RESOLUTION NO. 3015
A RESOLUTION OF TI-IE CITY COUNCIL OF THE CITY OF ARROYO GRANI>E
DECLARING ITS INTENT TO HOLD A PUULIC HEARING TO ASCERTAIN WHETHER
A PUBLIC NUISANCE EXISTS AT PROPERTY LOCATED AT 202 ALDER STREET
WHEREAS, Peter Quaglino, owner of property located at 202 Alder Street (APN 77-191-20), was issued
a building permit on May 7, 1993; and
WHEREAS, a condition of said building permit was that curb, guller, and sidewalk improvements be
completed along the frontage of the property; and
WHEREAS, the concrete work has been completed, but the roadway pavement has not been restored and
debris is stockpiled behind the sidewalk; and
WHEREAS, the unfinished condition presents a pedestrian and traffic safety concern; and
WHEREAS, the unfinished work together with the oncoming rainy season presents the added concern that
the roadway pavemet1t may be undermined; and
WHEREAS, repeated requests have been made to the owner to complete the work; and
WHEREAS, the owner has failed to complete the work;
NOW, THEREFORE, BE IT RESOLVED that the City Council does find, based on the recommendations
of the Director of Public Works, that a public nuisance may exist at property commonly known as 202
AIder Street, Arroyo Grande (APN'77-191-20), being a portion of Lot 6, Block 5, of the Fair Oaks Tract;
and
BE IT FURTHER RESOLVED that in the event that a finding that a public nuisance does exist, it will
be the intent of the City Council to direct the Director of Public Works to perform or to employ a
competent general contractor to perform appropriate work recommended by the Director of Public Works
at said owners expense to abate the nuisance; and
BE IT FURTHER RESOLVED that the City Council has directed the City Clerk to cause to be
conspicuously posted on the premises !I certified copy of this resolution as well as 11 "Notice of Puhlic
Hearing"; and further that at least fifteen (15) days before. the public hearing, the City Clerk shull cause
to be served on the owner one copy of the Notice of Public Hearing and a certified copy of the resolution;
and
BE IT FURTHER RESOLVED that the date and time fixed for the public hearing shall be on the J Ilh
day of January, 1994, at 7:30 P.M., in the City Council Chambers at 215 East Branch Street, Arroyo
Grande, at which time any and all interested parties may testify and present evidence regarding this mailer.
