SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE 2014 CONCRETE
REPAIR AND VIA LA BARRANCA DRAINAGE IMPROVEMENTS

RECOMMENDATION:
It is recommended the City Council:
1. Accept the improvements as constructed by V. Lopez Jr. & Sons, Inc. for the
subject project;
2. Direct staff to file a Notice of Completion; and
3. Authorize release of retention, thirty-five (35) days after the Notice of Completion
has been recorded, if no liens have been filed.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The amended Capital Improvement Program includes $108,276 for the subject project.
The project funding sources and expenditures are as follows (amounts include the 20%
contingency):

The Miscellaneous Concrete Fund included $60,000 for FY 2014-15, leaving $21,311
available for the next concrete project ($60,000 -$38,689 = $21,311). The remaining
$24,256 of the Pavement Management obligation will be returned to the fund balance.

BACKGROUND:
On June 10, 2014, Council awarded a construction contract to perform the subject
project to V. Lopez Jr. & Sons, Inc. for $90,288 and authorized the City Manager to
approve change orders in the amount of $18,058. The project scope of work involved
the replacement of sidewalk, curb and gutter, and driveway approach segments along
Bennett Avenue, Woodland Drive, Fair Oaks Avenue, Farroll Avenue, and Avenida de
Diamante that have experienced damage from adjacent trees. The scope of work also
included drainage improvements along Via La Barranca and the repair of a residential
driveway apron on Montego Street.
ANALYSIS OF ISSUES:
The contractor has completed the work in accordance with the approved plans and
specifications. There are no outstanding issues.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
1. Approve staff's recommendation;
2. Do not accept the project;
3. Accept the project but do not authorize release of retention; or
4. Provide direction to staff.
ADVANTAGES:
The project is complete. Accepting the improvements will allow staff to close out the
project. Remaining funds in the project account will be used for a second phase of
concrete repair work.
DISADVANTAGES:
The disadvantage of accepting the improvements would be if subsequent deficiencies in
the work are identified. However, the contract documents include a one-year warranty
period for the contractor to address any construction defects that may arise.
ENVIRONMENTAL REVIEW:
The project is categorically exempt from CEQA pursuant to Guidelines Section
15301 (c).
PUBLIC NOTIFICATION AND COMMENTS:
The agenda was posted on Thursday, August 21, 2014. The agenda and staff report
was posted on the City's website on Friday, August 22, 2014. No public comments
were received as of the time of preparation of this report.
