and landscaped and open space areas. The public works department also maintains the city's vehicle fleet and community tree program. 2.30.030 Public works director -- Position created -- Appointment -- Duties. The position of public works director is created and established and shall be filled by appointment of, and serve at the pleasure of, the city manager. The public works director shall be fully responsible for all the functions and duties of the public works department as established by state laws, ordinances, or resolutions.. The public works director or his or her designee shall: 1. Assume full management responsibility for assigned services and activities of the public works department, including planning and park development and maintenance of all city parks, streets, buildings, fleet, and utilities; 2. Monitor and evaluate the efficiency and effectiveness of service delivery methods and procedures; 3. Develop, implement and oversee effective and cost efficient work, equipment and asset management systems and programs; 4. Plan, direct, coordinate and review the work plan for maintenance staff; assign work activities, projects and programs; 5. Develop, implement and maintain systems to inventory infrastructure deficiencies and program, assign and track corrective measures; 6. Recommend to the city manager budget, staff, equipment, material and supply needs; 7. Coordinate capital improvement projects and services related to maintenance of the city's infrastructure; 8. Advise the parks and recreation commission on issues related to maintenance of parks facilities and open space areas; and 9. Consider tree removal permit requests. SECTION 8: Arroyo Grande Municipal Code Sections 2.32.030 and 2.32.040 of Chapter 2.32 "Traffic Commission" are hereby amended as follows: 2.32.030 Meetings. The traffic commission shall regularly meet once each month during the evening at the council chambers on a day and time designated by the commission, provided sufficient topics of consideration are present, and may meet at such other times as the chairperson deems necessary or advisable. ORDINANCE NO. PAGE 6 2.32.040 Purpose and scope. The traffic commission shall act in an advisory capacity to the city council in the review and development of traffic facilities, policies, and programs as related to the movement and parking of vehicles within the city, and shall have the authority to conduct public meetings on such matters. The traffic commission shall have the following additional duties: A. Assist other commissions and committees in providing input to the planning and implementation process for traffic control for projects with traffic related impacts; B. Review issues having to do with traffic and parking matters and shall recommend solutions; C. Recommend ways and means to improve existing traffic conditions within the city and review regional traffic as it relates to the city; D. Act in an advisory capacity to the planning commission relating to traffic issues in the circulation element of the general plan. The traffic commission shall rely upon the technical and administrative input of the director of community development and shall act in an advisory capacity to the director. The traffic commission shall have such additional related duties and authority as may from time to time be approved by the city council. SECTION 9: The repeal of an ordinance herein shall not repeal the repealing clause of such ordinance or revive any ordinance which has been repealed thereby. SECTION 10: A summary of this Ordinance shall be published in a newspaper published and circulated in the City of Arroyo Grande at least five (5) days prior to the City Council meeting at which the proposed Ordinance is to be adopted. A certified copy of the full text of the proposed Ordinance shall be posted in the office of the City Clerk. Within fifteen (15) days after adoption of the Ordinance, the summary with the names of those City Council members voting for and against the Ordinance shall be published again, and the City Clerk shall post a certified copy of the full text of such adopted Ordinance. SECTION 11: This Ordinance shall take effect and be in full force and effect thirty (30) days after its passage.
