CARMEL, CITY ATTORNEY SUBJECT: CONSIDERATION OF A RESOLUTION ACCEPTING AN OFFER OF DEDICATION FOR A WATER LINE EASEMENT ON A PORTION OF PARCEL 1 OF PARCEL MAP NO. AG-89-423 AND AUTHORIZING THE MAYOR TO EXECUTE A CORRECTION QUITCLAIM DEED DATE: MAY 13, 2014 RECOMMENDATION: It is recommended the City Council adopt a Resolution accepting an offer of dedication for a water line easement and authorizing the Mayor to execute a correction quitclaim deed. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: None. BACKGROUND: During a construction project at the Arroyo Grande Hospital, a portion of one of the buildings was proposed to be built over the City's water line and easement which serves the hospital. As a result, this water line was relocated outside of the building's footprint to enable access for maintenance and repair. In order to perfect title to the relocated water line, the City executed a quitclaim deed releasing its interest in the former location of the water line and accepted an offer to dedicate for the new location. Those instruments were recorded on June 27, 2011 as Document Nos.: 2011030302 and 2011 030300, respectively (Attachments 1 and 2). ANALYSIS OF ISSUES: It was recently discovered that the owner of the Arroyo Grande Hospital property was not the entity referenced in either the 2011 quitclaim deed or the offer to dedicate. Therefore, a correction quitclaim deed and new offer to dedicate with the correct property owner is necessary in order to rectify the situation. The correction quitclaim deed and new offer of dedication are attached as Exhibits A and B to the proposed Resolution. ADVANTAGES: Execution of the correction quitclaim deed and acceptance the offer of dedication properly aligns the City's and property owner's title to the relocated water line. DISADVANTAGES: None identified. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted in front of City Hall on Thursday, May 8, 2014 and on the City's website on Friday, May 9. No comments were received. Attachments: 1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ACCEPTING AN OFFER OF DEDICATION FOR A WATER, LINE EASEMENT AND AUTHORIZING THE MAYOR TO EXECUTE A CORRECTION QUITCLAIM DEED WHEREAS, a water line located on the Arroyo Grande Hospital property, 345 South Halcyon, Arroyo Grande, CA (the "Property") was relocated in 2011 in order to allow for certain construction to take place on the Property; and WHEREAS, in order to perfect title to the relocated water line, on or about June 22, 2011, the City executed a Quitclaim Deed releasing its interest in the former location of the water line and accepted an Offer of Dedication for the new location; and WHEREAS, City staff has reviewed the 2011 Quitclaim Deed and Offer of Dedication and has determined that the Property owner was incorreCtly referenced; and WHEREAS, in order to correct this error, a Correction Quitclaim Deed and new Offer of Dedication with the correct property owner's name has been prepared. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande does hereby accept the Irrevocable and Perpetual Offer to Dedicate attached hereto as Exhibit "A". BE IT FURTHER RESOLVED that the City Council of the City of Arroyo Grande does hereby authorize the Mayor to execute the Correction Quitclaim Deed attached hereto as Exhibit "8". That portion of the existing said water line easement circumvented by the above description is no longer needed and hereby abandoned.
