RESOLUTION NO. 3038
A RESOLUTION OF THE CITY COUNCIL OF TIlE CITY
OF ARROYO GRANDE UPHOLDING TIlE APPEAL TO
DELETE CONDITIONS OF APPRO V AL NO.9 AND 10 OF
CONDITIONAL USE PERMIT NO. 94-518; 900 WEST
BRANCH STREET (ST. PATRICK'S CATIlOLIC SCHOOL)
WHEREAS, on May 17, 1994 the Planning Commission held a public hearing pursuant
to State Law and City Codes on Conditional Use Permit Case No. 94-518; and
WHEREAS, the Planning Commission included Conditions of Approval No.9 and 10
requiring the installation of curb, gutter and sidewalk;
WHEREAS, on June 6, 1994, Raymond J. Burnell, on behalf of St. Patrick's Catholic
School, filed an appeal of the Planning Commission's inclusion of Conditions of Approval No.
9 an 10 and asked that said conditions be deleted; and
WHEREAS, the City Council of the City of Arroyo Grande held a duly noticed public
hearing on July 12, 1994 to consider said appeal; and
WHEREAS, after due study, deliberation, and public hearing, the City Council finds that
the following circumstances exist;
1. The proposal use will not be detrimental to the public health, safety or welfare,
or materially injurious to properties and improvements in the vicinity.
2. Because final design of West Branch Street is still in process, installation of curb,
gutter and sidewalk at this time would be premature and economically infeasible.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande
hereby upholds the Appeal of Conditional Use Permit Case No. 94-518 with deletion of
Conditions of Approval No.9 and 10.
