RESOLUTION NO. 3039
A RESOLUTION OF TilE CITY COUNCIL OF TilE CITY
OF ARROYO GRANDE DELETING PUBLIC WORKS
CONDITION OF APPROVAL NO. 5 PLACED ON WT
MERGER CASE NO. 94-518 ON THE CHEVRON
PRODUCES USA PROJECT LOCATED AT 251 GRAND
AVENUE
WHEREAS, the City of Arroyo Grande received applications from Chevron Products
USA for property located at 251 Grand A venue in the HC zoning district; and
WHEREAS, the Planning Commission of the City of Arroyo Grande held duly noticed
public hearings on the project on June 7, 1994 and June 21, 1994; and
WHEREAS, after due study, deliberation and public hearing, the Planning Commission
approved the applications for the Lot Merger Case No. 94-519, Amended Architectural Review
Case No. 73-067, Planned Sign Program Case No. 94-114 and Variance Case No. 94-184; and
WHEREAS, Public Works Department Condition of Approval No.5 requires a ten (10)
foot offer of dedication for roadway purposes; and
WHEREAS, Pubic Works Department Condition of Approval No. 5 was appealed on
June 28, 1994 by Chevron Products USA; and
WHEREAS, the Arroyo Grande City Council held a duly noticed public hearing on the
aforementioned appeal on July 12, 1994, at which time all interested persons were given an
opportunity to be heard; and
WHEREAS, based on the application materials, the various oral and written staff
reports, testimony at the public meetings and hearings, decision of the Planning Commission,
and written correspondence, the City Council finds the following:
1. There is no reasonable relationship between the proposed project and request for a ten
(10) foot offer of dedication for roadway purposes.
NOW THEREFORE, the City Council of the City of Arroyo Grande hereby deletes Public
Works Condition of Approval No.5.
