A RESOLUTION OF TilE CITY COUNCIL OF TilE CITY
OIr AUROYO GRANDE ADOPTING TilE NOISE ELEMI~NT
OF TilE GENEUAL PLAN, ADOPTING A NEGATIVE
I>ECLAUATION AND INSTRUCTING TilE CITY CLEUK
TO FILE A NOTICE OF DETERMINATION
WIIEREAS, Section 65302 of the California Government Code directs all cities and
counties 10 prepare General Plan Noise Elements; and
WHmtEAS, said Government Code Section also requires the Noise Element to recognize
the guidelines established by the Office of Noise Control in the State Department of Health
Servicesi and
WHEREAS, the City of Arroyo Grande has determined that it is appropriate and
necessary to update and revise the previous Noise Element adopted by the CitYi and
WHEREAS, duly noticed public hearings were held by the Planning Commission of the
City of Arroyo Grande on April 6, 1993, and May 18, 1993 at which all interested persons were
given the opportunity to be heardi and
WHEREAS, duly noticed public hearings were held by the City Council on June 8, 1992
at which lime all interested persons were given the opportunity to be heard; and
WIIEREAS, the City Council reviewed the potential environmental impacts of the
proposed Noise Element in compliance with California Environmental Quality Act (CEQA), the
State CEQA Guidelines, and the City's Rules and Procedures; and
WHEREAS, the City Council has reviewed and considered the informalion and public
teslimony presented at the public hearings and in the proposed documents and staff reports.
NOW, THEREFORE, DE IT RESOLVED that the City Council of the City of Arroyo
Grande, California does hereby adopt a Negative Declaration, instruct the City clerk to file a
Notice of Determination and adopt the updated Noise Element based on the following findings:

I. The proposed update of the noise element is consislent with the goals, objectives,
policies, and programs of the General I)lan and will not result in any internal
inconsistencies within the plan.
2. The proposed update of the noise element will not adversely affect the public health,
safety, and welfare because the update will promote the public health and welfare by
reducing the harmful and annoying effects of excessive noise exposure, such as hearing
loss, high blood pressure, stress related disorders, interference will conversation and
sleep, lost productivity in the work place, and lower property values.
3. Based on the Initial Study and all the comments received, the potential environmental
impacts of the proposed update of the noise element are insignificant.
Noise Element Findings
1. The proposed update will provide for compatible development in terms of noise exposllle --
by minimizing noise conflicts resulting from new and existing developmeht. In addition,
the information in the noise element will enable establishment of land Hse p',h:.ms th~t
will minimize noise conflicts.
2. The proposed noise element is appropriate because it was prepared in h.;cordance with
the requirements of Section 65302(f) of the California Government CtJde and with the
Guidelines for the Preparation and Content of the Noise Elemeot of the Gena;.1 Plan
prepared by the California Department of Health Services. In addition, the proposed
noise standards are justified based on existing noise levels identified in a community
noise survey.

I. The City of Arroyo Grande has prepared an initial study pursuant to Section 15063 of
the Guidelines of the California Environmental Quality Act (CEQA), for the draft noise
element.

2. Based on the initial study, a negative declaration drafted for review by the public and
review and approval by the Planning Commission.
3. After holding a public hearing pursuant to Slate and City Codes, and considering the
record as a whole the Planning Commission adopled the negative declaration and fOllnd
that there is no substantial evidence of any significant adverse effect, either individually
or cumulatively on wildlife resources as defined by Section 71 \.2 of the Fish and Game
Code or on the habitat upon which the wildlife depends as a result of development of this
project.
liE IT FURTHER RESOLVED Ihat the City Council of Ihe City of Arroyo Grande,
California hereby repeals the 1986 noise element.
On motion of Council Member Souza , seconded by Council Member, Brandy,
and by the following roll call vote, 10 wit:
AYES: council Members Souza, Brandy, Moots, Burke and Mayor Gallagher
